Item Integración de derechos para las personas privadas de libertad del centro de privación de libertad Tungurahua n°. 1 y su incidencia en la reinserción social de la ciudad de Ambato, en el periodo 2022(Universidad Tècnica de Ambato, Facultad de Jurisprudencia y Ciencias Sociales, Carrera de Derecho, 2023-03) Toalombo Chango, Santiago Martin; Romo Santana, José LuisThe present titling work with the theme: “INTEGRATION OF RIGHTS FOR PERSONS DEPRIVED OF LIBERTY OF THE TUNGURAHUA DEPRIVATION CENTER N°. 1 AND ITS IMPACT ON THE SOCIAL REINSERTION OF THE CITY OF AMBATO, IN THE PERIOD 2022”, starts from a constitutional premise where Ecuadorian citizens are creditors of all the rights contemplated in the catalog of the Constitution of the Republic of Ecuador, (2008) as well as the Human Rights established by the United Nations Organization. People deprived of their liberty or PPL are limited in certain rights such as liberty and their civil rights before society; but they continue to maintain the other rights guaranteed within the Rehabilitation Centers for Persons Deprived of Liberty, such as the right to education, food, health, work, recreation, among others. Ecuador is currently one of the countries with the most prison violence; due to internal violence due to power disputes between criminal gangs, where the lack of enforcement mechanisms by the Ecuadorian State for the guarantee of the right to life, security, and physical integrity within the Social Rehabilitation Centers for persons deprived of Liberty. The National Service for Comprehensive Care for Adults Deprived of Liberty and Adolescent Offenders - SNAI, as well as the National Police are the entities in charge of providing security within prisons, in recent years their work has been seen poorly, making visible the social achievement that people deprived of liberty live today, placing them in a state of vulnerability within the centers established for the fulfillment of custodial sentences. The international human rights entities play a preponderant role in the investigation since they grant important precepts of application as measures to counteract the prison crisis that Ecuador is experiencing todayItem Intervención del Trabajo Social y los conflictos entre Personas Privadas de la Libertad(Universidad Tècnica de Ambato, Facultad de Jurisprudencia y Ciencias Sociales, Carrera de Trabajo Social, 2023-03) Silva Sánchez, Odalis Micaela; Naranjo Ruiz, Viviana FidenciaThis research focuses on the intervention of Social Work and the conflicts between persons deprived of liberty, which is a fundamental task in order to insert into society, in an adequate manner, all persons who in one way or another need to exercise their rights as citizens. The main objective is to investigate the existing trust between PPLs in the center and how the Department of Social Work has intervened in the face of these problems in the Tungurahua No. 1 Deprivation of Liberty Center. In order to approach this topic, hypothetical-deductive and inductive-deductive research was used as a starting point, as well as the experience obtained by the tutor, within the Tungurahua N°1 Deprivation of Liberty Center. The research level was exploratorydescriptive, with a quali-quantitative approach methodology, using the questionnaire/survey on 'Social Work Intervention in conflicts of persons deprived of liberty'' previously validated by myself, as an instrument of hypothesis verification. The results obtained indicate that both social work intervention and conflicts between persons deprived of liberty is a problem that can be seen in the center. The most existing conflict in the CPL is the verbal one, at the same time the PPLs do not have enough confidence to go to the Social Work Department and ask for help to solve their conflicts, sometimes the families of the PPLs influence this since it is part of the life of the PPLsItem Los derechos humanos de las personas privadas de libertad y su incidencia en el derecho Constitucional a la rehabilitación social en el Ecuador(Universidad Técnica de Ambato,Facultad de Jurisprudencia y Ciencias Sociales, Carrera de Derecho, 2022-09) Villalva González, Diego Alejandro; Acosta Morales, María GabrielaThroughout history, social rehabilitation centers in Ecuador, have been characterized for having penitentiary overpopulation, and it is taken to annual index of overcrowding around the 29.83%. This problem has big consequences, for example, people who is deprived of their liberty do not have adequated places to sleep, also do not have access to food, health and obviously education, they can not participate in cultural, social and sport activities, not even to workshops, capacitation and work programs. Those issues, and the deficient penitentiary infrastructure, and also a lack of well-prepared human personal, absence of programs and treatments to drug addiction, lack of control in the entrance of prohibited arms inside the penitentiary, corruption inside of it, are elements which