dc.descriptionCombating illicit drug trafficking, organized crime, money laundering, economic vulnerability, and the fight against the financing of terrorism are among the key concerns of governments worldwide. Therefore, the objective of this research was to compare Ecuadorian regulation with the recommendations of the Financial Action Task Force (FATF) on the prevention of money laundering and terrorist financing. The study was conducted using a qualitative approach with a descriptive scope, through bibliographic and documentary review, which helped gather information on the subject under investigation. The results revealed legal gaps and limited interpretative clarity in the current regulatory framework, providing a useful basis for strengthening the mandates of the respective laws. It is concluded that Ecuador’s financial regulation shows significant progress in essential aspects such as the criminalization of money laundering and asset forfeiture; however, structural weaknesses persist that require immediate attention in order to effectively address money laundering and the financing of criminal activities.
dc.description.abstractCombatir el tráfico ilícito de drogas, el crimen organizado, el lavado de activos, la vulnerabilidad de las economías y la lucha contra el financiamiento del terrorismo, son varias de las preocupaciones de los gobiernos de turno a nivel mundial. Por ende, el objetivo de la presente investigación fue comparar la regulación ecuatoriana con las recomendaciones del Grupo de Acción Financiera Internacional en prevención de lavado de activos y financiamiento del terrorismo, se desarrolló bajo un enfoque cualitativo, con alcance descriptivo, a través de la revisión bibliográfica y documental, esto ayudo a recopilar información sobre el tema investigado. Los resultados demostraron vacíos legales y poca especificación interpretativa en la normativa vigente, siendo de utilidad para tener una base sólida para mejorar los mandatos de las respectivas leyes. Se concluye que la regulación financiera ecuatoriana presenta avances significativos en aspectos primordiales como la tipificación del lavado de activos y el decomiso, pero, persisten debilidades estructurales que requieren atención inmediata, para hacer frente al lavado de activos y el financiamiento de delitos.
