    Alienación Parental y su relación con la Vulneración del Interés Superior del Niño

    The present research was born with the main objective of determining what is parental alienation to establish the repercussions on the child; identify the rights that allow to comply with the best interests of the child and to demonstrate how parental alienation affects the best interests of the child because the history which can be evidenced that parental alienation appears with the sole purpose of protecting children and adolescents, but this was totally wrong due to reason that it is used to meet the needs of parents who maintain care minors; this can be understood as psychological abuse because parental alienation interrupts an optimal development of minors together with their parents in which an erroneous image of the absent parent is created, but it is evident that parental alienation is born with the separation of the couple or the spouses in such a way that a legal procedure is initiated either Divorce, possession, parental authority or maintenance; showing that the constitutional provisions of article 44 are violated, which determines that the state and the family shall optimally promote the integral development of children and adolescents.

    Tipología familiar y cuidado parental

    The research responds to the variables of family typology and parental care of the students of the General Unified Baccalaureate of the Ambato Adventist Educational Unit of the province of Tungurahua. Concern about the change in family typologies and the influence on the development of parental care has been questioned due to the fundamental role that the family plays in the life of the growing human being. This research centers its objective on the basis of the alarming increase in the rates of changes in family forms, it has focused on studying whether depending on the family in which the adolescent is, it produces an optimal or inappropriate effect on the care taken by their parents. For the execution of the present study, the methodology was used with a quantitative approach, with the help of the application of a survey made up of three sections, the first one an instrument that determines the family typology, second by the questionnaire of parental ties to know parental care. and third by a survey that allows identifying the factors that influence the care that parents carry out from the perspective of the students; These instruments are validated and respond to the study variables. The statistical method for testing the hypothesis was carried out, obtaining as a result the denial that family typology influences parental care, due to the variation in results, the veracity of the hypothesis proposed cannot be affirmed, but the disturbing results should be noted. of each of the variables, revealing problems that are of interest. Well, we cannot deny the reality of a changing society and family, so social must find new strategies that adapt to the typologies that will continue to emerge with the passing of time, to optimize the performance and functionality of families, and maintain the same objective for which it was institutionalized, to allow the integral development of an individual. In this sense, the importance of the family for the development of the youngest and adults is understood, since the influence that this group has on current relationships will mark the individual development of each member, it is in the family context that the character, personality, temperament, principles, values and among other traits that are part of the human being; which depend on the quality of parental care that is established within the family. But due to changes in typologies in families, the realities of many minors have changed, since it is not only the fact of living with both parents or living only with mom or dad, it is the fact of how regardless of the family typology in the that a human being develops, the care can be adequate and can satisfy its basic needs for its formation and survival.

    Autorización de salida del país del niño, noña o adolescente y la patria potestad de los progenitores

    En el Ecuador como en cualquier país del mundo existe una legislación que regula y controla todos los acontecimientos y acciones de la sociedad, nuestro país no es la excepción es así que el Art. 425 de la Constitución de la República del Ecuador manifiesta claramente la jerarquía de las leyes y su modo de aplicación. Iniciando con la Carta Magna, Tratados Internacionales, luego las Leyes Orgánicas Y las Leyes Ordinarias, mismas que sirven de fundamento legal y nos dan la visión para que la Movilidad Humana sea un derecho y una Garantía Jurisdiccional a cumplirse con el carácter coercitivo no solo en el Ecuador sino en el mundo. Razón por la cual el presente trabajo de investigación tiene como objetivo principal que la Movilidad Humana debe ser respeta no solo en las personas mayores de edad sino principalmente en los niños (as) y adolescentes, quienes por diferentes motivos tienen que viajar a los países del mundo y sus metas no deben ser cuartadas, más aun cuando se trata de salud, educación y unión familiar. En los menores de edad la patria potestad es el requisito fundamental para la movilidad humana, es así que en el presente trabajo de investigación exponemos claramente que se debe analizar pormenorizadamente las razone y las circunstancias como lo adquirieron de quienes la tienen, ya que terminan siendo personas totalmente extrañas y no los padres, llegando a la conclusión que para que el menor tenga el permiso de salida del país, cumpla todo un proceso incluso con la condición de pagar cierta cantidad de dinero. Los Derechos de los menores son irrenunciables imprescriptibles e intransferibles razón por la cual mencionamos y proponemos que quien es el responsable del menor sea quien autorice la salida del país, incluso sin la firma del progenitor que nunca está en la formación del mismo, pero siempre cumpliendo con los requisitos legales y normativos del país.
