Abstract
This thesis, “The Use of Artificial Intelligence and the Protection of Intellectual Property Rights in
Ecuadorian Law,” constitutes a significant piece of research within the current technological context,
given the rapid advancement of artificial intelligence and the challenges it poses to the traditional system
of intellectual property rights protection. Consequently, the objective of this research is to analyze the
impact of artificial intelligence on the protection of intellectual property rights under Ecuadorian law,
considering the main legal challenges arising from the creation of content through automated systems
and the need to establish appropriate regulatory mechanisms in response to technological development.
To conduct the research, a qualitative methodology was applied, based on a bibliographic-documentary
approach. Additionally, analytical-synthetic, historical-critical, inductive, and comparative methods
were used, which together made it possible to identify the existing legal challenges. Similarly, semistructured interviews were conducted with judges from the Civil Judicial Unit of Ambato and legal
professionals specializing in intellectual property with academic experience, with the aim of obtaining
specialized insights to contribute to the analysis of the subject under study. As a result of the research,
it was determined that there is an urgent need to promote flexible and up-to-date regulation, either
through the reform of the Organic Code of the Social Economy of Knowledge, Creativity, and
Innovation or the creation of a specific law on artificial intelligence, which achieves a balance between
technological development and the effective protection of intellectual property rights in Ecuador.

El presente trabajo de titulación, “Uso de la inteligencia artificial y la protección de los derechos de
propiedad intelectual en la legislación ecuatoriana”, constituye una investigación relevante dentro del
contexto tecnológico actual, debido al acelerado avance de la inteligencia artificial y a los desafíos que
esta genera para el sistema tradicional de protección de los derechos de propiedad intelectual. Como
consecuencia, el objetivo de la investigación es analizar la incidencia del uso de inteligencia artificial
en la protección de los derechos de propiedad intelectual dentro de la legislación ecuatoriana,
considerando los principales desafíos jurídicos que nacen a partir de la creación de contenidos mediante
sistemas automatizados y la necesidad de establecer mecanismos normativos adecuados frente al
desarrollo tecnológico. Para el desarrollo de la investigación, se aplicó una metodologia con enfoque
cualitativo, sustentada en la modalidad bibliográfica-documental, asimismo, se utilizaron métodos
analitico-sintético, histórico-crítico, inductivo y comparativo, que en conjunto permitieron determinar
los desafíos jurídicos existentes. De igual manera, se aplicaron entrevistas semiestructuradas dirigidas
a jueces de la Unidad Judicial Civil de Ambato y a profesionales del derecho especialistas en propiedad
intelectual y con experiencia en la academia, con el propósito de obtener criterios especializados que
contribuyan al análisis del tema de estudio. Como resultado de la investigación, se obtuvo la necesidad
urgente de impulsar una regulación flexible y actualizada, sea mediante la reforma del Código Orgánico
de la Economía Social de los Conocimientos, Creatividad e Innovación o la creación de una ley
específica sobre inteligencia artificial, que logre un equilibrio entre el desarrollo tecnológico y la
protección efectiva de los derechos de propiedad intelectual en el Ecuador.
