    Normas y protocolo de atención integral aplicados a mujeres víctimas de violencia intrafamiliar que acuden al Hospital básico de Baños

    Domestic violence against women has received special attention from international organizations; all countries have national programs, norms and protocols, care networks and human resources trained on the subject. However, the implementation of these policies has faced limitations, be they due to difficult access or ignorance on the part of the victims. For this purpose, the Ministry of Public Health of Ecuador, creates within the main points of attention of health establishments, first reception rooms in the external consultation services mainly and emergency where women victims of intrafamily and social violence are received. The main objective of this work is to evaluate the standards and comprehensive care protocol that are applied in the treatment of patients who are victims of violence who attend the Basic Hospital of Baños, in order to obtain effectiveness in the tools and techniques of biopsychosocial intervention. Same that will be analyzed through a methodological journey. Starting with the application of the survey technique, through the collection, classification and analysis of the information, the women victims of domestic violence will be identified and the effectiveness of the intervention will be established by the multidisciplinary team of Health professionals, in order to guarantee timely access to services that provide them with a correct and immediate reception, medical and psychological care and subsequent legal guidance, achieving recovery and reintegration into the family nucleus of the users

    Aplicación de medidas de protección en delito de violencia psicológica y afectación del principio de inocencia en el cantón Alausí, período 2017 – 2018

    The purpose of this academic investigation is to determine the main causes that AFFECT THE INNOCENCE PRINCIPLE IN THE APPLICATION OF PROTECTION MEASURES IN THE CRIME OF PSYCHOLOGICAL VIOLENCE. And to propose that effective judicial protection be guaranteed by justice administrators and guarantee the right established in the Constitution of the Republic of Ecuador, Universal Declaration of Human Rights and the American Convention on Human Rights, without causing damage to the procedural parties. In the Organic Integral Criminal Code in its article 558, it establishes the protection measures in favor of the victim or members of the family nucleus in the case of domestic violence. This measure currently constitutes an important means for the protection of victims of violence, however, ignorance has caused the inappropriate use of protection measures, which seriously affects the rights of the accused mainly the right to be heard. The importance of this research lies in achieving an effective, timely application and complying with the principle of legal certainty as provided by the Constitution of the Republic of Ecuador, so it is necessary to conduct an analytical, legal and doctrinal study of the measures of protection, in such a way that effective solutions can be proposed in the face of bad application, which allow equal protection and treatment to the procedural parties. The present study of qualitative type, applied the descriptive and deductive methods, following the line of investigation of technical and doctrinal foundations of criminal sciences in Ecuador, having as main result, the criterion of the lawyers of free exercise of the canton Alausí, is to optimize the procedure for issuing protection measures, without affecting the basic principles and guarantees and the constitutional principle of presumption of innocence.

    La reparación material y la tutela judicial efectiva a víctimas de violencia intrafamiliar en la provincia de Bolívar

    The fundamental rights of all human beings are the most precious value for the existence of life. That is why, the primary duty of the State is to guarantee its effective enjoyment established in the constitution. By virtue of this mandate, there is a requirement to have regulations that are aimed at safeguarding all the needs and events of people's behavior. One of the great social problems that our society has is the constant violation of the rights of those people who are victims of domestic violence and that the legal system, through regulations, is aimed at the restitution of rights. That is why, the present investigation carried out, is aimed at verifying, if in the processes of domestic violence, there is an adequate material reparation as financial compensation, which is intended to protect the rights of the victims; and, under which regulations and parameters, the justice operators of the Judicial Units of the province of Bolívar, base and motivate their resolutions, taking into consideration the jurisprudence and criteria of the Inter-American Court of Human Rights, which constitute application and compliance mandatory for justice operators. And, finally, to verify the criteria of ordinary Judges, with that of Public Prosecutors and Defenders, legal professionals who are in the litigation of domestic violence processes and know first-hand, whether there really is a true protection effective judicial in the material reparation of victims of domestic violence, through regulations that allow it to be applied in judicial processes.

    La limitación del grado de parentesco en las infracciones de violencia intrafamiliar

    The purpose of this investigative work is to study in a descriptive way limitation of the degree of kinship in intrafamily violence infractions, due to the dark and erroneous application of the norm, since it is free to know that people are subject and subject to the criminal type of violence intrafamiliar, judging and punishing people who are not immersed in the types of protection to them. In the development the end of the limitation of the degree of kinship is analyzed as the one of infractions of domestic violence, doctrinal concepts, jurisprudentials, causes and effects, together with the object of the criminal process, getting to establish what are the penal principles and rights of the active and passive subjects of the criminal offense who have been violated due to such legal flaws, which were analyzed based on concepts of authors and international human rights standards of which Ecuador is a part. Critical-propositive opinions are carried out in the development, with the aim of providing criteria that lead to avoiding existing asymmetries due to state legal persecution.

    La familia de origen conflictiva y la reproducción de la violencia intrafamiliar de los casos atendidos en la unidad judicial especializada de violencia contra la mujer y la familia del Cantón Pastaza

    La presente investigación fue realizada a través de la colaboración y vivencias de usuarios/as de la Unidad Judicial Especializada de Violencia contra la mujer y la familiar de la Provincia y Cantón Pastaza sobre el tema la familia de origen y la reproducción de violencia intrafamiliar, cuyos resultados arrojo que un alto porcentaje de mujeres que han crecido en un ambiente de violencia y que al momento de conformar su hogar continúan de manera sistemática padeciendo esta situación, con lo cual dicho patrón de comportamiento se perpetua dentro de un circulo simbiótico negativo que afecta generación tras generación. La violencia es un problema social estructural que afecta contundentemente a la calidad de vida de los seres humanos, es por ello que se ha realizado un profundo análisis en el cual se aborda las consecuencias de la violencia intrafamiliar, para lo cual se ha creído conveniente humanizar la ruta de atención en un espacio de primera acogida a mujeres y miembros del entorno familiar que han sufrido cualquier tipo de violencia, cuyo fin es brindar a los profesionales una guía orientada a establecer acciones, intervenciones, procedimientos y responsabilidades que les permita realizar el primer contacto con la víctima de una manera acertada y evitando la re victimización.This research was conducted through collaboration and experiences of users of the Judicial Unit specializing in violence against women and the family, in Pastaza province and canton, the subject family of origin and reproduction of domestic violence , the results showed that a high percentage of women who had grown up in a violent atmosphere when forming their own families continue to suffer systematically the same situation, which said pattern of aggressive behavior is perpetuated in a negative symbiotic circle and affects generations. Violence is a social problem that affects the quality of life of human beings, for that reason there has been a profound analysis, in which the consequences of domestic violence are listed, the route has humanized care for women and members of the families that have suffered any kind of violence, its main goal is to provide professional support to help them make the first contact with the victim in an objective manner avoiding further damage to the victim.