allow some places to violate Human Rights of people who is deprived of their liberty and also make impossible the aim of social rehabilitation, making that this centers just contribute to improve their abilities to continue being criminals. Now, in this context, the present investigation is trying to give a response to the main question: Is respect of Human Rights a helpful tool to accomplish the constitutional right of social rehabilitation? And for getting and answer to this, was used a methodology with a quantity and quality focus and also deductive reasoning. This investigation project possesses a big scientific value, because the problem has not been analyzed yet for many investigators.Item Visión a los derechos de las personas lesbianas gays bisexuales transexuales intersexuales en el sistema penitenciario ecuatoriano(Universidad Técnica de Ambato, Facultad de Jurisprudencia y Ciencias Sociales, Carrera de Derecho, 2022-06) Peña Sailema, Jéssica Samantha; Tite, RamiroIn recent years, the reality and socio-legal situation of sexual minorities has been distinguished; supervened by the systematized existence of violence and discrimination, which has been legitimized by society itself, for reasons of gender identity or sexual orientation. The theme of this research is directed to the study of the Rights of Intersex Lesbian Gay Bisexual Transsexual people in the Ecuadorian prison system.LGBTI people are shown as one of the most vulnerable groups from the perspective of rights, they become invisible subjects, victims of abuse, cruel treatment and social ostracism, which directly affects their personal integrity and holistic development. Through doctrinal and legal research, the living conditions and the situation of the rights of LGBTI people held in detention centers will be analyzed.For the methodological foundation, sources of information, methods and research techniques relevant to the development of the research were used, through the application of a survey to a selected group of legal professionals, LGBTI people and other interested parties related to the subject; allowed to respond to the objectives set, reaching the conclusions and recommendations that conjecture the purpose of this investigation.In this way, it is visualized that the Ecuadorian prison system, as it is currently conceived, only makes a difference between men and women, limiting and arranging social rehabilitation centers and pavilions for these two types of gender, but it does not consider people of other genders that coexist in society. In this sense, emphasis is placed on a prison system that manages inclusive and egalitarian social rehabilitation, considering sexual orientation or gender identity, with the purpose of safeguarding the freedom and individual rights of all persons deprived of liberty, including the group. of Lesbians, Gays, Bisexuals, Transsexuals, Intersexuals, in this way the perspective of gender and sexual diversity would be gradually incorporated in Ecuador.Item Relaciones familiares en personas privadas de libertad sentenciadas por delitos en contra de la familia(Universidad Técnica de Ambato,Facultad de Jurisprudencia y Ciencias Sociales, Carrera de Trabajo Social, 2022-03) Jurado Realpe, Maite Soledad; Campoverde Quijano, Edga MaribelPart of the problems that human facing up related to the family context, the parenting style with which we are educated and the environment in which we grow up are the essence in the development of all life itself. Therefore, these factors will depend on the quality of family relationships and their ability to overcome crises during the family life cycle. In the context of those deprived of liberty, these relationships may or may not be affected by distance and in this case by committing the crime towards the family. The present investigative study was carried out with the purpose of knowing the family relationships of the people deprived of liberty who committed a crime against the family, for which a qualitative-quantitative approach was used, for the focus qualitative, work was focus based on semi-structured interviews, while for the focus quantitative the FF-SIL test was used, which allows knowing family functionality, and the Family Apgar, to size the level of satisfaction. The total population of the study was 30 PPL from the Tungurahua N1 Deprivation Center. Based on the data, it was obtained that the family relationships of persons deprived of liberty, sentenced for crimes against the family, have not been affected for the most part, since they have already suffered a breakdown at some point in the life cycle. family.Item Identidad de género y resiliencia de las personas lgbti+ privadas de libertad en la sección de varones del centro de rehabilitación social regional sierra centro norte Cotopaxi(Universidad Técnica de Ambato. Facultad de Jurisprudencia y Ciencias Sociales, Carrera de Trabajo Social, 2020-08) Villarroel Herrera, Cinthya Lizbeth; Quiroga López, Malena KarinaThe purpose of this