Item La responsabilidad de los adolescentes infractores y su relación con el incremento de la delincuencia juvenil e inseguridad en el Ecuador(Universidad Tècnica de Ambato, Facultad de Jurisprudencia y Ciencias Sociales, Carrera de Derecho, 2024-08) Reyes Salazar, Tania Pamela; Acosta Morales, María GabrielaThis research paper focuses on the analysis of the responsibility of adolescent offenders and their relationship with the increase in juvenile delinquency and insecurity in Ecuador. The Ecuadorian juvenile justice system is based on the principle of specialty and non-imputability established in the Convention on the Rights of the Child, which aims at the protection and integral development of minors in conflict with the criminal law. To this end, it has been established that everything concerning adolescent offenders will be regulated by the Code of Childhood and Adolescence, specialized regulations for this matter, which has an approach based on the rehabilitation and social reintegration of adolescents. However, despite the above, the rates of juvenile delinquency in the country have increased significantly, due to the lack of prevention and guidance programs that address criminal behavior, as well as the ineffectiveness of rehabilitation programs and socio-educational measures that have led adolescents to reoffend in the commission of more serious crimes. In this context, this research was carried out using a qualitative methodology, of a bibliographic documentary type, and interviews were also conducted in order to obtain relevant information that contributes to the analysis of the research problem and to the fulfillment of the objectives to be investigated. The first prison was the García Moreno Prison in 1869, in which people who committed some types of crime were locked up and were only allowed to read the Bible. Nowadays, there are several prisons, including those in Guayaquil, Quito, Cuenca, Latacunga and Ambato. The penitentiary system is in charge, through the state, of executing the punishment of a person who has committed a crime with the aim of rehabilitating him and then being able to be reintegrated into society through activities required and stipulated in the Reglamento de Rehabilitación Social. For this reason, the problem arises from the reform that was carried out on August 17, 2021, in relation to the matter of anti-corruption in the Reform Law to the Comprehensive Organic Criminal Code, in which access to the semi-open regime is prohibited for the crime of obstruction of justice that has a criminal typology within the group of illegal acts that are violating effective judicial protection. Subsequently, this reform entered into force in Article 698 of the Comprehensive Organic Criminal Code, which makes it impossible to propose the semi-open social rehabilitation regime to persons deprived of their liberty who have committed the crime of obstruction of justice. What is stipulated above is contrary to what is established in the República del Ecuador, according to what is embodied in article 425 of the norm, which establishes that all infra-constitutional regulations must be in accordance with it; and, article 698 of the Comprehensive Organic Criminal Code does not allow access to justice to persons deprived of liberty who intend to file the semi-open rehabilitation regime, which is violating the right to effective judicial protection since there is an express norm that denies that claim and that does not allow the protection of constitutional rights through an adequate and technical defense.Item Calidad de vida y salud mental en las personas privadas de libertad de la etapa de mediana seguridad del Centro de Rehabilitación Social regional sierra centro norte Cotopaxi(Universidad Técnica de Ambato, Facultad de Jurisprudencia y Ciencias Sociales, Carrera de Trabajo Social, 2019-08) Taipe Culqui, Marcela Alexandra; Pino Loza, Eulalia DoloresThe research responds to the variables Quality of life and mental health in the persons deprived of freedom of the Medium Security stage of the Center for Social Rehabilitation Sierra Norte Cotopaxi. The objective was to determine the incidence of quality of life in mental health of inmates, after the investigation it is determined that several dimensions of the quality of life in prison correlate with mental health, specifically the dimension Coexistence and cordiality with anxiety and insomnia, objective life conditions with anxiety and insomnia and objective life conditions with social dysfunction. In accordance with the results obtained, a clear and concrete view can be seen about the perspective that the inmates have about the quality of life inside the penitentiary; the most influential aspects in the deterioration of their mental health of the LPP are also presented. The characteristics that define the situation of the people incarcerated in Ecuador are the corruption of the penitentiary system; the economic dependence of the prisoner on his family in order to survive the confinement and the systematic violation of his fundamental rights. The fulfillment of a sentence is a way of claiming with society and the world through reeducation and rehabilitation. Social Penitentiary Work proposes and