Abstract
This research analyzes “The Guarantee of Motivation and the Coercive Enforcement
Procedure in the Collection of Debt Instruments in the IESS”, addressing the relationship
between the constitutional rights of debtors and the effectiveness of the coercive
administrative procedure. This mechanism is fundamental to guarantee the recovery of state
resources, but its application must comply with standards of legality, proportionality and
respect for due process. The central problem lies in the lack of adequate motivation in the
debt instruments issued by the Ecuadorian Social Security Institute (IESS). The absence of
clear and precise grounds in these administrative acts generates risks of nullity, violates the
right to defense and affects the legal certainty of the administered parties. In turn, these
shortcomings lead to legal conflicts that hinder the collection of legitimately owed amounts,
weakening the institutional legitimacy of the IESS. The research identifies several critical
areas, including deficiencies in the motivation of administrative acts, the impact of coercive
measures on the rights of debtors, and the regulatory and operational limitations in the
execution of these procedures. There is a need to reinforce the principles of reasonableness
and proportionality, to ensure clarity in the drafting of resolutions and to train the personnel
responsible for issuing them. In methodological terms, the qualitative approach made it
possible to analyze the legal and doctrinal context, while the quantitative approach provided
concrete data on the results of the coercive procedure. This comprehensive analysis offers a
detailed view of the tensions between the requirement of motivation and the effectiveness of
coercive collection, proposing regulatory and strategic reforms to improve the legitimacy of
the process. Ensuring proper motivation in IESS administrative acts is fundamental to
balance public and private interests, promoting a fairer and more efficient social security
system. This study contributes to strengthen legal certainty and citizen confidence in public
institutions.

La presente investigación analiza “La Garantía de la Motivación y el Procedimiento de
Ejecución Coactiva en el Cobro de Títulos de Crédito en el IESS”, abordando la relación
entre los derechos constitucionales de los deudores y la eficacia del procedimiento
administrativo coactivo. Este mecanismo es fundamental para garantizar la recuperación de
recursos estatales, pero su aplicación debe cumplir con estándares de legalidad,
proporcionalidad y respeto al debido proceso. El problema central radica en la falta de
motivación adecuada en los títulos de crédito emitidos por el Instituto Ecuatoriano de
Seguridad Social (IESS). La ausencia de fundamentación clara y precisa en estos actos
administrativos genera riesgos de nulidad, vulnera el derecho a la defensa y afecta la
seguridad jurídica de los administrados. A su vez, estas falencias conducen a conflictos
legales que entorpecen la recaudación de valores legítimamente adeudados, debilitando la
legitimidad institucional del IESS. La investigación identifica varias áreas críticas, entre ellas,
las deficiencias en la motivación de los actos administrativos, el impacto de las medidas
coactivas sobre los derechos de los deudores, y las limitaciones normativas y operativas en la
ejecución de estos procedimientos. Se plantea la necesidad de reforzar los principios de
razonabilidad y proporcionalidad, garantizar la claridad en la redacción de resoluciones y
capacitar al personal encargado de su emisión. En términos metodológicos, el enfoque
cualitativo permitió analizar el contexto jurídico y doctrinario, mientras que el enfoque
cuantitativo ofreció datos concretos sobre los resultados del procedimiento coactivo. Este
análisis integral ofrece una visión detallada de las tensiones entre la exigencia de motivación
y la eficacia del cobro coactivo, proponiendo reformas normativas y estratégicas para mejorar
la legitimidad del proceso. Garantizar una correcta motivación en los actos administrativos
del IESS es fundamental para equilibrar los intereses públicos y privados, promoviendo un
sistema de seguridad social más justo y eficiente. Este estudio contribuye a fortalecer la
seguridad jurídica y la confianza ciudadana en las instituciones públicas.
