Item Los derechos reproductivos y la protección del derecho a la Maternidad de la trabajadora dependiente(Universidad Técnica de Ambato, Facultad de Jurisprudencia y Ciencias Sociales, Carrera de Derecho, 2025-03-27) López Garcés, Vanessa Elizabeth; Masabanda Analuiza, Galo IvánThe right to work is a fundamental right that is protected and guaranteed in the Ecuadorian constitutional order, both for men and women who carry out a dependent work activity on a daily basis. In this sense, in the fulfillment of labor obligations, those who have been the most vulnerable of all acquired rights are working women, even more so when they are or are linked to the reproductive role, such as in a state of pregnancy, motherhood and lactation; the lack of protection that they often face in the state of motherhood is worrying, since this is considered a crucial stage for their well-being and that of their children. Therefore, the objective of the research is to carry out a study that allows to determine if reproductive rights and the protection of the right to motherhood of the dependent worker in the public and private sector are guaranteed in Ecuadorian labor legislation. For this, an exploratory study supported by a mixed methodology is applied starting from a qualitative study to end with a quantitative study, achieving a comprehensive view of the situation; Therefore, it is immersed in the line of research on “social exclusion and integration.” The main result is that, despite the existence of regulations that support the protection and maternity leave of dependent workers in Ecuadorian labor legislation, there is a significant legal loophole for those workers subject to the Labor Code in relation to those in the public sector, since they are not protected in the event of the death of their newborn children within the period of maternity leave granted. Concluding that there is an urgent need to reform labor legislation and thus guarantee comprehensive protection for workers subject to the Labor Code in the event of the loss of their newborn child.Item Funcionalidad familiar y maternidad en la adolescencia de la población femenina en la Facultad de Jurisprudencia y Ciencias Sociales de la Universidad Técnica de Ambato(Universidad Técnica de Ambato. The stories presented here, investigates the motherhood, sexuality and family dynamics of the first family nucleus that welcomed, educated and cared for them, this being the fundamental pillar for the optimal development of an adult; in addition to knowing the problems or challenges that young mothers faced when they decided to have their baby.Item Laberintos de cristal y el acceso de la mujer a puestos docentes universitarios en la Facultad de Jurisprudencia y Ciencias Sociales de la Universidad Técnica de Ambato(Universidad Técnica de Ambato, Facultad de Jurisprudencia y Ciencias Sociales, Carrera de Trabajo Social, 2019-05) Sánchez Changoluiza, Héctor Bolívar; Haro Lara, Aida PatriciaThe present research entitled glass labyrinths and the access of women to university teaching positions in the Faculty of Jurisprudence and Social Sciences of the Technical University of Ambato; is developed through qualitative and quantitative methodology has been used the Gender Ideology Scale (EIG) whose objective is to identify the labyrinths of glass and the questionnaire on the attitude towards the work of university professors that allow women's access to positions university teachers. Theories about gender discrimination have evolved throughout history, the inequality of opportunities between men and women prevails in society basically determined by circumstances that are outside the gender ideology, the double work-family responsibility of the Woman has been termed as glass labyrinths manifesting as an invisible barrier associated with marital status, motherhood, professional and personal success, which over time have been assigned as responsibilities of women. The access of women to university teaching positions is linked to the factors of professional training, occupational factors and personal characteristics, in this way they have managed to conquer hierarchical positions that were exclusively occupied by men, in recent times it is no longer only carried out as mother or wife; has faced new challenges so when women speak they do not always do it as mothers, wives or friends, they also do it as lawyers, engineers, graduates, etc.Item Maternidad universitaria y el impacto generado al asumir esta doble condición(Universidad Técnica de Ambato, Facultad de Jurisprudencia y Ciencias Sociales, Carrera de Trabajo Social, 2018-09) Criollo Espín Cristina Alexandra, Cristina Alexandra; Altamirano Altamirano, Silvia JovannaThis article aims to identify the difficulties and the impact that this double condition of student-mother produces. A descriptive study whose sample was 50 mother students from the Faculty of Jurisprudence and Social Sciences. The results found reveal: a high rate of unplanned pregnancies (80%), the first source of support especially in single women is