Abstract
The present research project addresses a critical analysis of the Ecuadorian justice system from
the perspective of legal pluralism, highlighting the coexistence of the ordinary justice system
and the constitutionally recognized Indigenous justice system. The importance of this topic lies
in its contemporary relevance and in the need to strengthen intercultural dialogue to ensure
respect for due process, without disregarding the validity of the customary practices of
Indigenous peoples and nationalities. Based on the normative review of the 1998 and 2008
Constitutions, as well as the examination of relevant case law from the Constitutional Court,
the study analyzes the scope and limitations of the exercise of Indigenous justice, particularly
in cases related to guarantees such as habeas corpus. The methodology applied combines a
qualitative approach grounded in documentary analysis, doctrinal and normative review, and
interviews with experts and justice operators. This approach allowed for the identification of
perceptions, tensions, and opportunities for improvement in the coordination between both
judicial systems. The research is framed within the study of constitutional law, legal pluralism,
and the administration of justice. The scientific novelty of this work lies in the proposal of an
institutional strengthening model that promotes intercultural training, the recovery of
legitimate traditional practices, and the incorporation of constitutional standards into
community procedures, while respecting their autonomy. This proposal seeks to contribute to
a more inclusive justice system, consistent with constitutional mandates and aligned with the
social and cultural realities of contemporary Ecuador

El presente trabajo de investigación aborda el análisis crítico del sistema de justicia ecuatoriano
desde la perspectiva del pluralismo jurídico, destacando la coexistencia de la justicia ordinaria
y la justicia indígena reconocida constitucionalmente. La importancia del tema radica en su
actualidad y en la necesidad de fortalecer el diálogo intercultural para garantizar el respeto al
debido proceso, sin desconocer la validez de las prácticas consuetudinarias de los pueblos y
nacionalidades indígenas. A partir de la revisión normativa de las Constituciones de 1998 y
2008, así como del estudio de jurisprudencia relevante de la Corte Constitucional, se examinan
los alcances y limitaciones del ejercicio de la justicia indígena, especialmente en casos
vinculados a garantías como el habeas corpus. La metodología aplicada combina un enfoque
cualitativo, basado en análisis documental, revisión doctrinaria y normativa, y entrevistas a
expertos y operadores de justicia. Esta aproximación permitió identificar percepciones,
tensiones y oportunidades de mejora en la articulación entre ambos sistemas judiciales. La
investigación se inscribe en la línea de estudio del derecho constitucional, pluralismo jurídico
y administración de justicia. La novedad científica del trabajo radica en la propuesta de un
modelo de fortalecimiento institucional que promueve la capacitación intercultural, la
recuperación de prácticas tradicionales legítimas y la incorporación de estándares
constitucionales en los procedimientos comunitarios, respetando su autonomía. Esta propuesta
busca contribuir a una justicia más inclusiva, coherente con el mandato constitucional y acorde
con las realidades sociales y culturales del Ecuador contemporáneo
