Abstract

The "cross death" is a constitutional mechanism in Ecuador designed to terminate the functions and powers of either the legislature or the executive, with the aim of resolving power struggles between these two branches. However, this mechanism lacks any form of control established by law. In contrast, in Spain, the dissolution of the General Courts (parliament) is a process that must be proposed by the President of the Government and approved by the Council of Ministers as the first filter. The second filter is the King, who issues a decree for dissolution, but this can only occur if there is no motion of censure against the President of the Government. This safeguard is not present in the Ecuadorian constitution, which means there is no mechanism to verify the causes for the dissolution of the assembly. This research aims to compare the "cross death" mechanism, its procedures, requirements, and admissibility in both Spanish and Ecuadorian legislation. To achieve this, a qualitative approach was adopted, utilizing the comparative law method and interviews as the primary technique. An interview guide was used as the research instrument with subject matter experts. The study concluded that the "cross death" process in Ecuador has flaws in its implementation, timing, and procedural aspects. Therefore, it is important to establish controls over this mechanism and to promote democratic education among Ecuadorian citizens.

La muerte cruzada es un mecanismo constitucional mediante el cual se plantea dar por terminada las funciones y atribuciones del legislativo o ejecutivo en ecuador, cuyo objetivo es el de solucionar la pugna de poder entre estas dos funciones, sin embargo, el mecanismo no contiene ningún tipo de control tipificado en una norma, ahora bien al referirnos al caso de España, se presenta la disolución de las cortes generales, esta disolución debe ser propuesta por el presidente de gobierno y es aprobada por el consejo de ministros como primer filtro, el segundo filtro lo realiza el rey mediante un decreto y esta solo se puede llevar a cabo en el caso de no existir una moción de censura contra el presidente de gobierno, lo que no se incluye en la constitución del ecuador y por lo que no se puede realizar un control en cuanto a la verificación de las causales de disolución de la asamblea. Por lo que, se realiza la presente investigación con el objetivo de comparar la figura de muerte cruzada, su procedimiento, requisitos y admisibilidad tanto en la legislación española como la ecuatoriana. Es por esto por lo que, se implementó un enfoque cualitativo, con un método de derecho comparado y como técnica se implementó la entrevista, mediante el instrumento de investigación conocido como guía de entrevistas que fueron implementadas a expertos en el tema. Con lo que se pudo concluir que la muerte cruzada contiene falencias en su implementación, tiempo y procedibilidad, por lo que es importante implementar un control al mecanismo y la implementación de educación en democracia a los ciudadanos ecuatorianos.
