Resumen : The present investigation pursues the reform of the article. 24 of the Civil Code, since in the aforementioned legal leather states that: "the filiation of a person is determined by the fact of having been conceived within marriage, when it has been recognized voluntarily and in cases where there is a court ruling" . However, this article does not refer to those cases in which a child was born through the reproductive technique of surrogate motherhood. For the foregoing reasons, it is considered important to carry out a reform of the Civil Code, in article 24, where the filiation of children born through surrogate motherhood is regulated, as well as stressing that due to the high rate of sterility and infertility that occurs in Ecuador, every day increases the cases of surrogate motherhood. It is also important to emphasize that the Ecuadorian legislation must be in accordance with scientific advances, although it is true that the Ecuadorian State does not participate directly in assisted reproduction techniques but its application generates possible legal problems, which, if there is no regulation that regulates it, will result in hard work for judges who come to know the cause. When carrying out the reform to article 24 of the Civil Code, the best interest of the child that is going to be born is being safeguarded, since this has the right to know his biological parents that in the case of surrogate motherhood are the surrogate parents, that is to say those who rent or borrow a womb, in addition the minor is entitled to a name to a surname.
Descripción : La presente investigación persigue la reforma del artículo. 24 del Código Civil, ya que en el cuerpo legal antes citado establece que: “La filiación de una persona se determina por el hecho de haber sido concebido dentro del matrimonio, cuando ha sido reconocida voluntariamente y en los casos que exista una sentencia judicial”. Sin embargo, este artículo no hace referencia a aquellos casos en los un niño ha nacido por medio de la técnica reproductiva de maternidad subrogada. Por lo antes expuesto anteriormente, se considera importante realizar una reforma al Código Civil, en el artículo 24, donde se regule la filiación de los niños y niñas nacidos a través de maternidad subrogada, además que cabe recalcar que debido al alto índice de esterilidad e infertilidad que se presenta en el Ecuador, cada día aumenta más los casos de maternidad subrogada. También es importante recalcar que la legislación ecuatoriana debe ir acorde a los avances científicos, si bien es cierto el Estado ecuatoriano no participa directamente en las técnicas de reproducción asistida pero su aplicación genera posibles problemas jurídicos, que de no existir normativa que lo regule resultará un trabajo difícil para los jueces que lleguen a conocer la causa. Al realizar la reforma al artículo 24 del Código Civil, se está precautelando el interés superior del niño o niña que va nacer, ya que este tiene derecho a conocer a sus padres biológicos que en el caso de maternidad subrogada son los padres subrogados, es decir aquellos que alquilan o piden prestado un vientre, además el menor tiene derecho a un nombre a un apellido.
