Item Las multas como pena accesoria del delito y el principio de proporcionalidad(Universidad Técnica de Ambato, Facultad de Jurisprudencia y Ciencias Sociales, Carrera de Derecho, 2017-03) Guacho Yuquilema, Edgar Franklin; Sánchez Espín, Jorge EnriqueThe graduation work: "FINES AS PENA ACCESSORY OF CRIME AND THE PRINCIPLE OF PROPORTION" proposed that the pecuniary fines from a judgment, be regulated in a different way to which to date has been carried out, so that this so the state ensure the proper implementation of laws. After the investigative work, it is concluded that the mechanical application made by the administrator of justice by imposing financial penalties for the person whose judgment is damning, it is implemented through the legal requirements established by law, but it should be noted that the same law It does not take into consideration several factors which are vital for assertive decision imposing fines. The addition of a new methodology for determining the fines to be applied in our legislation will help forewarn not only the rights and guarantees of persons deprived of liberty but of the victims and the state which promotes better performance and application criminal regulations. By taking into consideration several key aspects in the implementation of a correct and appropriate punitive legislation, the state would guarantee due process and proper compliance with the principles and constitutional guarantees. Under these parameters, it is inevitable to state that this research is of vital importance and significance in the proper and optimal development of Ecuadorian law, as it seeks to provide an alternative solution to the problem, which is of paramount importance is incorporated into our legal system for the protection and safeguarding of the rights and guarantees of individuals.Item El pragmatismo de las políticas públicas para la igualdad en discapacidad y el derecho constitucional de educación inclusiva(Universidad Técnica de Ambato. Facultad de Jurisprudencia y Ciencias Sociales, Unidad de Posgrado, Maestria en Derecho Constitucional, 2020-11) Guacho Yuquilema, Edgar Franklin; Benavides Benalcáza, Merck MilkoThis investigation born from the comparative, historical, doctrinal, constitutional, legal and development analysis regarding public policies and constitutional law that seek to concretize the exercise of rights for all people. For their part, public policies since their historical development have been characterized by detecting problems in society, in democratic and rights states; based on a certain constitutional paradigm and political line of the current government. It is convenient to emphasize that in certain cases the determination, formulation, development and evaluation of public policies has left aside the historical, economic, social and constitutional development context, focusing on simple legal compliance. On the other hand, the development of the law is based on the fulfillment of the guarantee of the declaration of Human Rights, under these characteristics the states in their legal or constitutional reforms seek its effectiveness, although it is true that in certain cases they are constituted in theoretical postulates, due to the lack of state capacity and responsible entities that do not understand the constitutional responsibility regarding compliance. The effectiveness of Inclusive Education of certain quality has been verified as a public policy that seeks to guarantee the constitutional right to education in Ecuador established through the 2008 constitutional reform that is configured under the Constitutional paradigm of Rights and Social Justice. Under the characteristics established with the research development, the degree of materialization of public policies on equality in disability that seeks to materialize the right to quality inclusive education in both basic general education and high school in zone three was analyzed. Finally, it is indicated that public policy as a constitutional guarantee, since its establishment, has been linked to the exercise of power and mass manipulation of the current government without determining clear guidelines that make such guarantee concrete.Item La respiración y su incidencia en la practica de la natación en los estudiantes de primer año de bachillerato común del Instituto Superior Tecnológico ―Bolívar en el período marzo – agosto 2011.(2013-06-12) Guacho Yuquilema, Edgar FranklinLa respiración es un proceso vital mediante el cual nuestro cuerpo toma el aire del ambiente y lo introduce al organismo al mismo tiempo que recupera el bióxido de carbono del interior del cuerpo, para ser expulsado mediante el mismo sistema. La respiración es un proceso fisiológico indispensable para la vida de los organismos aeróbicos. Gracias a la respiración podemos tener energía y logramos llevar a cabo nuestra alimentación, actividades y nuestra vida diaria de una manera adecuada. El aire es un elemento natural que contiene nitrógeno, oxígeno y Dióxido de carbono, pero en el momento de hacer el intercambio de gases, los alvéolos pulmonares solamente toman el oxígeno necesario y útil para las funciones indispensables y el buen funcionamiento del organismo lo demás lo desecha. La respiración consta de tres grandes momentos para que sea de utilidad y beneficio: La inspiración es el momento en el cual tomamos aire del medio exterior a través de la nariz y lo introducimos a los pulmones cuyo acto hace posible la vida en los organismos aeróbicos. El proceso de intercambio de gases se realiza dentro de los pulmones y es de vital importancia para el buen desempeño de las funciones vitales. La espiración es el momento en que sale el bióxido de carbono del interior de todo el cuerpo.
