| dc.description | En el presente trabajo de investigación se analizará la aplicación de la justicia juvenil restaurativa y su relación con los desafíos de la reinserción social que enfrentan los adolescentes infractores en el Ecuador, tomando en cuenta las limitaciones que actualmente presenta el sistema especializado de adolescentes infractores pues a pesar de que el ordenamiento jurídico ecuatoriano reconoce principios orientados al desarrollo integral y la reintegración social del adolescente, en la realidad se presentan múltiples factores que afectan el cumplimiento efectivo de los objetivos de la reinserción social. Examinando como la falta de mecanismos restaurativos influye directamente en los procesos de reinserción social de los adolescentes infractores, ya que se considera que en gran parte de los adolescentes infractores provienen de entornos marcados por violencia exclusión social, pobreza y vulneración de derechos, de igual manera se estudian los desafíos que existen dentro de los centros de internamiento institucional y las dificultades que enfrenta el estado para garantizar estos procesos integrales de reintegración social. También se analiza el marco jurídico nacional e internacional que regula la justicia juvenil restaurativa con la finalidad de determinar si verdaderamente cumple con el principio de protección integral y el principio de interés superior del niño. La importancia de esta investigación se centra en la necesidad de comprender que la reinserción social no es solamente el cumplimiento de una medida socio-educativa sino que es un proceso integral que permite al adolescente reconstruir vínculos sociales, fortalecer su estabilidad emocional y desarrollar capacidades que lo ayuden a reincorporarse en la sociedad, así con esta investigación se presenta una critica la eficiencia del sistema. | |
| dc.description.abstract | This research paper will analyze the application of restorative juvenile justice and its relationship to the challenges of social reintegration faced by adolescent offenders in Ecuador. It will consider the limitations currently present in the specialized juvenile offender system, because although Ecuadorian law recognizes principles aimed at the comprehensive development and social reintegration of adolescents, in reality, multiple factors affect the effective achievement of social reintegration goals. The paper will examine how the lack of restorative mechanisms directly influences the social reintegration processes of adolescent offenders, given that a large proportion of these offenders come from environments marked by violence, social exclusion, poverty, and human rights violations. It will also study the challenges within institutional detention centers and the difficulties the state faces in guaranteeing these comprehensive social reintegration processes. The national and international legal framework governing restorative juvenile justice is also analyzed to determine whether it truly complies with the principle of comprehensive protection and the principle of the best interests of the child. The importance of this research lies in the need to understand that social reintegration is not merely the fulfillment of a socio-educational measure, but rather a comprehensive process that allows adolescents to rebuild social ties, strengthen their emotional stability, and develop skills that will help them reintegrate into society. This research thus presents a critique of the system's effectiveness. | |
