(Universidad Técnica de Ambato, Facultad de Jurisprudencia y Ciencias Sociales, Carrera de Derecho, 2026-07-08) Acosta Acosta, Maria Belen; Chagcha Solis, Carlos Julio
This thesis, “The Use of Artificial Intelligence and the Protection of Intellectual Property Rights in Ecuadorian Law,” constitutes a significant piece of research within the current technological context, given the rapid advancement of artificial intelligence and the challenges it poses to the traditional system of intellectual property rights protection. Consequently, the objective of this research is to analyze the impact of artificial intelligence on the protection of intellectual property rights under Ecuadorian law, considering the main legal challenges arising from the creation of content through automated systems and the need to establish appropriate regulatory mechanisms in response to technological development. To conduct the research, a qualitative methodology was applied, based on a bibliographic-documentary approach. Additionally, analytical-synthetic, historical-critical, inductive, and comparative methods were used, which together made it possible to identify the existing legal challenges. Similarly, semistructured interviews were conducted with judges from the Civil Judicial Unit of Ambato and legal professionals specializing in intellectual property with academic experience, with the aim of obtaining specialized insights to contribute to the analysis of the subject under study. As a result of the research, it was determined that there is an urgent need to promote flexible and up-to-date regulation, either through the reform of the Organic Code of the Social Economy of Knowledge, Creativity, and Innovation or the creation of a specific law on artificial intelligence, which achieves a balance between technological development and the effective protection of intellectual property rights in Ecuador.

Local development deeply values knowledge, creativity, and the ability to generate innovation within the productive environment of each territory. For this reason, it is essential to have qualified human capital and solid organizational structures, which are nourished by both local knowledge and national and international experiences. This allows for a wide diversity of techniques, products, preferences, cultural and political expressions, opening up multiple possibilities for progress adapted to the particularities of each region. Thus, development is built on constant innovation, the circulation of knowledge, and collaboration among diverse actors, integrating key elements such as entrepreneurship, cooperation between the public and private sectors, the active participation of civil society, and the strengthenimg of local institutions. Therefore, the general objective is to determine the influence of local development on the well-beimg of the Emilio María Terán community. For this purpose, qualitative methods, field research, and bibliographical research were used. This allows us to conclude that the majority of respondents do not perceive a real or effective integration of environmental conservation policies im their community. Indicating that there is a clear need to strengthen environmental actions, increase their visibility, and generate greater community participation in these types of policies.

Communication is a key factor in the development of social and professional relationships. For this reason, the development of information and communication technologies (ICT) has encouraged public and private institutions to adapt their strategies to the new needs of the population, as they have the ability to project credibility to build social trust. However, they are also a tool that can discredit the image of a person or institution, such as what is happening in the political sector in Ecuador, as citizens distrust the actions of the president, assembly members, mayors and councilors. In this context, the objective of this research is to find whether there is innovation in the communication products of four public institutions in Ambato, and to analyze the state of citizen trust. For this purpose, the research used qualitative and quantitative methodology, with interviews to five communication specialists, surveys applied to 385 people and comparative analysis of 25 publications describing the content on the social network Facebook. According to the data obtained, there is evidence of a lack of innovation in communication strategies and the style of presenting information, even though, in the case of the Municipality of Ambato, "El Informative" was implemented. In addition, the lack of socialization, compliance with proposals and promotion of citizen participation were also cited as reasons for distrust.

The aspects discussed in this project are important and represent the bases of the communication problems arise from the little diffusion is given to certain types of contents, with respect to the subject we can take as base the culture is all the aspects that they allow us to survive in society and, by attaching to this, manifestations of culture become a representation of identity and also, in complex forms of organization for certain groups that make them a way of life, a way of survival, a social innovation. There is social innovation in the Cultural field in Ambato but it has a very slow growth due to the little use of communication strategies and products, there is a considerable amount of groups and cultural presentations, however very few people get to know of their activities and although Many times large institutions such as the “Gobierno Provincial Nucleo de Tungurahua” directly or indirectly support cultural groups to transcend their activities remain hidden for the majority of citizens. Even about 80% of people are not aware of most of the activities that will be or are being done in the city. The study was conducted between December 2016 and January 2017. The study was conducted through interviews, surveys and observation sheets with managers and members of cultural groups, as well as managers and with a percentage of young people from Ambato aged between 20 and 29, ages in which it’s considered that the possibility of Innovate is greater possibilities to take an interest in cultural activities. This study seeks to place cultural journalism as an alternative to generate social innovation. The acceptance of the diffusion of cultural activities in Ambato and the appropriation of the identity of the young people would generate a greater interest that would help to the evolution of this type of journalism.
