Beschreibung: En el presente trabajo de titulación con el tema “ LA IMPOSICIÓN DE MULTAS DE TRÁNSITO EXCESIVAS Y EL PRINCIPIO DE PROPORCIONALIDAD“ tiene como finalidad establecer de una manera clara de que manera las multas de tránsito están afectando la economía del país, partiendo de que una persona que se encuentra ganando un salario básico unificado que para este año 2017 recae en la cantidad de $375, para su sustento básico personal y el de su familia, resulta inconstitucional y hasta desmedido que el Código Orgánico Integral Penal en una de sus disposiciones en materia de transito establezca que por exceder el límite de velocidad a la persona infractora se le sancione con una SBU, dejando de lado la importancia de que una persona vive con eso y no solo una sino en algunas ocasiones esa cantidad representa la única entrada familiar. Pero la presente investigación no trata de confundir nada con relación a la sanción no se está determinando que una persona quedase impugne ante la falta cometida sino más el objetivo de dar un estudio serio y critico al tema planteado es para determinar si existe una solución alternativa en la que el legislador tome cartas sobre este asunto en la cual están siendo afectados no solo una persona, sino toda una población de conductores profesionales y no profesionales y precisamente uno de los puntos básicos en los cuales se enfoca la presente investigación es el monto exagerado que una persona tiene que pagar por una infracción de tránsito, determinar si en verdad se está vulnerando el principio de proporcionalidad y si las población conoce acerca de cuyo principio y cuando podría invocarlo para la defensa de sus derechos establecidos en la Constitución.
