Abstract
The present research, titled “The Statute of Limitations in Criminal Actions for Sexual
Offenses Committed by Juvenile Offenders: Analysis of Ruling No. 15-19-CN and Related
Cases”, is based on the urgent need to clarify the normative contradiction between the
constitutional principle of the non-applicability of statutory limitations to sexual crimes
committed against children and adolescents—as recognized in Article 46, paragraph 4 of the
Constitution of the Republic of Ecuador—and the provisions of Article 334A of the Code of
Childhood and Adolescence, which establishes a general statute of limitations of five years
for crimes committed by adolescents, without distinguishing the severity of the offense. This
legal dissonance not only creates a clear risk of impunity but also leads to inconsistent judicial
interpretations. In this context, the study aims to carry out a critical legal analysis of this
normative tension with the purpose of identifying interpretative alternatives that ensure the
coherence of the legal system and the effective protection of victims’ rights. To this end, the
central focus of the analysis will be Ruling No. 15-19-CN and Related Cases-22 issued by the
Constitutional Court of Ecuador, as it constitutes a key precedent in the field of children's and
adolescents’ rights. Nevertheless, the Court's ruling revealed divided interpretations regarding
the non-applicability of statutory limitations in sexual offenses committed by juvenile
offenders, which resulted in a decision with limited scope and generated uncertainty in the
practical application of the law. This situation highlights the need for a deeper analysis to help
consolidate a coherent and rights-based legal framework

La presente investigación titulada “ La prescripción de la acción penal en delitos sexuales
cometidos entre menores infractores: Análisis de la sentencia N°15-19CN y acumulados ”se
fundamenta en la imperiosa necesidad de esclarecer la contradicción normativa existente entre
el principio constitucional de imprescriptibilidad de los delitos sexuales cometidos contra
niñas, niños y adolescentes, reconocido en el artículo 46, numeral 4 de la Constitución de la
República del Ecuador, y lo dispuesto en el artículo 334A del Código de la Niñez y
Adolescencia, que establece un plazo general de prescripción de cinco años para los delitos
cometidos por adolescentes, sin distinguir la gravedad del delito. Esta disonancia legal no
solo genera un riesgo evidente de impunidad, sino que también propicia interpretaciones
judiciales dispares, en este contexto, el estudio se orienta a realizar un análisis jurídico crítico
de esta tensión normativa con el propósito de identificar alternativas interpretativas que
garanticen la coherencia del ordenamiento jurídico y la efectiva protección de los derechos
de las víctimas. Para ello, se tomará como eje central de análisis la Sentencia N.º 15-19-CN
y acumulados-22 de la Corte Constitucional del Ecuador, al constituirse en un precedente
fundamental en materia de derechos de la niñez y adolescencia, no obstante, la sentencia de
la Corte dejó expuestas interpretaciones divididas sobre la imprescriptibilidad en delitos
sexuales cometidos por adolescentes infractores, lo que derivó en un fallo con alcances
limitados y generó incertidumbre en la aplicación práctica del derecho. Esta situación
evidencia la necesidad de un análisis más profundo que contribuya a consolidar un marco
normativo coherente y garantista
