Resumen : The problem regarding deficient integral reparation to the victim, has not been a generalized issue since the Integral Organic Penal Code regulates a penalty for the transcendence of the crime committed, whose sentences range from fifteen days in prison and with a ceiling of forty years if the active subject of the crime has committed an offense with some type of aggravating circumstance. However, there are crimes known to be doctrinaire as bagatelle and Ecuadorian criminal law has included speed for the actions of the prosecutor to discretionally apply the principle of opportunity; that it be understood that the discretionality to which I refer is with respect to the power granted by the norm to apply the aforementioned principle simply by looking at state circumstances, the sentence and the health condition of the active subject of the crime; leaving aside a constitutional right of the victim, to be repaired for having been affected his legal protected property; However, the latter may well claim by the civil jurisdiction, but the legislator has included several verbs in the Constitution of the Republic of Ecuador. as is the repair without further delay; therefore, the proposal is aimed at including a reform in the Ecuadorian criminal legislation that guarantees that the victim ends her ordeal in seeking to seek redress through the civil courts.
Descripción : El problema respecto a la deficiente Reparación Integral a la víctima, no ha sido un tema generalizado toda vez que el Código Orgánico Integral Penal regula una penalidad por la trascendencia del delito realizado, cuyas penas van desde quince días de prisión y con un techo de cuarenta años si el sujeto activo del delito ha cometido una infracción con algún tipo de agravante. Sin embargo existen delitos que conocido es los doctrinarios como de bagatela y se ha recogido en la normativa penal ecuatoriana la celeridad para las actuaciones del fiscal en aplicar discrecionalmente el Principio de Oportunidad; que se entienda que la discrecionalidad a la que hago referencia es con respecto a la facultad concedida por la norma para aplicar el referido principio velando simplemente circunstancias estatales, la pena y la condición de salud del sujeto activo del delito; dejando de lado un derecho constitucional de la víctima, a ser reparada por haber sido afectada su bien jurídico tutelado; sin embargo este último bien puede reclamar por la jurisdicción civil, pero el legislador a incluido varios verbos rectores en la carta magna como es la reparación sin mayor dilaciones; por lo que la propuesta va encaminada en que al incluir una reforma en la normativa penal ecuatoriana se garantiza que la víctima termine su viacrucis en tratar de solicitar su reparación en la vía judicial civil.
