ICE fundas plásticas y el principio de suficiencia recaudatoria

dc.descriptionThe present research project aims to analyze compliance with the Special Consumption Tax (ICE) applied to plastic bags as a tax instrument and an environmental control mechanism in Ecuador. This tax has a dual purpose: to reduce the use of plastic bags and to generate sufficient revenue for the State to fulfill its functions. The study employed a descriptive methodology. An analysis of the regulations showed that they require adjustments to address new challenges, as their impact has not been significant in supermarkets or informal markets. Revenue collection has not met expectations because Ecuadorian households still largely prefer single-use plastic bags, and very few families opt for cloth or paper alternatives. The continuous review of collected values makes it possible to determine whether the principle of revenue sufficiency is being met and whether the regulation is generating a real impact. Consequently, the ICE on plastic bags does not comply with this principle, as the structure of the regulation is somewhat weak and difficult for small businesses to apply.
dc.description.abstractEl presente proyecto de investigación tiene por objetivo analizar el cumplimiento del Impuesto a los Consumos Especiales (ICE) aplicado a las fundas plásticas como instrumento tributario y del control ambiental en Ecuador; el cual presenta un fin de doble propósito el de disminuir el uso de las fundas plásticas y el de recaudar lo necesario para que el Estado pueda cumplir con sus funciones. La metodología de estudio utilizada fue descriptiva. Al analizar la normativa, se evidenció que la misma requiere de ajustes que se adapten a nuevos desafíos porque su impacto demostró no ser tan notorio en supermercados y mercados informales. Por otro lado, la recaudación no ha sido la esperada ya que los hogares ecuatorianos prefieren mayoritariamente usar fundas de un solo uso y muy pocas familias optan por bolsas de tela o de papel. La constante revisión de valores recaudados permite verificar si realmente se está cumpliendo con el principio de suficiencia recaudatoria y la normativa está generando un impacto real. Por consecuencia el ICE a las fundas plásticas no cumple con el principio recaudatorio pues la estructura de la normativa es un tanto débil y complicada de aplicar para pequeñas empresas.
