| dc.description | Este trabajo presenta una investigación encaminada por una parte a explorar a la mujer indígena dentro de los contextos: histórico, social y cultural, a manera de ilustrar su trayectoria y posición dentro del estado ecuatoriano. Así mismo, se analiza la situación actual y el cómo se maneja la violencia sexual irrogada en contra de la mujer dentro de las comunidades indígenas del Ecuador, cuando estas acuden a los sistemas de justicia ordinario o consuetudinario. Así, se configura un problema socio-jurídico, un fenómeno silencioso que ataca a la integridad sexual de miles de niñas, adolescentes, jóvenes y adultas. En esta línea, dentro de la metodología aplicada se utiliza el paradigma crítico-propositivo, a fin de analizar el fenómeno que aqueja a la víctima para proponer soluciones reales que respondan a la necesidad humana. El evaluar la aplicación y defensa de los derechos que cobijan a las mujeres que por riqueza cultural son indígenas, se determina como un campo muy poco explorado dentro del mundo jurídico. Por esta razón se presenta un análisis de datos real, recogido de la perspectiva de la comunidad indígena de las parroquias de Cajabamba y Salasaca, pertenecientes a la región andina del país. En efecto, se exponen resultados y conclusiones que son de interés para el mundo jurídico sobre el derecho a una vida libre violencia sexual y finalmente se recomienda la aplicación de un mecanismo de cooperación que permita a la mujer indígena acudir a una justicia integral sin atentar contra el pluralismo jurídico vigente en el país. | es_ES |
| dc.description.abstract | This work presents an investigation aimed on the one hand to explore indigenous women within the contexts: historical, social and cultural, in order to illustrate their trajectory and position within the Ecuadorian state. Likewise, the current situation is analyzed and how the irrogated sexual violence against women is handled within the indigenous communities of Ecuador, when they go to the ordinary or customary justice systems. Thus, a socio-legal problem is configured, a silent phenomenon that attacks the sexual integrity of thousands of girls, adolescents, youth and adults. In this line, within the applied methodology the critical-propositional paradigm is used, in order to analyze the phenomenon that afflicts the victim in order to propose real solutions that respond to human need. Evaluating the application and defense of the rights that protect women who, due to their cultural richness, are indigenous, is determined as a very little explored field within the legal world. For this reason, an analysis of real data is presented, collected from the perspective of the indigenous community of the parishes of Cajabamba and Salasaca, belonging to the Andean region of the country. Indeed, results and conclusions that are of interest to the legal world on the right to a life free of sexual violence are presented and finally the application of a cooperation mechanism is recommended that allows indigenous women to seek comprehensive justice without threatening the legal pluralism in force in the country. | es_ES |
