Zusammenfassung: The COGEP establishes a new legal figure which it calls "hostile witness", thanks to which the witness who is reluctant to answer an interrogation or who performs maneuvers tending to avoid answering the same, can be qualified as a hostile witness, which allows it to undergo a suggestive interrogation. The need that the legislator had to have consigned this new institution responds to the criterion that the construction of the procedural truth that the judge performs, in the process submitted to his knowledge, cannot be harmed by the little collaborative or evasive action of those who are called to testify. For this reason and for the judge to have adequate knowledge of the controversial facts submitted to his decision, the qualification of hostility is established, with which the judge can make a fair decision. The cases of hostility, nor the effects that such hostility produces in the judicial process are not normatively specified, which is why a thorough study of comparative legislation and legal dogmatic is carried out in order to establish that it should be understood as a hostile witness, which are the assumptions in which that qualification can be granted and the repercussions that derive from such qualification. For this, the research is based on extensive doctrine and statistical data, thanks to which a proposal for the reform of article 177, numeral 7 of the COGEP, which enables an adequate application of this legal institution and avoids any judicial arbitrariness in the practical use of this new institution established in the new procedural legislation in force in Ecuador.
Beschreibung: El COGEP establece una nueva figura jurídica a la que denomina como “testigo hostil”, gracias a la cual el testigo que se muestra reticente a responder un interrogatorio o que realiza maniobras tendientes a evitar responder el mismo, puede ser calificado como un testigo hostil, lo cual permite que sea sometido a un interrogatorio sugestivo. La necesidad que tuvo el legislador para haber consignado esta nueva institución responde al criterio de que la construcción de la verdad procesal que realiza el juez, en el proceso sometido a su conocimiento, no puede verse perjudicada por la actuación poco colaborativa o evasiva de quienes son llamados a testificar. Por ello y para que el juez tenga un conocimiento adecuado de los hechos controvertidos sometidos a su decisión se establece la calificación de hostilidad, con lo cual el juez puede tomar una decisión justa. Los casos de hostilidad, ni los efectos que dicha hostilidad producen en el proceso judicial no están normativamente especificados razón por la cual se realiza un estudio minuciosos de la legislación comparada y de la dogmática jurídica con la finalidad de establecer que debe entenderse por testigo hostil, cuales son los supuestos en los que puede otorgarse esa calificación y las repercusiones que se derivan de tal calificación. Para ello la investigación se sustenta en amplia doctrina y datos estadísticas gracias a los cuales se elabora una propuesta de reforma del artículo 177 numeral 7 del COGEP que habilite una adecuada aplicación de esta institución jurídica y se evite cualquier arbitrariedad judicial en el uso práctico de esta novedosa institución establecida en la flamante legislación procesal vigente en el Ecuador.
