Item La reparación integral y el delito de femicidio en el Ecuador(Universidad Técnica de Ambato,Facultad de Jurisprudencia y Ciencias Sociales, Carrera de Derecho, 2022-09) Marín Mora, Cristina Nicole; Acosta Morales, María GabrielaViolence against women is one of the social and political problems that require the most attention in the region. The increase of femicide cases, coupled with a lack of interest from the State in addressing this problem, encourages the development of studies and proposals to break the discourse of permanent impunity that has permeated society and has given way to the constant violation of the human rights of girls and women. The inquiries presented in this work aim to investigate the right to Integral Reparation in cases of femicide in Ecuador, to achieve this, the methodological path was taken from a descriptive and empirical level through the application of the quali-quantitative method; this will be developed through the application of surveys and interviews that guide the fulfillment of the different purposes of this investigation. By the aforementioned, the level of knowledge possessed by both practicing law professionals, and prosecutors and judges of criminal guarantees have about the investigated topic, was revealed. The nature of the study required a research area framed in the field of Public Policy, Law and Society; therefore the proposal has an effect upon the adequacy of a monitoring system of jurisdictional decisions regarding Integral Reparation for indirect victims of Femicide, allowing to determine that the fulfillment of the described right is not guaranteed as it should be.Item La seguridad jurídica y la reparación integral a las víctimas de delitos penales de tránsito(Universidad Técnica de Ambato,Facultad de Jurisprudencia y Ciencias Sociales, Carrera de Derecho, 2022-07) Carlos Andrés Muyolema Tixe, Carlos Andrés; Tite, Segundo RamiroDeaths caused by traffic accidents have increased in recent years and with these irregularities have arisen, regarding the handling of the situation of the victims, as well as the punishment of those responsible for such an act, Ecuador despite having a Current regulation on criminal and traffic matters, such as the Comprehensive Organic Criminal Code, have not been able to contribute to reducing mortality rates from this cause, showing that sanctions and constant reforms are not enough. In Ecuador, comprehensive reparation has been implemented in its criminal justice system, which is part of the constitutional rights of victims. Ecuadorian legislation is receptive to the problem so that in the Organic Comprehensive Criminal Code only comprehensive reparation is typified within two articles such as 77 and 78, which are not enough to ensure the correct application of comprehensive reparation. and thus reach the satisfaction of the victims who remain as a result of the commission of culpable traffic crimes.Item El apoyo familiar y las víctimas de violencia de género acogidas en el sistema de protección y asistencia a víctimas y testigos de la provincia de Tungurahua(Universidad Técnica de Ambato. Particular by which initiates a displacement itself that directly affects the victim because it generates the breakdown of affective ties, especially in the nuclear family. In addition to analyzing the family dynamics and identifying the communication style they maintain and the social context in which they develop.Item La violencia de género contra las mujeres y la resiliencia en el centro de apoyo a la mujer y la familia Las Marías de la ciudad de Cuenca(Universidad Técnica de Ambato, Facultad de Jurisprudencia y Ciencias Sociales, Posgrado, Maestría en Trabajo Social, 2017-07) Flores Lazo, Elizabeth Teresa; Barrios Mesa, ReinierThis work of research is directed to meet the overall target set: to achieve biopsychosocial development of women victims of gender-based violence users of The Center of Support for Women and the Family "Las Marias" of the city of Cuenca, through a more focused work on the resilience of women and their families, in order to reduce violence and deploy all its potential considering as study population users of the Center of Support Las Marias of the City of Cuenca, during the period November 2015 June 2016, which was contextualized at the level of the Ecuador, in the providence of Azuay and the city of Cuenca. Methodologically, the information was obtained through the application of a survey, having as the universal population 94 users of the Center, followed by the tabulation, interpretation and analysis of the results obtained as evidenced with the calculation of "Chi-cuadrado" X 2 for the verification of the hypothesis. Obtained as a result of the calculated Chi-cuadrado (7.83), and being this (3.84) wholesale (Xi2), with an α (margin of error) of the 0.05; and with 1 degree of freedom, it REJECTS the null hypothesis and it ACCEPTS the alternative hypothesis, that is, it constitutes a determining factor and there is a significant statistical difference between The Violence of Gender Against Women and the Resilience of users of the Center of Support for Women and the Family "Las Marias" of the City of Cuenca. Considering resilience as determinant to deal with violence against women, there is evidence that users of the Center in a large percentage consider important to develop resilient features to eliminate or reduce gender-based violence exerted on them, moreover, a high index of users believe that the violence which they have been the victim of responds to the condition of gender, therefore, risk factors play an extremely important role to consider since speaking of violence gender roles and stereotypes that are naturalized can hardly be conceived as risk factors that worsen the condition of women should they not reach resilience. Concluding with the proposal of a model of attention of Social work (MAITS) from the theory of development to human scale The Center of Support for Women and the Family of The Marias of the City of Cuenca", with the aim of developing resilience in women victims of gender violence, aimed at reducing and/or eradicating gender-based violence against women and their families approached from the theory of development to human scale and human needs.Item La familia de origen conflictiva y la reproducción de la violencia intrafamiliar de los casos atendidos en la unidad judicial especializada de violencia contra la mujer y la familia del Cantón Pastaza(2015) Soria Chonata, Carmita Alexandra; Altamirano Altamirano, Silvia JovannaLa presente investigación fue realizada a través de la colaboración y vivencias de usuarios/as de la Unidad Judicial Especializada de Violencia contra la mujer y la familiar de la Provincia y Cantón Pastaza sobre el tema la familia de origen y la reproducción de violencia intrafamiliar, cuyos resultados arrojo que un alto porcentaje de mujeres que han crecido en un ambiente de violencia y que al momento de conformar su hogar continúan de manera sistemática padeciendo esta situación, con lo cual dicho patrón de comportamiento se perpetua dentro de un circulo simbiótico negativo que afecta generación tras generación. La violencia es un problema social estructural que afecta contundentemente a la calidad de vida de los seres humanos, es por ello que se ha realizado un profundo análisis en el cual se aborda las consecuencias de la violencia intrafamiliar, para lo cual se ha creído conveniente humanizar la ruta de atención en un espacio de primera acogida a mujeres y miembros del entorno familiar que han sufrido cualquier tipo de violencia, cuyo fin es brindar a los profesionales una guía orientada a establecer acciones, intervenciones, procedimientos y responsabilidades que les permita realizar el primer contacto con la víctima de una manera acertada y evitando la re victimización.This research was conducted through collaboration and experiences of users of the Judicial Unit specializing in violence against women and the family, in Pastaza province and canton, the subject family of origin and reproduction of domestic violence , the results showed that a high percentage of women who had grown up in a violent atmosphere when forming their own families continue to suffer systematically the same situation, which said pattern of aggressive behavior is perpetuated in a negative symbiotic circle and affects generations. Violence is a social problem that affects the quality of life of human beings, for that reason there has been a profound analysis, in which the consequences of domestic violence are listed, the route has humanized care for women and members of the families that have suffered any kind of violence, its main goal is to provide professional support to help them make the first contact with the victim in an objective manner avoiding further damage to the victim.
