Abstract
The present research work entitled "Children's Right to Psychological Health and the
Public Policies of the Ecuadorian Educational System" focuses on analyzing the problems
of guaranteeing the psychological rights of children through the application of public
policies of the Ecuadorian educational system. It is important to emphasize that the State
must guarantee free, dignified and quality access to ensure the exercise and full enjoyment
of their rights through the issuance of public policies. The right to psychological health is
a fundamental right for human beings and should therefore be valued, promoted and
protected. The research was carried out through a mixed approach, which allows me to
understand and analyze the behaviors of society relating cause and effect, through the
application of surveys to parents and interviews with officials who make up the Student
Counseling Department of the Educational Unit "Antonio Carrillo Moscoso" and
Educational Unit "Jorge Alvarez" of the Canton Santiago de Píllaro, thus working in a line
of research of law and society. Although the public policy of the Ecuadorian educational
system guarantees the psychological health of children, the results of the research show
that this right is violated due to the incorrect applicability of public policy. The research
conducted contributes knowledge because when talking about the right to psychological
health we determine the fundamental role it plays in the integral development of children,
influencing their emotional, cognitive, social and physical growth

El presente trabajo de investigación titulado “Derecho a la Salud Psicológica de los niños
y las Políticas Públicas del Sistema Educativo Ecuatoriano” se centra en analizar los
problemas de garantía del derecho psicológico de los niños mediante la aplicación de las
políticas públicas del sistema educativo ecuatoriano. Es importante recalcar que el Estado
debe garantizar el acceso gratuito, digno y de calidad que asegure el ejercicio y goce pleno
de sus derechos mediante la expedición de políticas públicas. El derecho a la salud
psicológica es un derecho fundamental para los seres humanos por ende debe ser valorada,
promovida y protegida. La investigación se llevó a cabo mediante un enfoque mixto, el
cual me permite comprender y analizar los comportamientos de la sociedad relacionando
causa y efecto, mediante la aplicación de encuestas dirigidas a padres de familia y
entrevistas a funcionarios que conforman el Departamento de Consejería Estudiantil de la
Unidad Educativa “Antonio Carrillo Moscoso” y Unidad Educativa “Jorge Álvarez“ del
Cantón Santiago de Píllaro, de esta forma se trabaja en una línea de investigación de
derecho y sociedad. A pesar que la política pública del sistema educativo ecuatoriano
garantiza la salud psicológica de los niños, los resultados de la investigación evidencian
que este derecho esta vulnerado debido a la incorrecta aplicabilidad de la política pública.
La investigación realizada aporta conocimiento pues al hablar del derecho a la salud
psicológica determinamos el papel fundamental que tiene para el desarrollo integral del
niño influyendo en su crecimiento emocional, cognitivo, social y físico
