| dc.description | El avance de las tecnologías de la información y la comunicación ha provocado importantes cambios en la forma en que las personas acceden a bienes y servicios. Actualmente, gran parte de las actividades comerciales se desarrollan mediante plataformas digitales, sin embargo, este escenario también ha generado nuevas formas de vulneración de derechos, especialmente, para las personas adultas mayores, quienes, debido a la brecha digital, al limitado acceso a capacitación tecnológica y al desconocimiento de mecanismos de seguridad informática se encuentran en una situación de mayor exposición frente a infracciones digitales. El presente trabajo tuvo el propósito de estudiar las medidas de protección para el adulto mayor frente a las infracciones digitales al consumidor, la investigación surge de la necesidad de analizar si los mecanismos de protección actuales responden de manera adecuada a las nuevas dinámicas del comercio electrónico y a los posibles riesgos que afrontan las personas adultas mayores. El estudio se desarrolla bajo un enfoque cualitativo, mediante las modalidades bibliográfica-documental y de campo. El análisis de la normativa, doctrina jurídica, artículos científicos e investigaciones previas permitió construir el fundamento teórico de la presente investigación, también se aplicaron entrevistas a adultos mayores para la obtención de criterios que contribuyeran a un mayor entendimiento del problema analizado. Los resultados reflejaron que, aunque el ordenamiento jurídico ecuatoriano reconoce derechos y mecanismos de protección para los consumidores y las personas adultas mayores, todavía existen limitaciones para actuar eficazmente frente a los nuevos métodos de infracciones digitales. La investigación se desarrolló dentro de la línea de investigación de protección de derechos y garantías, orientada al fortalecimiento de mecanismos jurídicos que permitan una tutela efectiva de los grupos de atención prioritaria en los entornos digitales. | |
| dc.description.abstract | The advancement of information and communication technologies has brought about significant changes in how people access goods and services. Currently, a large part of commercial activity takes place through digital platforms, which has facilitated consumer relations. However, this scenario has also generated new forms of rights violations, for example, for older adults, who, due to the digital divide, limited access to technological training, and a lack of knowledge of cybersecurity mechanisms, are more vulnerable to digital offenses such as online fraud, deceptive advertising, improper charges, identity theft, and unauthorized use of personal data. This research aimed to study protective measures for older adults against digital consumer offenses. The importance of this research stems from the need to analyze whether current protection mechanisms adequately address the new dynamics of e-commerce and the potential risks older adults face when interacting in the digital world. Furthermore, this research is especially important given that it focuses on a priority group whose rights require effective protection within a constantly digitizing society. To achieve this objective, a qualitative approach was used, employing bibliographic-documentary and field research methods. The analysis of regulations, legal doctrine, scientific articles, and previous research allowed for the construction of the theoretical foundation of this investigation. Interviews with older adults will also be conducted to obtain perspectives that will contribute to a greater understanding of the problem analyzed. The results revealed that, although the Ecuadorian legal system recognizes rights and protection mechanisms for consumers and older adults, limitations still exist in effectively addressing new methods of digital infringement.
