Item Características de la violencia a niños niñas y adolescentes en los casos atendidos por los departamentos de consejería estudiantil del distrito 09d12 Balao-Naranjal-educación en función de la restitución de derechos y disminución de la violencia(Universidad Técnica de Ambato. Facultad de Jurisprudencia y Ciencias Sociales, Unidad de Posgrado, Maestria en Trabajo Social, 2020-11) Ordóñez Ruiz, Mariana Mercedes; Barragán García, José GabrielThis research has as its central theme the analysis of the characteristics of violence against children and adolescents in cases attended by the Departments of Student Counseling-DECE of District 09D12 Balao-Naranjal-Education. Therefore, at the beginning of this study, the conceptual review of violence was taken as a starting point, based on its typologies, causes and consequences, which allow a comprehensive, clear and precise understanding of this problem; At the same time, the national and international legal regulations that support the rights of children and adolescents were reviewed, towards a true protection and restitution of rights. Previous research that shows the reality of this psychosocial phenomenon is also collected, and the results of this local study are exposed, showing that the violation towards childhood and adolescence is a socio-cultural problem deeply rooted in the population under investigation. Among the most relevant results are the identification of the most recurrent types of violence, physical violence, negligence, psychological and sexual, their contexts of manifestation, the areas of affectation in the victims, the prevention and intervention procedures used by professionals of the DECE in cases of violation of rights and the level of significance of these in the vindication of the rights of children and adolescents. Finally, some recommendations are established so that at the district level, decision-making and the generation of training and awareness strategies directed at the entire educational community are improved, based on the decrease in violence and the improvement of the quality of life of children and adolescents in the educational institutions of District 09D12 Balao-Naranjal.Item Obstrucción de vínculos parentales en el ejercicio del régimen de visitas de niños, niñas y adolescentes: un estudio de casos desde la práctica Judicial-Cuenca 2015-2017.(Universidad Técnica de Ambato. Facultad de Jurisprudencia y Ciencias Sociales, Unidad de Posgrado, Maestria en Trabajo Social, 2020-11) Tapia Calle, José David; Barragán García, José GabrielThe main objective of this study was to identify the mechanisms of obstruction of parental ties in the exercise of the visitation regime of children and adolescents through the study of cases from the judicial practice in the Family, Woman, Childhood and Adolescence Unit in the Cuenca canton during the period of time from 2015 to 2017. In this study, all the factors that influence family conflict were analyzed and the main arguments that the procedural parties use to hinder compliance with the visitation regime within a judicial process against the non-custodial parent of their children are described. . The existence of contexts of social inequality in which fathers and mothers develop after the separation and its incidence in the visitation regime of their children is determined, finally the effectiveness of the legal norms that regulate the right of visits among the minors and their parents. The methodological procedure used was qualitative and quantitative in nature, with greater emphasis on qualitative design, the study was in the field and laboratory, the techniques used were the interview and documentary analysis of cases selected at the discretion of experts, the judgments selected were those They represented complex cases within divorce and visitation cases. The study was carried out at an exploratory, descriptive and analytical level, since there are no major approaches to the phenomenon in Latin America and particularly in Ecuador. The guiding question for the research was to answer: What is the evolution of the problem in the visitation regime and the obstruction mechanisms most used by the parents? As results found, it was possible to identify that the highest level of conflict in family law occurs in causal divorce processes in relation to the low incidence of conflicts in the visitation regime processed in separate trials. The existence of various parental obstruction mechanisms used systematically by the custodial parent throughout the judicial process is evidenced.Item La vulneración de los derechos de las personas con enfermedades catastróficas y su dificultad al acceso a la atención integral en el sistema de salud pública(Universidad Técnica de Ambato. Facultad de Jurisprudencia y Ciencias Sociales, Unidad de Posgrado, Maestria en Trabajo Social, 2020-10) Vargas Pin, Jessica María; Barragán García, José GabrielThe demand for people suffering from catastrophic diseases in Ecuador is increasing over time and the fulfillment of comprehensive health in our country, especially directed at this priority group and in a situation of double vulnerability, is a debt that the State maintains and that in many cases it is not fulfilled according to current regulations, which leads to the violation of one of the fundamental human rights within the Ecuadorian Constitution, such as the right to health. In effect, the state of health not only has to do with the optimal functioning in the biological aspects of the person but also those factors such as; enjoy goods and services that contribute to a state of human well-being. In this same sense, health focused on the bio-psycho-social level of the human being has become a social objective, where people with catastrophic diseases are disadvantaged and invisible in access to comprehensive health care, showing the problems and the increase in inequities in health and healthcare; This implies that the results presented in the public health system are insufficient to achieve the goals proposed by the State. In this same sense, this research aims to determine the impact of the violation of the rights of people with catastrophic diseases, for which it begins with the theoretical review of approaches that approach and represent the reality of the human being, this will allow a Better understanding of the environments and spaces for socialization of people suffering from these diseases. Likewise, a review of international and national legal regulations is carried out with a focus and criteria regarding the health and health services that this human group receives. The qualitative methodology is also applied, with the aim of observing, interacting and understanding the reality of people and making conclusions and recommendations that allow improving the health care of people suffering from catastrophic diseases.