the family of origin. The conciliation of these roles has consequences for the academic performance of the mother student, there was not a right couple support in all the stages of pregnancy and maternity related to single women. The strong impact that is generated due to this double condition, is mainly in the life style of the university students, many of them were not prepared to assume these roles which generates a break in their family and social circle.Item Madres y estudiantes universitarias: relación entre deserción y/o interrupción escolar , el caso del al Facultad de Jurisprudencia y ciencias sociales de la Universidad Técnica de Ambato(Universidad Técnica de Ambato, Facultad de Jurisprudencia y Ciencias Sociales, Carrera de Trabajo Social, 2018-09) Ortega Tello, Karla Maritza; Paredes, TeresaThe present work addresses the concern mothers and college students: the relationship between school dropout and / or school interruption. The case of” Facultad de Jurisprudencia y Ciencias Sociales “from “Universidad Técnica de Ambato-Ecuador”. The main objective of this research is to identify the gender determinants, and the support received for the students to remain in the faculty. A mixed research approach was used. Attempts were made to investigate the support received by the student mothers as a possible reconciliation to the problem, resulting in the almost entirely mother students receiving support from their families to complete their university studies.Item La maternidad subrogada y el derecho a la reproducción(2015) Vicuña Pardo, Andrea Anabel; Santamaría, Juan PabloLa presente investigación persigue la regulación de la maternidad subrogada en el ordenamiento jurídico ecuatoriano, permitiendo así que las parejas que se ven opacadas por la imposibilidad de procrear, ya sea por problemas atribuidos a la infertilidad o esterilidad, puedan hacerlo y de esta manera hacer efectivo su derecho a la reproducción. Desde el aspecto jurídico la maternidad subrogada es el acto que genera el nacimiento de un niño gestado por una mujer sujeta a un pacto o compromiso, mediante el cual debe ceder todos los derechos sobre el recién nacido a favor de una pareja que figuré como padres de éste. En la legislación Ecuatoriana son pocos los datos que se encuentra acerca de la maternidad subrogada, este tema ha sido tratado con poca importancia tanto así que en el año 2000 se creó un proyecto de Ley de Familia, en el que incluía este tema, sobre su regulación y el tratamiento que se debe darse a estas técnicas reproductivas, lamentablemente solo quedó en proyecto y no se llevó a cabo la promulgación de tal ley. Pese a que el Estado Ecuatoriano no participa directamente en el proceso de la reproducción a través de la maternidad subrogada, sí tiene una participación y responsabilidad considerable en la creación de políticas sanitarias, administrativas y sobre todo normas legales que regulen este tipo de prácticas. Esto significa que se incorpore en la Ley Orgánica de Salud las condiciones técnicas para la aplicación de la maternidad subrogada, así como también la idoneidad y capacidad de los médicos y las clínicas que prestan estos servicios. Además que es necesario que los médicos de nuestro país se capaciten acerca de las nuevas técnicas de reproducción asistida ya que la esterilidad y la infertilidad con el pasar del tiempo se convertirán en problemas de salud pública y deberá ser incluido dentro de nuestro ordenamiento jurídico para darle una solución. This research aims to regulate surrogacy in the Ecuadorian legal system, allowing couples who are overshadowed by the inability to procreate, either by problems attributed to infertility or sterility can do so and thus make effective their right for reproduction. From the legal aspect, surrogacy is the act that generates the birth of a child gestated by a woman subject to an agreement or commitment, by which you must give all rights to the newborn for a couple who figured as his parents. In the Ecuadorian legislation there is few data about surrogacy, this issue has been dealt with so little importance, such is the 2000 Family Law draft, which included this issue on aspects like its regulation and treatment to be given to these reproductive techniques; sadly, it remained a project only and was not carried out the enactment of such a law. Although the Ecuadorian State is not directly involved in the process of reproduction through surrogacy, it is its responsibility for creating health policies, especially administrative and legal rules governing this type of practices. This means that it should be incorporated into the Organic Health Law, technical conditions for the implementation of surrogacy, as well as the suitability and capability of doctors and clinics that provide these services. In addition it is necessary that doctors in our country are trained on the new techniques of assisted reproduction as sterility and infertility with the passage of time will become public health problems and should be included in our legal system to give a solution.