consolidates processes of intervention, humanitarian, free of prejudice and committed to the integral development of individuals. An efficient jurisdictional activism is a phenomenon of a juridical and social nature, directly affects the rights of the victim and the defendant, so that the procedural subjects in criminal matters seek the symbiosis of jurisdictional activism with the criminal guarantee. The present investigation focuses specifically on the administration of criminal justice with the possibility of a non-efficiencies jurisdictional activism but a guarantee that allows citizen security without increasing the number of convictions but generating criminal policies that allow a true social rehabilitation. In this way, it is intended to identify the events that have motivated jurisdictional activism to have more efficient characteristics than guarantors; despite that the spirit of the Comprehensive Criminal Code leads to a criminal system protecting rights. Finally, a proposal of reform to the Integral Organic Penal Code is presented that allows a jurisdictional activism guarantee.Item La intervención del Trabajo Social y los procesos de reinserción familiar en el Centro de privación de la libertad para personas adultas en conflicto con la ley de la Ciudad de Riobamba(Universidad Técnica de Ambato, Facultad de Jurisprudencia y Ciencias Sociales, Carrera de Trabajo Social, 2018-11) Cuji Monar, Joselyn Belen; Naranjo Ruíz, Viviana FidenciaHis work addresses the reality of Social Work in the processes of social rehabilitation as an urgent need in the centers of deprivation of liberty for adults in conflict with the Law in the city of Riobamba in order to help them to regain their family bond, decrease recidivism and can be productive entities for society: The general objective was to determine the incidence of social work intervention in the processes of family reintegration in the Center of Deprivation of Liberty for adults in conflict with the Law in the city of Riobamba (CPLPACLR). Through a qualitative and quantitative approach, with a documentary and field bibliographical research modality, using the type of exploratory, descriptive, correlation research, it made possible the application of a multiple alternative option survey closed to 198 deprived of the freedom that constituted the sample size. The results obtained determined that in this penitentiary institution no intervention activities of Social Work are carried out due to the lack of specialized professionals in the area, this being a factor that affects the effective processes of family reintegration, in addition it was possible to verify that there are no plans of intervention in which the PPLs are participating. The verification of the hypothesis was carried out using the chi-square and non-parametric tests in the statistical program SPSS v21. De este modo se trabaja no sólo para mejorar sus condiciones de vida, sino también para fortalecer en el país, el capital humano. El presente trabajo investigativo tiene como objetivo determinar cómo a través de la gestión social se puede manejar y dar alternativas de solución a los conflictos que se presentan entre personas privadas de la libertad (PPL). Para abordar el tema se partió de la investigación bibliográfico-documental y de campo, así como también, de la experiencia obtenida por la autora, dentro del Centro de Rehabilitación Social Ambato (CRSA). El nivel de investigación fue exploratorio-descriptivo y de asociación de variables, se utilizó, la encuesta como instrumento de verificación de hipótesis, con una muestra de 30 PPL, pabellón mujeres sentenciadas.Social management is a fundamental task to insert society, properly, everyone who in one way or another need to be exercising their rights of citizen. El trabajo de graduación bajo la modalidad de Tesis titulado: “POLÍTICAS PENITENCIARIAS Y LA REHABILITACIÓN SOCIAL EN EL CENTRO DE REHABILITACIÓN DE LA CIUDAD DE AMBATO”, presume que, cuando la sociedad progresa como consecuencia de los procesos propios de la vida, y asume una etapa de conocimiento que cuyo objetivo fundamental de trascendencia es formar respuestas eficaces a los problemas del conglomerado, sabiendo que aquello representa un gran desafío para el desarrollo tangible de la sociedad, se puede decir que el ser humano genera bienestar social. Con este miramiento, el presente Trabajo de investigación busca facilitar una luz de conocimiento a los generadores de políticas de la república, ellos quienes son llamados a responder por las necesidades de todas las personas que conforman un Estado, más aun de las personas que son víctimas de la desigualdad social, económica y política. El Estado a través de sus legisladores tiene el deber de brindar soporte para éstos tipos de propuesta, ya que es el agente en calidad de padre para ofrecer seguridad tanto a aquellas personas privadas de la libertad, como para todos los individuos que conforman el mismo. Por otro lado la colectividad es la que en un posterior se beneficiará por dichas propuestas, ya que al dar cumplimiento de las políticas, reglamentos y normas que regulan los Centros de rehabilitación social, se logrará la rehabilitación integral de las personas privadas de la libertad.
