    Fashion law y la protección de la propiedad intelectual en la Industria de la moda en Ecuador

    This research examined the protection of intellectual property in the Ecuador’s fashion industry from a Fashion Law perspective, with the aim of determining whether the current legal framework affectively addresses the needs of this sector. The study was based on the premise that fashion extends beyond aesthetic and commercial considerations, as it also involves creativity, branding, competition, and intangible value. Toa achieve this objective, a qualitative research approach was adopted, supported aby bibliographic, documentary, legal-dogmatic, and comparative methods. The analysis was grounded in the review of the Constitution of the Republic of Ecuador, Andean legislation, the Organic Code of the Social Economy of knowledge, Creativity and Innovation (COESCCI), documents issued by SENADI, and selected legal references from the European Union, the United Kingdom, and the United States. In addition, relevant cases concerning intellectual property protection in the fashion industry were examined, together with the legal mechanisms applicable to imitation, copying, and counterfeiting practices, in order to identify the criteria applied in practice and the limitations of the existing protection system. The analysis revealed that a legal basis for protecting fashion does exist in Ecuador, although this protection appears fragmented, poorly coordinated, and still lacking a coherent Fashion Law framework. It was also observed that trademarks function as the strongest protective tool, safeguarding commercial identity and differentiation within the market, while industrial design focuses more on the product's appearance, although in practice it faces several limitations, and copyright maintains a more restricted and complementary scope. In this context, the research concluded that the Ecuadorian system does protect fashion, but only partially, thus requiring greater coordination, a more consistent institutional response, and more timely mechanisms to address the sector's actual dynamics.

    Uso de samples y fragmentos de audio en la industria musical ecuatoriana y la protección de los derechos de propiedad intelectual

    This research analyses the use of samples and audio fragments in the Ecuadorian music industry and its impact on the protection of intellectual property rights. The study addresses the legal issue that arises when a new musical production incorporates parts of pre-existing works, phonograms, performances or recordings, which may affect copyright, related rights, licences, derivative works and liability for unauthorised use. The general objective was to determine the influence of music sampling on copyright, based on a bibliographical review of its regulatory treatment in Ecuador and international doctrine. The methodology adopted a qualitative, bibliographical and documentary approach, supported by a systematic literature review covering the period from 2020 to 2026. Scientific articles, legal doctrine, Ecuadorian legislation, international treaties and comparative case law were examined. The results show that a sample is not unlawful by its mere technical existence; its legal assessment depends on the protected subject matter, ownership, authorisation, degree of identification of the fragment and economic exploitation. In Ecuador, the Code on the Social Economy of Knowledge, Creativity and Innovation regulates copyright, related rights, derivative works, moral rights and economic rights, but it does not contain a specific rule on music sampling. It is concluded that Ecuadorian artists face legal and economic barriers, such as licensing costs, difficulty in locating rights holders, lack of national precedents and limited technical-legal knowledge. For this reason, the study recommends the creation of guidelines on authorization, licensing and rights management for the lawful use of samples in the Ecuadorian music industry.

    Uso de la inteligencia artificialy la protección de los derechos de propiedad intelectual en la legislación ecuatoriana

    This thesis, “The Use of Artificial Intelligence and the Protection of Intellectual Property Rights in Ecuadorian Law,” constitutes a significant piece of research within the current technological context, given the rapid advancement of artificial intelligence and the challenges it poses to the traditional system of intellectual property rights protection. Consequently, the objective of this research is to analyze the impact of artificial intelligence on the protection of intellectual property rights under Ecuadorian law, considering the main legal challenges arising from the creation of content through automated systems and the need to establish appropriate regulatory mechanisms in response to technological development. To conduct the research, a qualitative methodology was applied, based on a bibliographic-documentary approach. Additionally, analytical-synthetic, historical-critical, inductive, and comparative methods were used, which together made it possible to identify the existing legal challenges. Similarly, semistructured interviews were conducted with judges from the Civil Judicial Unit of Ambato and legal professionals specializing in intellectual property with academic experience, with the aim of obtaining specialized insights to contribute to the analysis of the subject under study. As a result of the research, it was determined that there is an urgent need to promote flexible and up-to-date regulation, either through the reform of the Organic Code of the Social Economy of Knowledge, Creativity, and Innovation or the creation of a specific law on artificial intelligence, which achieves a balance between technological development and the effective protection of intellectual property rights in Ecuador.

    Análisis jurídico sobre la repartición de ingresos originados por obras creadas por inteligencias artificiales

    The present research work titled "Legal analysis of the distribution of income generated by works created by artificial intelligence" primarily focuses on detailing the legal problems that arise when using artificial intelligence (AI) systems to generate a work, due to the lack of effective legal regulations governing the use of AI systems. As a result, multiple legal gaps exist, leading to conflicts at the legal level, particularly in the area of intellectual property rights, considering the creation process employed by AI systems.Therefore, it is pertinent for the government to take the necessary measures, such as urgently updating the legal regulations related to intellectual property, by incorporating the guidelines proposed by international law. Additionally, it is crucial for the government to commit to implementing the necessary mechanisms to address a problem that has a significant economic impact and is gaining strength due to the continuous technological advancements in AI. The topic is of great interest, as the research is framed within a growing issue. Similarly, this work advocates for the establishment of legal guidelines aimed at resolving the problem of income distribution in works created by artificial intelligence. These implications have emerged with recent technological developments.

