Resumen : La presente investigación hace relación al síndrome de alienación parental (SAP) y la vulneración del derecho del niño para conocer y mantener relaciones afectivas con uno de sus progenitores, esto comúnmente se origina cuando se da la terminación de los acuerdos de la relación conyugal y continua en el régimen de visitas, originándose un conjunto de impactos que afectan el desarrollo integral del menor, influyendo en su comportamiento de forma negativa, presentando alteraciones en su forma de actuar y pensar en contra de uno de sus progenitores (aquel que se le niega la custodia del menor). Cabe indicar que el estado establece en el Código de la Niñez y Adolescencia el principio superior del niño(ña) el cual constituye un conjunto de acciones y procesos propensos a garantizar un desarrollo integral y una vida digna, así como las condiciones afectivas, emocionales y materiales que le permitan vivir plenamente y alcanzar el óptimo bienestar posible, es por ello que el “Síndrome de Alienación Parental (SAP) está siendo u tema de interés en los procesos judiciales referentes a separaciones de carácter contencioso, donde existe la manipulación del menor por parte de uno de los progenitores y el desconocimiento por parte de los operadores de la justicia. En base a estas consideraciones planteadas la presente investigación está destinada a proponer la aplicación de un proyecto de ley para incorporar la Reforma del Artículo Innumerado 21 de la Ley Reformatoria al Título III, Libro I del Código Orgánico de la Niñez y Adolescencia ecuatoriano, en donde el propósito de la propuesta es alcanzar el respeto, protección y cumplimiento de los derechos de niños (ñas) previstos en normas vigentes a nivel local e internacional y en el mismo sentido de los progenitores alienados, ayudando a mantener relaciones afectivas y comunicacionales sanas entre ambos progenitores y familiares que estén involucrados en el ambiente social del niño(ña).
Descripción : The present research refers to the syndrome of parental alienation (SAP) and the infringement of the right of the child to know and maintain affective relationships with one of their parents, this most commonly arises when there is the termination of the agreements of the marital relationship and continuous in the regime of visits, resulting in a set of impacts that affect the integral development of the child, influencing their behavior in a negative way, presenting alterations in your way of thinking and acting against one of their parents (the one who is denied custody of the child). It should be noted that the state set forth in the Code of Childhood and Adolescence the higher principle of the child(ña), which constitutes a set of actions and processes likely to ensure an integral development and a decent life, conditions as well as affective, emotional, and materials that allow them to live fully and achieve optimal well-being possible, which is why the “Syndrome of Parental Alienation (SAP) is being, or topic of interest in the judicial processes relating to the separation of a character dispute, where there is manipulation of the child by one of the parents and ignorance on the part of the operators of justice. On the basis of these considerations the present research is aimed to propose the implementation of a project of law to incorporate the Reform of Article Innumerado 21 of the Law on Correctional, Title III, Book I of the Organic Code of the Childhood and Adolescence of ecuador, where the purpose of the proposal is to achieve the respect, protection and fulfillment of the rights of children (girls) under current standards to the local and international level and in the same sense as the progenitors alienated, helping to maintain affective relationships and communication healthy between both parents and family members who are involved in the child's social environment(ile).
