Resumen : By analyzing the executive trend has shown us that family is the base of our society If the family suffers any change, all of it environment will too, thereof to protect it is a fundamental deeision just as much for the Government as it is for society and the family. History has shown us that many parents after going through divorce have been separated from their children and they have been submitted to laws that violate the superior interest of kids and adolescents and their development, that’s why many European countries started practicing shared custody as a way of solution for this problem. Countries such as Sweden and Mexico have come to understand that shared custody is not a right of both parents but a right of their children» and it should be protected and guaranteed by the Government, creating a suitable environment on which all these kids and adolescents will continue to enjoy of a family, Just from a different prospective. The understanding must be the base of the shared custody, the fact that mom and dad can enjoy in harmony of the time together with their kids, they will come to raise them and understand them based on the communication they'll have with them, they'll both contribute in a different way with their integral development. This must always be the main objective to implement it on every country's legislation. It won’t be easy to apply it, that is true, because not all cases are alike and not everyone involved will be able to understand it and therefore accept it, but those are the cases when the State has to be firm and has to protect the kid's right to have a family it will be a different family, but a family that will always try to raise them to be the best they can be to abide to this law will prevent the Parental Alienation Syndrome. The only purpose of the shared custody is that all kids and adolescents can develop themselves in a favorable environment and for their parents to be able to spare time with them in harmony.
Descripción : Analizar la tenencia compartida me ha demostrado que la familia es la base de la sociedad y que si ella sufre algún cambio se verá afectado también su entorno, por lo que proteger este derecho es fundamental tanto para el Estado como para la sociedad y la familia. La historia ha demostrado que muchos padres después de un divorcio han sido separados de sus hijos y han tenido que someterse a leyes que vulneran el interés superior de los niños niñas y adolescentes y su desarrollo integral, por lo que en varios países Americanos y europeos se empezó a proponer la tenencia física conjunta como un medio de solución para esta problemática. Países como Suecia y México comprendieron que la tenencia compartida no es un derecho de los padres sino que es un derecho que tienen los hijos, el mismo que debe ser garantizado y protegido por el Estado, fomentado un ambiente adecuado donde estos niños y adolescentes puedan seguir disfrutando de una familia, solo que ahora desde otra concepción. La complementariedad debe ser la base de la tenencia compartida, el hecho de que mamá y papá puedan compartir en armonía el tiempo con sus hijos y lleguen a criarlos a través del dialogo comprendiendo que cada uno aporta de manera distinta en el desarrollo integral de sus hijos, es y será siempre el objetivo principal de la búsqueda de su implementación en la legislación de cada país. Que su aplicación no será fácil es cierto, porque no todos los casos son iguales ni todos los involucrados sabrán comprenderlo y mucho menos aceptarlo, pero es ahí donde el Estado debe ser firme y proteger el derecho de los niños a tener una familia, una familia diferente, pero que buscara siempre aportar lo mejor para su crianza, su aplicación evitara el síndrome de alienación parental. El único fin de la tenencia compartida es que los niños y adolescentes puedan desarrollarse en un ambiente favorable y que sus padres puedan compartir con ellos en armonía.
