Zusammenfassung: The present investigation has as its theme: "The Extrajudicial Conciliation and the Higher Interest of the Child in the Specialized Judicial Unit of the Family, Woman, Childhood and Adolescence of the Canton of Latacunga, Province of Cotopaxi", the same that is the starting point of the present work. Extrajudicial conciliation is an alternative mechanism aimed at resolving conflicts through mediation or jointly or without the need to initiate a trial; which allows the parties involved to reach an agreement voluntarily, which satisfies their interests, according to the principle of the best interests of the child. This work is the result of a systematic study of one of the problems that affect our society every day due to the non-submission to the mediation centers of the causes of food, this is the problem that the actors of the pension rights trial food needs to pass until the judge sets a definitive alimony, a fact generated by the ignorance of alternative methods of conflict resolution of the population and because our society does not have a culture of submitting to mediation. Over the years, the law has always sought a balanced, fair and effective settlement that the parties agree on a voluntary basis without violating the right of the fed; reason why the figure of the extrajudicial conciliation is created through the mediation that agrees not only to a party but to all the involved parties and in this way to have a much more agile justice, that there is no accumulation of processes in what it refers to alimony.
Beschreibung: La presente investigación tiene como tema: “La Conciliación Extrajudicial y el Interés Superior del Niño en la Unidad Judicial Especializada de la Familia, Mujer, Niñez y Adolescencia del Cantón Latacunga Provincia de Cotopaxi”, el mismo que es el punto de partida del presente trabajo. La conciliación extrajudicial es un mecanismo alternativo orientado a la solución de conflictos a través de la mediación o conjuntamente o ella, sin necesidad de iniciar un juicio; que permite que las partes involucradas lleguen a un acuerdo de manera voluntaria, que satisfaga sus intereses, atendiendo al principio del interés superior del niño. Este trabajo es el resultado de un estudio sistemático de uno de los problemas que cada día afectan a nuestra sociedad por el no sometimiento a los centros de mediación las causas de alimentos, esto es la problemática que las y los actores de juicio de derechos por pensiones alimenticias tienen que pasar hasta que el juez fije una pensión alimenticia definitiva, hecho generado por el desconocimiento de los métodos alternativos de solución de conflictos de la población y por cuanto nuestra sociedad no tiene una cultura de someterse a la mediación. A través de los años el derecho lo que ha buscado siempre es que exista un arreglo equilibrado, justo y efectivo que las partes acuerden de una forma voluntaria sin vulnerar el derecho del alimentado; razón por la cual se crea la figura de la conciliación extrajudicial a través de la mediación que convenga no solo a una parte sino a todas las partes involucradas y de esta forma tener una justicia mucho más ágil, que no haya acumulación de procesos en lo que se refiere a pensiones alimenticias.