    Creación de marca urbanista: un análisis comparativo, legal de los registros de marca y patentes de las principales ciudades del Ecuador

    ABSTRACT Since its beginnings, humanity has seen the need to group together in order to protect each other from the dangers that threatened them. This is verified especially in the first forms of human organization, in which clans and hordes were formed, among others. This arose from the need to face those problems that came mainly from nature, such as animal attacks, and even from other tribes. In order to protect themselves from external attacks, and even internal ones, from the beginning human beings had to resort to their imagination and intellect, this to manufacture weapons and defense instruments. These were the first samples of invention in the beginnings of humanity, in which a need is identified and, on the other hand, its solution. Likewise, it is transcendental in the elaboration and manufacture of the answer to the specific problem, the intellect or reason of the human being. The focus of this research is mixed, where the instruments used are qualitative and quantitative, which will allow the validation of the results. In this way, through the quantitative approach, the research tools can be used through data and information. On the other hand, with the qualitative approach it will be possible to corroborate the data obtained through the interview technique. Then, with this approach it will be possible to achieve a broader perspective regarding the phenomenon. For the succession of the present investigation, a deep analysis of the problem had to be carried out, the sources for the collection of data are divided into primary and secondary.

    Registro de marca ciudad y el derecho de Propiedad Intelectual en la legislación ecuatoriana

    The objective of this investigation is to establish the registration of the city brand and the intellectual property right in Ecuadorian legislation, for which the doctrine and Ecuadorian legislation are specified, analyzing whether there is a sufficient legal regulation that protects the trademark registration, comparing with the Colombian and Peruvian legislation and investigating the effectiveness of the procedures established for the registration of trademarks and their impact on intellectual property rights. In addition to the legal protection of intellectual property, each legislation autonomously determines the conditions of its protection. Regarding the methodology, a mixed approach study has been carried out with qualitative and quantitative data, where none of these prevails over the other, with a type of documentary-bibliographical research collecting information on primary and secondary sources with the aim of expanding and base the theoretical support, using theoretical and empirical methods, with an experimental design based on observation. For which, surveys and interviews were carried out, evidencing that there is legal protection on the brand, however there is no specific regulation that protects the city brand right. It is concluded that the purpose of intellectual property law is to defend the brand, and that to achieve this there are different control entities at a national and international level such as the National Intellectual Rights Service and the World Intellectual Property Organization. However, there is a need for legislation that comprehensively protects the city brand from a reform to the regulations

    Derechos de autor en la sobras musicales y los delitos contra la propiedad intelectual

    Al tener en nuestro país un Constitución Garantista de Derechos y principalmente que reconoce a los Derechos de Propiedad Intelectual ha existido en la ciudad de Latacunga inquietudes y molestias por parte de los integrantes de la Asociación de Artistas Profesionales de Cotopaxi, compositores, productores, que a través de las constantes quejas han hecho que se estudie la manera en que se permite por parte de las autoridades que se sigan vulnerando sus Derechos mediante el cometimiento de los Delitos contra la Propiedad Intelectual, por lo cual se menciona en el presente trabajo, los aspectos negativos que esto causa y los incumplimientos que se generan a la Ley de Propiedad Intelectual; cabe mencionar la existencia de una ley, La Ley de Propiedad Intelectual, que controla o debería controlar y defender este derecho que tienen los autores y artistas, pero lastimosamente en la ciudad de Latacunga y a nivel de todo el país, existe la inobservancia de esos preceptos, por lo que resulta necesario el estudio de las razones por las cuales ésta no se aplica y las posibles soluciones para que, en el perímetro urbano de la ciudad de Latacunga, la piratería lesiva y la falsificación de marcas de alguna manera, sea erradicada. A pesar de que existe una amplia cantidad de normas jurídicas al respecto, tanto en la Ley de Propiedad Intelectual, en la Constitución Política del Ecuador y los Tratados Internacionales, no existe información clara y accesible para los ciudadanos en general, con los mecanismos y acciones que pueden tomar para hacer valer y respetar sus legítimos derechos, desinformación que se ve reflejada en el creciente número de tiendas o centros comerciales que se dedican a la reproducción y venta de este tipo de productos discográficos ilegales, además de que las Autoridades del Instituto Ecuatoriano de Propiedad Intelectual no han realizado los respectivos controles a establecimientos que ofertan obras musicales, hechos que impide, de cierta forma, que la cultura e industria musical en nuestro país se encuentre totalmente subdesarrollada, a diferencia de otros países de Latinoamérica y el mundo. La presente investigación estudia este fenómeno de la piratería lesiva y la falsificación de marcas discográficas, así como las normas legales que amparan los Derechos de Autor con la finalidad de llegar a conseguir una solución a la problemática presentada.
