El derecho a la intimidad y el ciberacoso en los adolescentes de la educación media

Abstract

The protection and warranty to the right of intimacy has been clearly stated in the legal system of the Constitution of the Republic of Ecuador, for that matter it's a fundamental right that must be protected by the state through programs and public policies. This Right must be taken care of, given that currently society is living in a binding medium with social networking platforms, especially boys, girls and adolescents not having access from their homes must access through platforms that they are taking in their educational studies that allow them easy access. Which directly implies the presence in this social group in public and academic spaces, the crime of cyber-harrassment. Consequently, the objective of the investigation consists in studying and analyzing the legal standards to fully comply with the rights laid down by the Constitution such as the right to privacy, against the crimes of cyber harrassment in adolescents in their middle school education in Ecuador. For this purpose an explanatory investigation was established using a qualitative perspective to achieve the proposed objectives, framed by a research line of patterns of social behavior. This leads to the main result that adolescents in middle school use social networking without adopted security and protection measures and their information is exposed without any type of restriction. Concluding that adolescents, despite manipulating and managing computer networks don't know the implications that can bring the misuse of them.
