    The present research project about the Pre-Legislative Consultation in the Ecuadorian State and Collective Rights, and how to influence the adoption of legislative measures in state agencies, and those responsible for the alleged vulnerabilities related to Human Rights. In Ecuador, the Pre-Legislative Consultation has been held since antiquity, it is emphasizing the execution of a work in the indigenous communities in remote times the participation of these peoples is guaranteed, communicating loudly to the ancestral peoples about said execution, with In order to protect their rights and integrate them into working groups, guaranteeing their own participation of indigenous peoples. It is necessary to take into account several rights on collective rights in Ecuador, the influence on the decision making of the states in Ecuador and the lack of knowledge about the procedure of the Pre-Legislative Consultation.

    Los derechos constitucionales y la mendicidad en los adultos mayores

    This research is in response to the need to create a legal basis to contribute to the problems and needs in older adults who have made begging their way of life in the Tungurahua Province. For society this is an interesting topic as every human being moves toward the same destination, as old age. This proposed some solutions to the problem. After making a deep social analysis the dwellers in the gerontology centers in the Tungurahua Province, as well the cantonal councils for the protection of the rights. In order to know if their rights were violated or as we as to the dangers their faces on the streets to beg. This research proposes to create a Provincial Ordinance, the same that protects the rights of the elderly people as they need priority attention and constitutional benefits, in the cantons of the Tungurahua Province. Establishing some provincial–level regulations for elderly people that can benefit them in everything.

    La gobernabilidad y los métodos de participación ciudadana

    This paper emphasizes the importance of research on a truly relevant topic, since it is a key element in the development of participatory governance. The research involved a thorough analysis of national regulations for access and application of methods of citizen participation. As a result, the existence of general guidelines allowing access to such methods has been confirmed, since it empowers the Decentralized Municipal Autonomous Government of the canton of El Chaco to create an ordinance providing specific guidelines for their application. The methodology applied responds to the qualitative paradigm, through which an in-depth study is presented that explains one by one the methods of participation. The result is two statements: one about what these methods represent in theory and another that reflects the reality when applied in the canton of El Chaco. The present work, therefore, includes an analysis of real and updated data obtained through municipal decentralized autonomous government officials in the canton of El Chaco. In summary, the line of research contemplated the bibliographic-documentary and field modalities, supported at the exploratory, correlational and explanatory levels. All in all, it determined the creation and presentation of this novel work for the social sciences, whose purpose is to contribute through recommendations to the improvement of the citizen participation system, so that it becomes a real strength in the governance of the Decentralized Autonomous Municipal Government of the canton El Chaco.

    El principio de no regresión ambiental en relación con la Biodiversidad y los transgénicos en Ecuador

    main objective of this research work is to analyze the principle of environmental non-regression in the use of transgenics in Ecuador, which were established in the 1990s with the introduction of new soil technologies, consigned to the creation of genetically engineered organisms. modified (GMO), also known as transgenic or living modified organisms. These organisms are characterized by having a manipulated genetic composition that allows them to develop novel and "useful" characteristics for human life. The Constitution of Ecuador symbolizes an important framework that relates great advances in the issue of rights, but also in relation to the prevailing economic type, this problem is especially serious for a country like Ecuador, which enjoys a comparatively small territorial widening and Due to the great biological diversity that has been cataloged in one of the richest countries in the world in terms of ecosystems, species and genetic resources, possessing the greatest biodiversity per unit area in the world, we can exemplify Ecuadorian biodiversity as a trust contract, where the trustor would be the previous generations, the fiduciaries or temporary administrators of the environmental goods is the present generation and the generations to come are children or grandchildren will be the trustees. By virtue of that, that great trust agreement was delivered with the purpose of administering a series of environmental goods, and thus being able to delegate it to third or fourth generations. This principle of no environmental regression brings with it the total disappearance of everything considered as environmental risk, without the need to resort to international regulations or jurisprudence, forming its bases in minimum percentages of environmental risk. Therefore, addressing the study of GMOs is controversial because it refers to the preservation, care and control of biodiversity.     La violencia económica y patrimonial entre cónyuges y el derecho de igualdad

    The economic and patrimonial violence in Ecuador is a type of violence between couples that has not been spread, and that many people do not know, this is one of the reasons why there are no complaints for this cause, the objective of this investigation is focuses on Investigating the incidence of economic and patrimonial violence between spouses in the right to equality, in the Salcedo Canton. The methodology that was applied was exploratory and descriptive because it is a social phenomenon that is of public interest because the members of the family nucleus are the axis of society. The study population was 3415 women and men of the Canton between 20 years or 45 years and 7 professionals of the Department of the Cantonal Board of Protection of Rights of Salcedo and women who go to the Shelter for women victims of violence and their dependents . Among the main findings, the study ages were between 20 and 45 years of age, the average age of this study group was 33 years of age, and their prevailing level of education was 37.9% secondary. 40% of the women surveyed do not perform any work activity, the average salary of these women was $ 477.45. In relation to economic and patrimonial violence, 57% at some time in their life has been restricted from their assets; 44% at some point have been destroyed property or belongings and their income has been controlled; in 51% of the population who distributes the family income is the couple. Therefore, the proposal defines intervention strategies that may well allow progress in prevention, care, protection and punishment of violence against women.
