(Universidad Tècnica de Ambato, Facultad de Jurisprudencia y Ciencias Sociales, Carrera de Derecho, 2023-09) Monar Llanos, Wilson Geovanny; Vayas Castro, Guillermo Santiago
Single-parent interference or better known as parental alienation syndrome (SAP) originated in 1985 by the American psychiatrist Richard Garden, is the opposite extreme to the dynamics of cooperation and communication between parents that encourage the formation of a proper relationship between parents and children; Single-parent interferences are manifested in divorce or separation proceedings, where the custody of the child is disputed, its main display is the denigration of one parent by the other, generating serious and deep psychological damage in the child, affecting the parent-child relationship. With this precedent, the objective of this document is to analyze single-parent interference and its violation to the principle of the best interest of the children and adolescents in Ecuador. The methodology used by the researcher has a quantitative and qualitative approach and contains a descriptive level to scrutinize how these interferences are manifested and in which scenarios they are evidenced, to obtain the data surveys and interviews were used, which were carried out to law professionals in free practice belonging to the forum of lawyers of Tungurahua and to give more enhancement to the results, the Judges of the Family Unit of Women, Children and Adolescents were interviewed as well. Concluding that single-parent interference does violate the principle of the best interest of the child and adolescent, there being some cases in Ecuador where there is no rule to proceed with its respective sanction.
