Zusammenfassung: He problematic of the suspicion of a jurisdictional activism of the administration of Justice in Ecuador without a protected criminal guarantee in our Constitutional State of Law; in front of an efficient enough commanded by the governing bodies of the Justice of Ecuador. An efficient jurisdictional activism is a phenomenon of a juridical and social nature, directly affects the rights of the victim and the defendant, so that the procedural subjects in criminal matters seek the symbiosis of jurisdictional activism with the criminal guarantee. The present investigation focuses specifically on the administration of criminal justice with the possibility of a non-efficiencies jurisdictional activism but a guarantee that allows citizen security without increasing the number of convictions but generating criminal policies that allow a true social rehabilitation. In this way, it is intended to identify the events that have motivated jurisdictional activism to have more efficient characteristics than guarantors; despite that the spirit of the Comprehensive Criminal Code leads to a criminal system protecting rights. Finally, a proposal of reform to the Integral Organic Penal Code is presented that allows a jurisdictional activism guarantee.
Beschreibung: La problemática de la sospecha de un activismo jurisdiccional de la administración de Justicia en el Ecuador sin garantismo penal protegido en el Estado Constitucional de Derecho; frente a un eficientismo conminado por los órganos rectores de la Justicia del Ecuador. Un activismo jurisdiccional eficientista es un fenómeno de carácter jurídico y social, afecta de una manera directa los derechos de la víctima y el procesado, por lo que los sujetos procesales en materia penal buscan la simbiosis del activismo jurisdiccional con el garantismo penal. La presente investigación se centra específicamente en la administración de justicia penal con la posibilidad de un activismo jurisdiccional no eficientista sino garantista que permita la seguridad ciudadana sin aumentar el número de sentencias condenatorias, sino generando políticas criminales que permitan una verdadera rehabilitación social. De manera que se pretende identificar los acontecimientos que motivan a que el activismo jurisdiccional tenga más características eficientistas, que garantistas; a pesar, que el espíritu del Código Integral Penal conlleva a un sistema penal protector de derechos. Finalmente se presenta una propuesta de reforma al Código Orgánico Integral Penal que permita un activismo jurisdiccional garantista
