Abstract
This research addresses the diplomatic conflict that occurred on April 5, 2024, in which fundamental principles of International Law came into direct tension, including state sovereignty, the right to political asylum, the inviolability of diplomatic missions, and the principle of non-intervention in the internal affairs of States. The analysis herein is of significant relevance, as it evidences how the actions undertaken by Ecuador and Mexico sparked a legal and social debate in the international arena by overstepping normative boundaries widely recognized by the international community.
The methodology employed follows a qualitative approach, specifically of a documentary-bibliographic nature, with an exploratory and descriptive scope. Analytical-synthetic, case-based, and socio-legal methods were applied, utilizing documentary techniques and instruments such as data sheets and analytical matrices. The population of the research comprises normative, doctrinal, and jurisprudential sources related to state sovereignty and the right to political asylum, while the sample focuses on the analysis of the cases brought before the International Court of Justice by Mexico and Ecuador.
The novel contribution of this study lies in the legal analysis and interpretation of a diplomatic conflict that entailed regional and international repercussions, thereby underscoring the importance of upholding the sovereignty of host States and the protection of the right to political asylum. It is concluded that the conduct of both States contravened essential principles of International Law, thereby undermining the stability of the regional and international legal order by eroding mutual trust among States in the performance of their diplomatic functions.

La presente investigación aborda el conflicto diplomático ocurrido el 05 de abril de 2024 en el que se contraponen principios fundamentales en el Derecho Internacional, como la soberanía estatal, el derecho de asilo político, la inviolabilidad de las misiones diplomáticas, y la no intervención en asuntos internos. El análisis realizado es de alta relevancia, ya que, pone en evidencia como las actuaciones de Ecuador y México generaron un debate jurídico-social en el ámbito internacional al traspasar límites normativos ampliamente reconocidos en la comunidad internacional. La metodología utilizada responde a un enfoque cualitativo, de tipo documental-bibliográfica, con un nivel exploratorio y descriptivo. Se aplicaron métodos analítico-sintético, casuístico y socio-jurídico, con una técnica documental y se implementaron los instrumentos de fichas de trabajo y matrices de análisis. La población de la investigación se compone de fuentes normativas, doctrinarias y jurisprudenciales relacionadas con la soberanía y el derecho de asilo político, mientras que la muestra se centra en el estudio de los casos sometidos ante la Corte Internacional de Justicia propuestos por México y Ecuador. El aporte novedoso de esta investigación radica en el análisis e interpretación del conflicto diplomático que tuvo consecuencias a nivel regional e internacional, visibilizando la importancia del respeto a la soberanía de los Estados receptores y la protección del derecho de asilo político. Se concluye que las conductas de ambos Estados vulneran principios esenciales del Derecho Internacional, comprometiendo la estabilidad del sistema jurídico regional e internacional al vulnerar la confianza entre los Estados en el ejercicio de sus funciones diplomáticas.
