    El derecho a la salud de los habitantes del Cantón Lago Agrio y la explotación petrolera

    The present research work has as its theme. "THE RIGHTS TO THE HEALTH OF THE CANTON LAGO AGRIO INHABITANTS AND PETROLEUM EXPLOITATION", the investigation showed that the rights to health guaranteed by the Constitution of the Republic are being violated cruelly by companies Due to the fact that they carry out extractive activities of petroleum without the proper precaution and methodology. In addition, the investigation revealed that the oil companies have not made any kind of reparation and much less compensation to the people who have been and still are affected in their health by the environmental contamination that provoke to extract the petroleum. It is important to mention that the present research arises from the need to implement a legal regulation that ensures the right to health of the inhabitants that have been affected by the great contaminations caused by oil companies when extracting oil from the Ecuadorian Amazon, allowing So give a contribution to the community and above all make respect the rights enshrined in the Constitution of the Republic, especially the right to health established in its art. 32. With these considerations and in application of article 396 ibidem that determines that "the State adopts the appropriate policies and measures that avoid the negative environmental impacts when there is certainty of damage" and if there is doubt about the environmental impact although there is no scientific evidence the State shall take appropriate and timely measures in defense of the rights of nature and the rights to health. In other words, the State will be responsible and guarantor of the rights established in the supreme norm or charter to ensure a dignified life for the Ecuadorian people.

    La salud pública en el régimen constitucional del buen vivir y las adicciones a sustancias estupefacientes y psicotrópicas

    The present research is focused on the study and application of the regulations established for the control, consumption, treatment and rehabilitation of addicts to narcotic and psychotropic substances in Ecuador by comparing national and international legislation. The importance of the research focuses on the total application of the regulations established in legal instruments, taking into account the increase in addiction rates that have developed over the years in Ecuador, taking into account how it has been Developed a new model of government management complex and fully linked to the laws in this case that provide guarantees and are protective of rights through the new Ecuadorian Constitution. Thus, through the present investigation has been investigated with respect to the negative effects caused by addictions and how they develop and result in a public health problem that involves and requires the attention of the state and the application of the regulations Constitutional law that establishes the attention for this case. This work has been developed through the application of research strategies in order to obtain true information and collaborate for future studies of this subject.

    El aborto clandestino y el derecho a la salud

    In Ecuador, the consensual abortion or V.P.I (voluntary pregnancy interruption) is a crime and it is punished by the article 149 from “Codigo Orgánico Integral Penal” (Penal Body of Laws). This punishing law doesn’t take into account gender factors, which results in women fundamental rights denial. Therefore, women aim for an underground abortion that turn them away from the public health systems The lack of focused information about unsafe abortion and its link to maternal deaths, therapeutic abortion access restrictions, and abortion caused by sexual violence, professional secret infringement added to women in abortion process prosecution violate the Ecuadorian women rights to health, reproduction, privacy, violence free life, and substantial equality. Situation that leads to a discrimination condition. In a free, open-minded, and pluralistic society, legislators are obliged to exercise the fundamental rights according to the necessities of each historical moment. Gathered experience in term laws application, the social and juristic acknowledgement advance in women independence in their public and private life advocate for voluntary pregnancy interruption regulations as long as women independence and competent antenatal life protection as a juristic good are guaranteed.

    El acceso a la salud de los grupos de atención prioritaria y el principio constitucional de igualdad real y formal

    Para la mayoría de las legislaciones, si no es posible mencionar a todas, consideran a la salud como un derecho fundamental al que todos los grupos humanos tienen acceso en igualdad de condiciones y universalidad. Al ser la salud un derecho garantizado por el estado, es este quien debe brindar las prestaciones y facilidades en forma de un sistema de salud público. Los diversos grupos humanos, son los beneficiarios del sistema de salud y a quienes se les debe garantizar el pleno acceso a la misma; los grupos de atención prioritaria, vulnerables o incluso llamados relegados en algunos casos, son una realidad global sujeta a tendencias especiales en el tratamiento de la salud, debido a las peculiaridades que encierran y sobre todo a la premura en la atención. La eficacia de los sistemas de salud, es fundamental para garantizar este derecho, pues es importante trasladar a la realidad las disposiciones vigentes en las leyes y códigos, creando los medios necesarios que permitan llevar una igualdad formal a un nuevo nivel conocido como igualdad real o material, debido a que solo así se logrará un acceso a la salud óptimo, integral y sobre todo, que aporte y construya a una sociedad más justa en la que primen siempre los derechos de los seres humanos. La salud, es un derecho fundamental y como tal, se tiende a garantizarlo mediante normas y leyes que afirmen el libre acceso, gratuidad y sobre todo universalidad en los servicios. En la actualidad, ha quedado demostrado que en la mayoría de servicios públicos, la tipificación de la norma en la que se especifica la forma de prestación así como los aparentes servicios o facilidades, no es suficiente para garantizar el correcto y cabal acceso. A esta afirmación, se suma el caso del acceso a la salud, que como servicio público ha sido cuestionado por décadas y ha arrastrado hasta la actualidad fisuras propias, que de una u otra manera no han permitido el libre desenvolvimiento de la autoridad sanitaria en beneficio de la población. Es por ello que, se hace necesario el estudio a fondo y pormenorizado del actual sistema público de salud, con la finalidad de corregir las inequidades que generan un sistema de igualdad formal, para que a través de la implementación de la igualdad real o material como principio rector, se alcancen objetivos concretos en materia de salud.
