    Análisis jurídico de la Sentencia No. 2064-14-EP de la Corte Constitucional y la Suplantación de Identidad con contenido sexual

    Identity is understood as the set of personal data that singles out an individual within social relations. The growing technological progress that is evident today causes society to change the way it relates to other individuals. In this sense, personal data shared in digital networks are susceptible to be used without the consent of the owner by third parties for criminal purposes that infringe legal rights such as property, identity and privacy. In this context, the use of sensitive personal data with the purpose of impersonating the identity with sexual content is frequent, even more so in an increasingly digitized world. This conduct violates traditional rights such as intimacy, privacy, image, honor, dignity and protection of personal data. These rights enjoy constitutional legal protection; however, it is necessary that the law adapts to the new modalities that arise in the digital environment. In such a way that, the criteria adopted by the Constitutional Court in judgment N°2064-14-EP/21 must be incorporated into the legal practice. Therefore, this research through the application of an explanatory methodological framework aims to analyze the influence of Ruling N°2064-14-EP/21 in the criminal legal framework of Ecuador. To obtain and analyze the information leading to the execution of the project, inductive, analytical, synthetic, historical and comparative methods were used. In addition, seven interviews were conducted with prosecutors, criminal judges and lawyers in free practice, to know the perception of the professionals about study. The relevance of the research lies in the need for an adaptation of the criminal law to punish the crimes that arise in the digital environment. For which, the research line adopted by this project is Communication, Society, Culture and Technology. The results of the research show that the sentence under examination contains fundamental criteria for the analysis of the rights that arise in the digital era and for the determination of criminal liability for the conduct of impersonation with sexual content in the digital context. In addition, through comparative law, it has been verified that the Ecuadorian criminal law does not guarantee a real protection of the rights of the victims of digital crimes, since it does not contemplate a comprehensive reparation.

    La industria de la música y la construcción de identidades en la juventud

    Music is a part of everyone’s life. From the moment we become aware, music can be enjoyed, but it also serves as a means of expression, a form of communication, and a set of values or customs. It is important to consider that youth is a stage in life where people can explore and learn about various topics, as it is the transition to adulthood. For this reason, music can be a tool to address these topics, alleviate intrusive thoughts, manage emotions, and serve as a means of connection with peers or older individuals. The research project “The Music Industry and the Construction of Identities in Youth” analyzes the musical genres listened to by young people as a means of constructing identities during youth, not merely as a form of entertainment. The objective of this research is to determine the relationship between different musical genres and the construction of identities in youth. The methodology used is quantitative, with a sample of 377 young students from the Universidad Técnica de Ambato at the Huachi Campus. A survey was conducted asking about musical preferences and various situations in which music is listened to. The study highlights those genres such as Pop, Hip-Hop, Rock, and Reggaeton, along with platforms like YouTube and Spotify, shape young people’s musical preferences and, consequently, their identities. This validates the hypothesis that music influences youth identity. It is concluded that music not only reflects individual values and emotions but also serves as a link for young people to integrate into groups with shared interests. This is reinforced by the ability of cultural industries to project musical genres that connect both locally and globally.

    Más allá de la hibridación metamorfosis cultural enfocada a los atuendos tradicionales de la comunidad

    The project developed below aims to make visible the existence or not of a cultural hybridization focused on the traditional clothing of the Panzaleo community. It begins by contextualizing a little of the history, organization, beliefs, customs and traditions of the inhabitants of Cotopaxi, reinforcing what is described from three categories: territorial, symbolic and economic. To summarize the above, we studied the theoretical arguments based on authors such as Canclini, Flores and Velasco, who share similar concepts around a cultural hybridization and territorial detachment that exists in the Panzaleo community. This is a consequence of globalization, which not only impacts the economic environment of indigenous peoples, but also distorts their customs and traditions. The symbolic analysis takes as referring to their traditional festivals where the main characteristic feature of their celebrations is reflected especially in their garments, created on the basis of their beliefs and ideologies and shaped by their embroidery and necklaces that adorn and identify them. In addition, the economic situation of the Panzaleos has a history since the arrival of the Spaniards and the introduction of new anti-agricultural regulations in the 1980s and 1990s by the state, where the consequences of these changes are increased poverty and migration

