| Abstract: | ABSTRACT This research work is an analytical and comparative study on labor rights and telecommuting, seeks to resolve the legal problem emerged following the onset of Telework in Ecuador, regarding the contractual relationship if this set or not a contract Individual work itself is not criminalized in our labor Code. Teleworking when not being regulated by the Labor Code, left totally unprotected people working in this medium as having no where to turn in case of labor problems encountered at work, their rights are violated, same as They are established in the Constitution of the Republic of Ecuador, international treaties and conventions. Our society today makes great use of technological means for communication or entertainment, why telecommuting is an accessible working environment for all people, without discrimination, since being a working distance makes permanent use Technologies of Information and Communication ICT. |
| Description: | RESÚMEN EJECUTIVO El presente Trabajo de Investigación es un estudio analítico y comparativo sobre los Derechos Laborales y el Teletrabajo, busca resolver el problema jurídico surgido a raíz del aparecimiento del Teletrabajo en el Ecuador, en cuanto a la relación contractual, si este configura o no como un contrato individual de trabajo, mismo que no se encuentra tipificado en nuestro Código del Trabajo. El teletrabajo al no encontrarse regulado en el Código del Trabajo, deja en total desprotección a las personas que trabajan en este medio, ya que al no tener donde recurrir en caso de problemas laborales surgidos en el trabajo, se vulneran sus derechos, mismos que se encuentran establecidos en la Constitución de la República del Ecuador, Tratados y Convenios Internacionales. Nuestra sociedad en la actualidad hace gran uso de los medios tecnológicos con fines de comunicación o entretenimiento, por ello el teletrabajo es un medio laboral accesible para todas las personas, sin discriminación alguna, dado que al ser un trabajo a distancia, hace uso permanente de las Tecnologías de la Información y la Comunicación TIC. |