research is to know if gender identity influences the resilience of LGBTI + people, deprived of liberty in the men's section of the Rehabilitation Social Center Regional Sierra Centro Norte Cotopaxi, where the main problem lies in analyzing how People defined as LGBT + have been building their gender identity and how this process has helped to build the resilient capacity of this group of people. In Ecuador, the number of persons deprived of liberty every day is widespread, however, there is no certain number of how many people with different gender identities are recruited in prisons since this group is difficult to identify due to Different social and personal factors. It has been considered important to take into account the variables gender identity and resilience because they are important factors for the personal development of an individual within society, information has been collected through a mixed approach taking into account techniques and instruments that we allow to test the hypothesis raised, with the participation of 12 people openly declared LGBTI + within the men's sections of the liberty deprivation center, the same ones that have been interviewed and applied a Connor-Davidson resilience test (CD-RISC 25) in order to obtain results. The objective was to determine the incidence of quality of life in mental health of inmates, after the investigation it is determined that several dimensions of the quality of life in prison correlate with mental health, specifically the dimension Coexistence and cordiality with anxiety and insomnia, objective life conditions with anxiety and insomnia and objective life conditions with social dysfunction. In accordance with the results obtained, a clear and concrete view can be seen about the perspective that the inmates have about the quality of life inside the penitentiary; the most influential aspects in the deterioration of their mental health of the LPP are also presented. The characteristics that define the situation of the people incarcerated in Ecuador are the corruption of the penitentiary system; the economic dependence of the prisoner on his family in order to survive the confinement and the systematic violation of his fundamental rights. It is intended to identify, reaching an analysis of the reasons that have caused serious internal commotion in the Penitentiary System, establishing mechanisms to avoid the violation of constitutional guarantees of the utmost importance and the rights of persons deprived of liberty with a conviction. The Right to have a true control body of the persons deprived of liberty who have obtained the conditional suspension of the sentence, constitutes the paradigm of the investigation, because its main objective is the legal protection of rights, which are not they can be violatedItem Vinculos familiares y el plan de vida de las personas privadas de la libertad hombres de mediana seguridad del pabellon B"A del centro de rehabilatación social Regional(2016) Solís Araujo, Belén Carolina; Naranjo Ruiz, Viviana FidenciaLas personas privadas de libertad han sido etiquetadas por la sociedad únicamente como delincuentes y como personas que han infringido la ley, implicando siempre un estigma que recae sobre la persona privada de libertad y la familia, tanto durante como después del proceso de encarcelamiento, ante la situación planteada lo que se pretende es transformar las perspectivas de vida de las personas privadas de libertad y de la sociedad, basada en el fortalecimiento de los vínculos familiares, considerando que es el principal medio social de los seres humanos y de no fortalecer, se espera la reincidencia y el aumento de la población carcelaria. En este trabajo investigativo se presenta a la familia como el primer contexto social al que pertenecen los seres humanos, es un sistema integral constituido por cada uno de sus miembros, que si un individuo o subsistema familiar flaquea en su funcionamiento la totalidad del sistema familiar se ve afectada y al mismo tiempo sus vínculos familiares, considerado esto como la estructura básica del funcionamiento en que los miembros guardan entre sí una relación. Es evidente entonces que cuando una persona es privada de su libertad provoca en su familia un desequilibrio en todos los aspectos, además induce a la separación física, es decir una ruptura de la convivencia, de los vínculos, de la comunicación y en algunos casos, incluso puede provocar la ruptura definitiva de la relación familiar. Es imprescindible entonces fortalecer los vínculos familiares conjuntamente con un plan de vida individualizado que responderá a las capacidades y necesidades de cada persona, es decir que el plan de vida debe ser construido, ejecutado y evaluado durante la permanencia en el centro de rehabilitación, además de acuerdo al cumplimiento del plan de vida la persona privada de libertad podrá avanzar, mantenerse o regresar en los pabellones de mínima, mediana y máxima seguridad, de acuerdo al Modelo de Gestión Penitenciaria
