Item El apremio personal por el no pago de pensiones alimenticias y el derecho a la integridad personal en el cumplimiento de la medida en los centros de Rehabilitación Social(Universidad Técnica de Ambato, Facultad de Jurisprudencia y Ciencias Sociales, Carrera de Derecho, 2019-11) Caguana Chiliquinga, Ricardo Rubén; Poaquiza Poaquiza, Angel PatricioThe present research work entitled "The personal constraint for the non-payment of alimony and the right to personal integrity in compliance with the measure in the Social Rehabilitation Centers", conducted a thorough analysis of the provisions in the General Organic Code Processes regarding the compliance measure for non-payment of alimony does not obey the rights and guarantees contemplated in the constitution of ECUADOR 2008 and other legal and international sources. Once an exhaustive theoretical and field investigation was carried out, it was concluded that the provisions contemplated in the COIP and Penitentiary Regulations are not sufficient to guarantee the rights established in the constitutional regulations for the obligors, but on the contrary it is these same regulations that violate the main right over PPL, that is; the right to physical and personal integrity. In this sense, article 66, numeral 3 of the Constitution of the Republic of Ecuador states that “All persons are recognized and guaranteed… 3. The right to personal integrity…” Although it is true, there are regulations governing the compliance with this right within the Social Rehabilitation Centers, but it is of great social shock to know that the existence of these regulations in reality is totally obsolete.
