    Los derechos de la naturaleza y la aplicación del derecho de restauración en los conflictos ambientales

    The present titling work Development Project modality has as general objective: "To legally investigate the application and complexity of the right of restoration in environmental conflicts in cases with emblematic sentences in rights of nature", the same development several topics in the chapter II, inquired about the Right to nature, the Sumak Kawsay where this concept is explained in the different constitutions of South America. To then identify that Nature is a subject of rights, that is, it has all the rights enshrined in the constitutional norm. It was also inquired about environmental restoration that seeks to repair environmental damage. In addition, the state of the art was complemented with topics related to research such as restoration, rehabilitation, remediation, mitigation, topics related to the right to nature, adding both the constitutional regulatory framework and specific regulations. The present work analyzes the right of restoration in environmental conflicts, especially in the two cases with emblematic sentences in rights of nature, for which those selected by the Ombudsman's Office in 2020 were taken as a reference, in which presented a series of complexities due to various factors that were developed in chapter IV, to conclude with chapter V in which both the conclusions and recommendations were developed, thus understanding that the right of restoration in environmental conflicts must establish clear objectives and achievable for environmental restoration, which the judges must understand and understand that nature is one more subject, it must be emphasized that the present investigation sought texts by both Dr. Ramiro Ávila and Ecuadorian authors, comparative and international norms, scientific articles and others.

    Tutela judicial efectiva a la luz de la ejecución de sentencias expedidas por la corte interamericana de derechos humanos contra Ecuador

    The Inter-American System of Human Rights is configured as a supplementary mechanism to which recourse is had if the organs, institutions and powers of a State do not fulfil their function of guaranteeing the validity of the human rights recognised in the American Convention on Human Rights (Pact of San José); thus the victims or their relatives can appeal in the first instance to the Inter-American Commission which, if it considers it necessary, will take the case to the Inter-American Court so that it can decide on the appropriate action. This jurisdiction is recognized by Ecuador and therefore these judgments are binding on the Ecuadorian State as provided for in Article 68 of the American Convention. With this background, the present work will analyze the answers to the following questions: How does the lack of execution of sentences affect the right to effective judicial protection? What legal effects does the non-execution of sentences by the sanctioned State bring? What procedural mechanisms can be used to force the State to comply with the sentences issued by the Inter-American Court? The development of the thesis consists first of all of the definition of the right to effective judicial protection as well as its contents, which consist of accessing the organs of justice, obtaining from them a motivated sentence so that the judicial resolutions can be executed, achieving with the latter the materialization of the right to judicial protection and the rights recognized in said sentence; since effective protection is provided for in the Constitution, it is the State itself that must guarantee the effective enjoyment of it. It also explains the type of sentences that the Inter-American Court of Human Rights issues

    Las políticas del sistema de Rehabilitación social y la reincidencia de las personas privadas de libertad

    This research paper focuses specifically on analyzing current policies of the Social Rehabilitation System, the purpose of this paper is to analyze the causes and effects that cause the recidivism of people deprived of liberty, based on doctrinaire concepts of authors, jurisprudence and international standards of Human Rights of which Ecuador is a part. It is intended to identify, reaching an analysis of the reasons that have caused serious internal commotion in the Penitentiary System, establishing mechanisms to avoid the violation of constitutional guarantees of the utmost importance and the rights of persons deprived of liberty with a conviction. Currently a controversy has been instituted and continues to generate negative conflicts of competence between the judges of criminal guarantees and judges of penitentiary guarantees, although the competence of each one is typified separately in the reform provisions, article No. 225 and the article No. 230, respectively, established in the Comprehensive Criminal Organic Code; in practice, the same judge that substance, knows and issues the condemnatory sentence is the same one that resolves, knows and issues the termination of the sentence; Therefore by legal mandate there must be an impartial and specialized judge in prison matters, the one who acted on the basis of the area of competence, for not existing the need to raise a draft for reform to the Organic Comprehensive Criminal Code, in the reform provisions , of Article 230 first paragraph; and the creation of the Unit of Penitentiary Guarantees, for the application of their competences that corresponds to both to be watched over the defendant and the victim, as well as to endorse the execution of the process of social rehabilitation, in this way both in adherence to the strict respect to their human rights.

    La mediación familiar una alternativa innovadora para descongestionar el nímero de causas en el derecho de alimentos que se tramitan en el juzgado de la niñez y adolescencia

    El presente trabajo investigativo es presentado a conocedores del derecho, dedicados a ejercer arduas labores en favor de la comunidad, y de manera particular a los estudiantes del Centro de Estudios de Posgrados de la Universidad Técnica de Ambato. Este trabajo es el resultado de un estudio sistemático de uno de los problemas que cada día afectan a nuestra sociedad, esto es la odisea que las y los actores de juicio de alimentos tienen que pasar hasta que el juez fije una pensión alimentaria, hecho generado principalmente por la falta de cultura de paz en la población, que permita acceder con mayor frecuencia a los medios alternativos de solución de conflictos; por lo que, la presente investigación está encaminada a implementar la mediación familiar de manera ineludible previo a iniciar un proceso judicial, a fin de obtener un sistema judicial ágil y eficaz, descongestionando las causas que actualmente se encuentran represadas.This research work is presented to the right knowledgeable, dedicated to exercise arduous labors for the community, and especially students of the Centre for Postgraduate Studies of the Technical University of Ambato way. This work is the result of a systematic study of one of the problems that every day affect our society, this is the odyssey that and actors food trial must pass until the court set alimony, made mainly generated by the lack of a culture of peace in the city, which allows access to most often alternative means of dispute resolution; therefore, this research aims to implement family mediation prior inescapably to initiate legal proceedings in order to obtain a quick and efficient judicial system, easing the causes that are currently impounded.