    La percepción del mensaje historico- cultural de la fiesta del Inga Palla por parte de los niños y niñas de Tisaleo

    Popular festivities are high cultural richness traditions. With them we can look back in time and identify high important events that catalyzed the sociocultural expressions, where elements like transculturation, acculturation, communication, identity, culture and values get together. The celebration of the Feast of the Inga Palla in the Tisaleo canton is of vital importance to search, recover and preserve the memory of the place Children play a remarkable role in the festivity, they are consumers, producers and diffusers of this cultural events. That is why is so necessary to understand their perceptions and produce guides for the development and learning of this cultural identity events. In order to describe and understand the phenomenon based on their experience built from the individual point of view and from their collective perspective, it was necessary to use qualitative methodology within an empirical phenomenological interpretative framework. In addition, semi-structured interview techniques were used with characters that participate in the celebration directly and indirectly and; graphic elucidation with children. The results determined that children give very positive value meanings to this historical and cultural event, they provide a less devotional meaning but magnify it as a space for cooperation maintaining a high degree of belonging to it. Direct observation, participation and interpersonal oral communication, especially with their parents, are the main ways in which they acquire knowledge regarding the party because there are no communication strategies addressed to them.

    Análisis del proceso cultural de la cosmovisión Andina del Cantón Guamote

    This research is a way of interpreting, guiding a series of ideas, senses around the social and natural context that surrounds men within the Andean Region, through the Worldview, as this ideal form has been called in the region. of the Andes. For this reason it is developed in Guamote, one of the ten cantons that make up the province of Chimborazo, is a population in which these elements of the Andean Cosmovision are present in the dialogue with contemporaneity. Its social composition, of indigenous prevalence. In addition, there are some symbolic markers of his Living Culture: The Carnival, whose central element is the designation of festive charges and gifts; The Semana Mayor, which includes a series of indigenous celebrations; The Fair of agricultural products, which appears as the largest in the province and still serves as a weekly place of intersection and exchange of survival elements. In addition to these elements, the life of the Guamote canton could be defined as its urban area and its rural area, composed of the latter, by social units known as Peasant Communities whose political and social organization continue, so I am concerned to write this thesis that We will discover in this process.

    La identidad cultural y el ejercicio de los derechos

    The purpose of this research work is to guarantee the right of nationalities of indigenous peoples whether or not recognized by the Constitution of the Republic of Ecuador; under the norms established in our constitution is a state of rights and justice; due to the discrimination, xenophobia and other related forms of intolerance and racism that exist on the part of the mestizo society, because on the other hand, it must be taken into account that the communities and indigenous peoples maintain their own and ancestral cultural identity. The situation of the human rights of the indigenous peoples and of the minorities in the town of Salasaka has been extremely precarious. The right to cultural identity is a fundamental right that until now has not been fully effective, even with the full support of international organizations, declarations and conventions. So far, the only binding instrument turns out to be ILO Convention 169 regarding indigenous peoples and some declarations for the case of national minorities and their members, a situation that should be modified in the future.

    El personaje de la Mama Negra com representación social y su simbología en la fiesta de la Santísima tragedia o capitanía realizada en septiembre en Latacunga

    The present work of investigation has determined the Symbology of the Feast of the Most Holy Tragedy or Captaincy held in the month of September in the Latacunga city, obtaining as a general objective: To establish which are the symbolic and social representations of the character of the Black Mama in the popular party of Latacunga, to give fulfillment to this end was preceded by interviews with the characters of the Black Mama, Organizer, Prioste, a Historian and a Journalist about the festival of the " Santísima Tragedia¨, ", once the Results We proceeded to the interpretation by analyzing the testimonials identifying quantifiable variables according to the premise of the research or hypothesis. And as a result of this research project, it focused on the production of an informative magazine about this cultural expression, which is aimed at the general public, valuing in such a way that the Black Mama festivity is a relevant cultural phenomenon, representing a symbiosis of indigenous, Spanish and African cultures. The reason for the execution of an informative magazine is given by the fact that the mediatization of the representations and symbols of the Traditional festival of Santísima Tragedia o Capitanía held in September have a low character in the dissemination of its elements structuring and celebration, limiting the knowledge of the cluster of all its elements even by the native inhabitants of the city, in this way it is expected to awaken interest in citizenship and begin to value this cultural expression even more in order to follow preserving this type of Intangible Cultural Heritage

