La prueba en violencia intrafamiliar y el derecho a la seguridad jurídica

Abstract

El trabajo de graduación bajo la modalidad de Tesis cuyo tema es: LA PRUEBA EN VIOLENCIA INTRAFAMILIAR Y EL DERECHO A LA SEGURIDAD JURÍDICA”, nace de la necesidad de reformar el actual Código Orgánico Integral Penal en cuanto a la normativa para la obtención de la prueba en este ámbito, dotando de una Reforma adecuada que responda a la realidad de todo tipo de violencia intrafamiliar en el sector de estudio, contribuyendo a no vulnerar la seguridad jurídica de los integrantes del grupo familiar. En cuanto a esta Reforma de la normativa Penal se puede manifestar que el legislador en miras de aplicar la justicia ha optado por tipificar como delito o contravención a diferentes actuaciones atípicas en el ámbito de violencia intrafamiliar, designando la competencia respectiva a la Fiscalía o a la Unidad de Violencia Intrafamiliar respectivamente, sin embargo en la práctica no existe celeridad, y como la víctima no regresa han quedado en la impunidad, por lo que la norma en este ámbito debe ser reformada en base al principio de dar servicio a la colectividad oportunamente, de tal modo que no se de las absoluciones de los procesos en tanto y en cuanto existe violencia y no este comprobada. Además se propone, que en el caso de flagrancia al supuesto agresor se lo detenga en la Unidad de Policía Comunitaria del respectivo cantón mientras llegue la hora de la Audiencia en el Juzgado de Violencia Intrafamiliar siempre que la incapacidad no sobrepase los quince días, si en la misma el juzgador lo absuelve o comprueba su responsabilidad y por tanto su culpabilidad, a su salida del Centro de Detención Provisional tanto víctima como agresor deberán cumplir las terapias psicológicas siempre enmarcadas en el ámbito del seguimiento para verificar su cumplimiento, y de este modo el profesional correspondiente pueda determinar la afectación psicológica acontecida en la psiquis de las personas. Con estas consideraciones, este Trabajo culminado con la ayuda y atención de todos y cada uno de los profesionales del derecho y de las autoridades, aportan o concluyen que la socialización de la normativa y la prevención por medio de las Defensorías Comunitarias, así como ciertas reformas en cuanto a la prueba y la competencia para conocer los tipos de violencia intrafamiliar, van de la mano con que estas se lleguen a cristalizar en el quehacer diario aplicando la seguridad jurídica con el protagonismo del verdadero profesional quien ayuda a solucionar los conflictos.
