    This investigation work has the topic: “El interés superior del niño y los derechos constitucionales del adulto mayor en las demandas subsidiarias de alimentos”, is based on the need that exist in Ecuadorian leislation, to enforce the rights of the older people who constitute a PRIORITY GROUP, establisehd in the Constitution of the Republic. The “interés superior del niño” constitute one of the most fundamental principles that contained the Constitution. For this reason, Ecuador has subscribed to Internationals Conventions that guarantee this superior interest; at the same time that creates national laws that facilitate the no transgression of these rights. According to this need, the laws and the public workers had the obligation of safeguarding the rights of the old people so that they can have a healthy old age and that it agrees with its possibilities, enjoying a dignified senescense, as protected by the Constitution and other international norms.