    El derecho a la identidad y el interes superior del niño, en el Cantón Ambato, Provincia de Tungurahua

    The right to identity and the best interests of the child, has the purpose of the present investigation that respects the right to be recognized by their parents from the moment of birth and if for some reason they do not enjoy the same surname, the injured can access the claim and investigation of paternity at any time of his life, where there is no prescription for time and may even be done by the father or mother, who guarantees the State, together with the laws, the enjoyment of the right to be recognized by their parents, which is the fundamental to be able to access other rights, such as providing food, being involved in inheritances etc. In view of the fact that it is a social problem that generates rejection and discrimination because it is called illegitimate children, it is a subject that must be studied, generating quick solutions since it is more than sufficient the lack of love and family dysfunction, since unexpected children tend to suffer from birth, diverse behaviors of their parents, which vary from acceptance, resignation and refusal to take responsibility. The last point is key because without it the normal performance of the child's life will not be the same as the legitimate ones, let alone full, that is why the State is responsible for fulfilling its right and any person who has an interest on the same one it will be able to impel the action of investigation of paternity and as main cause that there are no obstacles, much less contradictions with the Constitution, no law that can be extinguished or prescribe the right to take the last name of its parents.

    El cine: Forma de auto representación de los imaginarios colectivos Kichwa Otavalo

    The present investigation is developed with the objective of analyzing the forms of representation of the filmmakers Kichwa Otavalo in his cinema through a process of identification of the characteristics of narrative, image and audio, observing the reflection of cultural identity through the creation and recreation of reality and the product of different creative and technical processes that develop. This research is based on the application of a qualitative methodology, from a process of reflection through documentary and bibliographic research, as well as the observation and analysis of six films made by Kichwa Otavalo directors and interviews to two filmmakers of the works that were the object of study of the present. Through these obtained data, self-representation can be established as a form of expression through cinema, either premeditatedly or through the spontaneity of the cultural context of the directors, knowing their concepts and application processes within the cinematographic language. say, the narrative, the image and the audio. This work has allowed us to generate an approach to what it means to make films from the multiple realities that exist among Ecuadorian filmmakers, in this case the Kichwa Otavalo cinema, knowing the symbolic elements that make up his works and the discursive delineation that his works imply creative and technical processes, so we propose the following question for the development of this research: Is this cinema produced to create processes of identity claims? And from a glance at the historical processes of Ecuador, we elucidate that the representation of the peoples tends to be a stereotype in the collective imagination, partializing a mistaken concept that revolves around the figure of the indigenous person who has been endowed with characteristics with which they do not identify themselves, that is to say, the wild, uncivilized and mystical indigenous. Does community cinema thus emerge as a necessary tool for self-representation as Kichwa Otavalo?

    La comunicación organizacional y la imagen corporativa del Gobierno Autónomo descentralizado Parroquial de Rio Negro del Cantón Baños de Agua Santa de la Provincia de Tungurahua

    This thesis focuses on the research and analysis of organizational communication and the corporate image of the Autonomous Decentralized Parochial Government of Río Negro of the Baños de Agua Santa canton of the Province of Tungurahua. Its content includes important aspects regarding the achievement of the established objectives, in order to benefit the chosen institution and strengthen the knowledge acquired in regard to the population. It is important to note that the first data were collected in the same place through surveys of the population and an interview given by one of the officials of the Parish. Their interpretation and analysis contributed to the collection of information to formulate conclusions and recommendations that are consistent with the reality of the institution. The research project consists of six chapters in which different topics were studied to help identify the dynamics and flow of organizational communication of the Autonomous Decentralized Parochial Government of Río Negro of the Baños de Agua Santa canton of Tungurahua province, in order to analyze the importance of corporate image. Once the necessary information was acquired, the proposal was made, which contains the corporate brand and identity manual focused on improving organizational communication and the corporate image of the government institution thus achieving its positioning in image, identity, recognition and reputation. through a joint empowerment with officials and their inhabitants.
