Resumen : This research has as its theme "Migration of the obligor, AND THE RIGHT TO FOOD" it is of great importance and interest by the State so that children and adolescents precautelen effective fulfillment of the right to food itself which are subjects covered according to the established and guaranteed by the Constitution of the Republic of Ecuador Section Five, in international instruments, international treaties Unicef and the Code for Children and Adolescents. The right to food is applied to meet all the needs of a child or adolescent and thus can develop their lives in a peaceful and normal. The current Constitution of the Republic of Ecuador has within its precepts clearly both the right girls, children and adolescents are entitled to their full development, conceptualized this term in regard to growth, maturation and full development of the intellect, skills, with the sole purpose to realize their aspirations, within the family, school, social environment. The children and adolescents enjoy the common rights of human beings, besides own age as well as the right to physical and psychological integrity; his identity, holistic health and nutrition; education and culture, sport, social security; here we can identify additional requirements covering the right to food and its vital importance. t is undeniable that in our country in the last two decades the indiscriminate increase was witnessed in migration rates of young people fathers and mothers, who left the country with the common ideal, to find better days for their families but not all cases tell the same story, since in the new country or a new life emigrant practically a new family begins. Thus it was born a new problem that children and adolescents were left to care and under the protection of grandparents and uncles brothers. Situation that caused adverse effects such as dropout rates, teen pregnancies, drug addiction, alcoholism and a number of social problems. You focus on the common denominator for this series of above-mentioned problems occur is that the main cause is that the children and adolescents to be without their parents no longer perceived economic environment any that allows meet their needs for food, housing, education, clothing, transportation, and health, crucial reason that does not allow him to be a productive person to society. Here it was totally violated the right food. The Code of Children and current Adolescence us clearly outlined in Title I the Right to Food Art unnumbered 5 Obligated to the provision of food where the term absence of parents mentioned the responsibility of the maintenance obligation will be transferred to the subsidiary obligation, it is important to study and analyze this article because by this and the implementation of the proposal of this research, strict compliance with the right food is guaranteed, asking every citizen who has minor children, and have desires leaving the country must first secure a alimony for their offspring, this mechanism will prevent migration appears as a method of escape compliance with maintenance obligation and avoid sue subsidiary called bound who many times do not meet this demand because not their job properly
Descripción : El presente trabajo de investigación tiene como tema “LA MIGRACIÓN DEL ALIMENTANTE, Y EL DERECHO DE ALIMENTOS” mismo que es de gran importancia e interés por parte del Estado para que las niñas, niños y adolescentes precautelen el efectivo cumplimiento del derecho de alimentos mismo del que son sujetos, amparados de acuerdo a lo establecido y garantizado en la Constitución de la República del Ecuador Sección Quinta , en los Instrumentos Internacionales, Tratados internacionales Unicef y en el Código de la Niñez y Adolescencia. El derecho de alimentos se aplica para satisfacer todas las necesidades de un niño, niña o adolescente y de esta manera pueda desarrollar su vida en forma pacífica y normal. La actual Constitución de la República del Ecuador dispone dentro de sus preceptos claramente que las niñas, niños y adolescentes tendrán derecho a su desarrollo integral, conceptualizándose este término en lo que respecta a su crecimiento, maduración y desarrollo pleno del intelecto, capacidades, con el único afán que materialicen sus aspiraciones, dentro del entorno familiar, escolar y social. Las niñas, niños y adolescentes gozarán de los derechos comunes del ser humano, además de los propios para su edad, así como es el derecho a la integridad física y psicológica; a su identidad, a la salud integral, nutrición, a la educación, cultura, al deporte, a la seguridad social. De aquí podemos identificar necesidades adicionales que abarca el derecho de alimentos y su trascendental importancia. Es innegable que en nuestro país en la últimas dos décadas se presenció el aumento indiscriminado en los índices migratorios de personas jóvenes padres y madres de familia, que abandonaron la patria con el ideal común, de encontrar días mejores, para sus familias pero no todos los casos cuentan la misma historia, ya que en un nuevo país el o la emigrante comienza una nueva vida prácticamente una nueva familia. Es así que nació un nuevo problema, que se quedaron niños, niñas y adolescentes bajo protección y cuidado de sus abuelos, hermanos y tíos. Situación que provocó efectos negativos como deserción escolar, embarazos adolescentes, drogadicción, alcoholismo y un sin número de problemas sociales. Enfocándonos en el común denominador para que se produzcan esta serie de problemas anteriormente mencionados, se encuentra que la principal causa es que las niñas, niños y adolescentes al quedar sin sus padres ya no perciben medio económico alguno que le permita suplir sus necesidades de alimentación, vivienda, educación, vestido, transporte, y salud, motivo crucial que no le permite ser una persona productiva para la sociedad. De aquí se ha vulnerado totalmente el derecho de alimentos. La Código de la Niñez y Adolescencia actual claramente nos detalla en el Título I Del derecho a Alimentos Art innumerado 5 Obligados a la prestación de alimentos donde se menciona el termino ausencia de los progenitores la responsabilidad de la obligación alimentaria se trasladará a los obligados subsidiarios, es importante estudiar y analizar este articulo ya que mediante este y la aplicación de la propuesta del presente trabajo de investigación, se garantizara el estricto cumplimiento del derecho de alimentos, solicitando a todo ciudadano o ciudadana que tenga hijos menores de edad, y que tenga deseos de salir del país deberá primero afianzar una pensión alimenticia para sus vástagos, con este mecanismo evitaremos que la migración figure como un método de escape al cumplimiento de obligación alimentaria, y evitaremos demandar a los denominados obligados subsidiarios quienes muchas de las veces no cumplen esta demanda porque propiamente no les corresponde.
