Item type:Ítem, La justicia juvenil restaurativa y la reinserción social de adolescentes infractores en el Ecuador(Universidad Técnica de Ambato, Facultad de Jurisprudencia y Ciencias Sociales, Carrera de Derecho, 2026-07-09) ;Lozada Robalino, Antonella MonserrathAcosta Morales, María GabrielaThis research paper will analyze the application of restorative juvenile justice and its relationship to the challenges of social reintegration faced by adolescent offenders in Ecuador. It will consider the limitations currently present in the specialized juvenile offender system, because although Ecuadorian law recognizes principles aimed at the comprehensive development and social reintegration of adolescents, in reality, multiple factors affect the effective achievement of social reintegration goals. The paper will examine how the lack of restorative mechanisms directly influences the social reintegration processes of adolescent offenders, given that a large proportion of these offenders come from environments marked by violence, social exclusion, poverty, and human rights violations. It will also study the challenges within institutional detention centers and the difficulties the state faces in guaranteeing these comprehensive social reintegration processes. The national and international legal framework governing restorative juvenile justice is also analyzed to determine whether it truly complies with the principle of comprehensive protection and the principle of the best interests of the child. The importance of this research lies in the need to understand that social reintegration is not merely the fulfillment of a socio-educational measure, but rather a comprehensive process that allows adolescents to rebuild social ties, strengthen their emotional stability, and develop skills that will help them reintegrate into society. This research thus presents a critique of the system's effectiveness.Item type:Ítem, La Mediación Penal como Herramienta para una Justicia Restaurativa en Adolescentes Infractores(Universidad Técnica de Ambato, Facultad de Jurisprudencia y Ciencias Sociales, Carrera de Derecho, 2025-08-05) ;Saquinga Pozo Lorena del CarmenJordán Buenaño, JeanetteCriminal mediation is a key tool for the development of restorative justice from the perspective of adolescents in conflict with the law. Its effective implementation ensures that the adolescent offender takes responsibility for the act committed, provides comprehensive reparation to the victim, and achieves social reintegration through dialogue aimed at resolving the conflict. The objective of this research is to establish the application of criminal mediation as a tool for restorative justice in adolescent offenders. The theoretical framework is structured through the analysis of bibliographic sources and academically valid scientific documents. A mixed methodological approach was used, applying techniques such as interviews and surveys. The interviews were conducted with judges, public defenders, a prosecutor, and a mediator, while the survey targeted independent practicing lawyers. The results reveal several obstacles hindering the proper implementation of criminal mediation, including institutional and operational shortcomings such as the lack of specialized training for justice system operators and the absence of standardized protocols. Other barriers include inadequate infrastructure in mediation centers, legal gaps in regulatory frameworks, limited public awareness and promotion of criminal mediation, insufficient human, material, and financial resources, and deeply rooted cultural attitudes. Criminal mediation has a significant impact on the offender, the victim, and society as a whole. It also contributes to strengthening a culture of peace and supports the justice system. Finally, strategies are proposed to ensure the effective implementation of criminal mediation for adolescent offendersItem type:Ítem, La responsabilidad de los adolescentes infractores y su relación con el incremento de la delincuencia juvenil e inseguridad en el Ecuador(Universidad Tècnica de Ambato, Facultad de Jurisprudencia y Ciencias Sociales, Carrera de Derecho, 2024-08) ;Reyes Salazar, Tania PamelaAcosta Morales, María GabrielaThis research paper focuses on the analysis of the responsibility of adolescent offenders and their relationship with the increase in juvenile delinquency and insecurity in Ecuador. The Ecuadorian juvenile justice system is based on the principle of specialty and non-imputability established in the Convention on the Rights of the Child, which aims at the protection and integral development of minors in conflict with the criminal law. To this end, it has been established that everything concerning adolescent offenders will be regulated by the Code of Childhood and Adolescence, specialized regulations for this matter, which has an approach based on the rehabilitation and social reintegration of adolescents. However, despite the above, the rates of juvenile delinquency in the country have increased significantly, due to the lack of prevention and guidance programs that address criminal behavior, as well as the ineffectiveness of rehabilitation programs and socio-educational measures that have led adolescents to reoffend in the commission of more serious crimes. In this context, this research was carried out using a qualitative methodology, of a bibliographic documentary type, and interviews were also conducted in order to obtain relevant information that contributes to the analysis of the research problem and to the fulfillment of the objectives to be investigated. Therefore, this research work is of great relevance since it analyzes important aspects of the responsibility of adolescent offenders, juvenile delinquency and their judgment
