Item El suicidio y el derecho a la vida(Universidad Técnica de Ambato. Facultad de Jurisprudencia y Ciencias Sociales, Carrera de Derecho, 2020-07) Toasa Galarza, Mariana Elizabeth; Tite, RamiroThe importance of this research work lies in the academic and legal contribution, depending on the criminalization of the type of suicide induction in order to protect the legal good of life. The investigation is carried out through a legal and comparative law study, because of knowing and understanding the figure of suicide induction, since in Ecuadorian criminal legislation there is no criminal type. The methodology applied in the research deals with the use of a bibliographic and documentary modality by contributing to the construction of the state of the art, in terms of suicide and the right to life, the approach that was applied was the quantitative one through the application of a survey as a technique, to collect information that was subject to analysis and interpretation of the criteria of both judges and prosecutors. The human being as an individual and subject of rights, being a cornerstone of social law, corresponds to the project being in the line of research regarding Integral Social Human Development. The proposal presented is based on the figure of induction of suicide as another way of acting of the human being, by attempting against one of the legal assets protected by both national and international regulations, such as the right to life, without this right fundamental, the other rights could not be accessed, so the determination of the criminal type of suicide induction is established within the crimes against the inviolability of life.Item Las relaciones familiares y los suicidios en el Cantón Ambato Provincia de Tungurahua(Universidad Técnica de Ambato, Facultad de Jurisprudencia y Ciencias Sociales, Carrera de Trabajo Social, 2018-06) Miniguano Moposita, Gabriela Elizabeth; Naranjo Ruíz, Viviana FidenciaThe main object of the present investigation research is to let know the incidence of family relationships into the suicides in Ambato canton from Tungurahua province during 2017, also it will be done in order to verify if it does exist a relation between the variables, in addition, a deeper study will be done, taking into account the cases because it is very necessary to acquire kowledge about the factors that are causing many people take the wrong decition that is to suicide, thus promoting the progressive increase of suicides without discrimination of age, gender and economic situation, bringing with it several consequences for relatives in the face of human loss. For this field investigation, families with suicide cases were taken into account, the investigator worked with 32 families in a direct way and with the administrative area of the Dirección Nacional de Delitos Contra la Vida, Muertes Violentas, Desapariciones, Extorción y Secuestro (Dinased) Subzona Tungurahua, in order to do this investigation it was necessary to apply a survey and the interview. The motor of this investigation is the necessity to find the biggest motivator of suicides in local people, according to the results it will provide by the different interviewed people it will show that the main reason is because some family problems, influenced by a lack of family relationships because, in these groups there exist an disorganized environment, emotional instability and dysfunction as a complete family, that is something that did not provide the necessary guarantees to achieve optimum levels of well-being and satisfaction both personal and family. With the results obtained, a proposal will be proposed as a solution to the problem in order to progressively reduce the statistics of suicide in the local people.Item La autopsia psicológica y los delitos contra la vida(Universidad Técnica de Ambato, Facultad de Jurisprudencia y Ciencias Sociales , Carrera de Derecho, 2017-01) Aponte Sevilla, Karen Gissela; Navalpotro Sánchez-Peinad, JesúsThe application of Psychological Autopsy as a means of evidence in crimes against life, is a very important implement in the criminal fieldas through this it can be can determined whether the scene actually corresponds to a crime, the sort of crime it is, or if we are facing a suicide. No counting on the victim’s presence because of dead or perhaps for their disappearance is one of the most complex scenarios for a forensic psychological assessment; however, feasible to carry out psychological assessment techniques by regression. Both globally and in Latin America, the application of psychological autopsy in cases of questionable deaths, has been a very useful technique in forensic psychiatry in the criminal justice field; its relevance and potential application in designing policies to promote health and prevent accidents, homicide or suicide application. However, the application of psychological autopsy as an expertise to help clarify the facts in an uncertain death in Ecuador is relatively recent, and although it can give clear evidence does not constitute strong evidence that actually leads to the administration of justice to consider the relevance that sometimes it deserves. However, it has been practiced in some cases in the country, although it is not literally established in the criminal legislation, its application has been rather in a permissible way. As mentioned above, the present research work considers the application of psychological autopsy as evidence in the investigation of crimes against life, which origin is uncertain. It is of vital importance with which a more comprehensive administration of justice will be achieved, not without mentioning that for those who have been with the pain of losing a loved one, also will have the emotional comfort of knowing that the person responsible for that presumed crime thought to be accidental, has been put before a court of law.
