Facultad de Jurisprudencia y Ciencias Sociales, Unidad de Posgrado, Maestria en Derecho Constitucional, 2020-09) Jara León, José Ricardo; Tite, Segundo RamiroThe issuance of the 2008 Constitution allowed Ecuador to undergo several transformations regarding an expansion of the catalog of rights and the conception of a Social State of Rights and Justice. Thus, disrupting the administration of justice and the role of the Judge, who enters the sphere of guarantee and protection of the rights of the individual. The Ecuadorian legal system complies with international standards in penitentiary matters, instituting judges for penitentiary guarantees. So, executing the sentence protects the rights of persons deprived of liberty, as a contribution to a specialized judicial system, making a distinction with the criminal guarantees judges who are responsible for knowing and punishing the typical and unlawful behavior of individuals. The regulations and their evolution project a State that guarantees rights. However, in practice, the Judicial Council, under the pretext of criminal efficiency and optimization of resources, never appointed these judges and issued Administrative Resolution No. 018 - 2014, which extended this competence and functions to criminal guarantees judges. This affected legal certainty, the principle of legality and specialty that underpins the jurisdiction and competence of justice operators, and limited the right to effective judicial protection of persons deprived of liberty. In other words, an administrative act tacitly acquires the rank of the organic law, which is not empowered by the legal reserve principle. The research used a qualitative-quantitative methodology, using the interview and survey to determine the criteria of the population of Judges, prosecutors, public defenders, and lawyers in free practice in the city of Riobamba. The results determined a violation of the rights of persons deprived of liberty and a legal contradiction with the functions that the Judge of criminal guarantees must fulfill, consistent with his strictly tutelary role as Judge of penitentiary guarantees.Item Los lazos maritales y inteligencia emocional en los procesos de rehabilitación(Universidad Técnica de Ambato, Facultad de Jurisprudencia y Ciencias Sociales, Carrera de Trabajo Social, 2019-08) Mogollón Cox, María José; Campoverde Quijano, Egda MaribelThe investigation was based on discovering the connection between marital bonds and the emotional intelligence in the rehabilitation processes in the CRS Sierra Region North Center Cotopaxi in the Medium Security Stage – Men. Nowadays in Ecuador day by day increases the number of people deprived of freedom and this is a social problem. It was necessary to know why the social rehabilitation has not beem effective. One of the factors that affects people deprived of their marital bands with their partner and this influence in their emotional intelligence, when they don’t have a balance in their emotions this trigger changes in the behavior as human beings and it can generate several conflicts between inmates so is necessary to work continuously as in the social sphere as in the psychological field to give comprehensive care to people deprived of their freedom. For the verification of the hypothesis was used the correlation between two variables, they were evaluated by two valid questionnaires, the Marital Satisfaction Scale and Trait Meta – Mood Scale (TMMS24).The Results showed connection between the factors of marital satisfaction and the dimensions of emotional intelligence. These factor affect or benefit people deprived of their liberty and it depends on their ability to cope and adapt to the new lifestyle.Item El sistema familiar e historia de vida de las personas privadas de libertad internas en el centro de atención a personas adultas en conflicto con la ley (CAPACL)(2015) García Prías, Nivia Elizabeth; Poaquiza Poaquiza, Ángel PatricioUna sociedad se conoce por la Historia de vida que escribió, escribe y escribirá, las narrativas de las historias de vida social se desarrollan en función de la dinámica que permite conocer su contexto social, cultural, económico, político que la ha marcado; así, las historias de vida personales marcan acontecimientos significativos cuya génesis es por lo general los sistemas familiares. En esta investigación se analiza la historia de vida de las personas privadas de libertad escritas desde la intersubjetividad de sus actores, quienes expresan sus vivencias, sentires y emocionares al ser parte de un sistema familiar que poco o nada aportó a su construcción social. De igual manera, este trabajo investigativo presenta una nueva alternativa de intervención del Trabajo Social que posibilita a través de la narrativa deconstruir, construir y reconstruir las historias de vida de las personas privadas de libertad logrando una transformación de su perspectiva de vida individual, familiar y social que permita tener una permanente y efectiva reinserción social. A society is known by the life story it wrote, write and will write. The narrative of social life stories develop based on the dynamic information about its social, cultural, economic, political context which has marked it; thus, personal life stories are marked by significant events whose genesis is usually family systems. This research analyzes the history of life that detainees have written for themselves from the intersubjectivity of their experiences, who also express the feelings and emotions they had while they were part of family systems that contributed little or nothing to their social construction. At the same time, this research presents a new alternative for Social Work intervention which is possible through the narrative to deconstruction, to construct and reconstruct the life stories of the detainees achieving a transformation of their individual perspective, family life and social order, to keep a permanent and effective social reintegration.
