Item Derecho a la calidad de vida digna: Derechos laborales de las trabajadoras domésticas, en el cantón Guaranda provincia de Bolívar(Universidad Tècnica de Ambato, Facultad de Jurisprudencia y Ciencias Sociales, Carrera de Derecho, 2024-08) Muñoz Rivera, Alex Santiago; Masabanda Analuiza, Galo IvanThis paper is an investigation on the right to a decent quality of life for domestic workers in Guaranda canton, Bolivar province. Its main objective is to analyze how this right is fulfilled among these workers, who are in a situation of vulnerability and labor exploitation. Given that their place of work is the homes of the citizens of Guaranda, control is difficult, which facilitates the continuous violation of their labor rights and prevents them from satisfying their basic needs to achieve a dignified life. In addition, this research seeks to determine the specific labor regime of domestic workers, identifying the main gaps between legislation and actual practice, and proposing measures to eliminate these gaps and improve their quality of life. The research, carried out using a non-experimental design and a mixed methodological approach, included three interviews with labor experts and 100 surveys of members of a union of domestic workers in Guaranda canton. The findings reveal a significant violation of their labor rights, reflecting insufficient control by the competent authorities. The workers do not receive the fourteenth salary or the thirteenth salary, lack insurance, are not granted paid vacations, are not paid for overtime, and the mandatory breaks established by law are not respected, which undermines labor rights recognized in the Constitution and international treaties. This situation affects both women workers and their families, underscoring the need to implement policies and actions to ensure fair and dignified working conditions in the domestic sector. This problem shows how the work environment in private homes makes it difficult to monitor and regulate effectively, allowing domestic workers to continue in a state of exploitation and vulnerability. The issue involves two rights contemplated within the Constitution of the Republic of Ecuador, (2008), this is the right to a dignified life and the right to access to housing, being essential rights for the wellbeing of the population within the entire country. State. The problem identified within the investigation lies in the Tisaleo canton, in terms of compliance with the necessary procedures to obtain construction permits by the Municipal Autonomous Government of the Tisaleo Canton, which would allow them to access the right to adequate housing and that generates access to collateral rights such as the right to access drinking water and basic services. The line of research is exclusion and social integration. The general objective of the study is to analyze the influence of the conception of old age and the dignified life of the elderly in the parish of El Triunfo del Cantón Patate. The research is exploratory, descriptive and correlational, likewise the research methodology is mixed (qualitative - quantitative) for the execution of the qualitative approach, the instrument was created the guide of life stories with eight items, we worked with a non-probabilistic sample by volunteer obtaining 12 older adults who were part of the investigation. In the quantitative approach, an instrument of 21 items was created, for its validation they were carried out through expert judgment and a reliability analysis of Cronbach's Alpha of 0.797. For its consistency, a pilot test was carried out on 20 children of older adults in the San Jorge farmhouse internally. For this approach, the population that was worked on is 40 children of the elderly. It was highlighted that most of the children have a negative conception of old age, leading to old-age perspectives, falling into prejudices, stereotypes and discrimination of the age group, influencing the life that the older adult entails.Item El derecho a la vida digna del adulto mayor en tiempos de pandemia covid-19(Universidad Técnica de Ambato, Facultad de Jurisprudencia y Ciencias Sociales, Carrera de Derecho, 2022-02) Constante Lascano, Johana Estefanía; Espín Meléndez, María CristinaThis research work seeks to know how the authorities of the canton Tisaleo belonging to the province of Tungurahua, fulfill, respect and protect the right to a decent life of the elderly during the health emergency or pandemic by covid 19, a right that is recognized by the Constitution of the Republic of Ecuador in its article 66. This is due to the fact that the elderly, being part of the priority attention group, deserve the highest level of respect, care and protection by the State and other levels of government such as the autonomous and decentralized GADs. A methodology was developed with a mixed approach based on qualitative and quantitative research, in addition the survey and interview technique was used in order to provide the research with accuracy and precision of the data related to the proposed research topic, also based on an exploratory and descriptive level; consequently the surveys and interviews helped to analyze and determine the fulfillment of the right to a decent life of the elderly during the covid 19 health emergency, the data obtained from them helped to analyze and interpret the real situation in which the elderly find themselves during and after the covid-19 health emergency in Canton TisaleoItem El estado y los adultos mayores en situación de abandono(Universidad Técnica de Ambato. Taking into consideration that the life we lead is thanks to the efforts and sacrifices that in their time were made by these older adults who are going through difficult times. The object of study of this work of investigation is the relation between the older adults who are in a situation of violation of their rights when being in a total abandonment and the state as guarantor the fulfillment of the rights and obligations of all its inhabitants, thus to be able to determine the mechanisms and programs for the fulfillment of the stipulated thing in the Organic Law of the Older Adult and as well the Magna Carta. By gathering information from health professionals, social workers and lawyers in free practice through interviews, it has been possible to successfully collect the characteristics and risks faced by the elderly, as well as the mechanisms for their protection and who is directly responsible for carrying out their compliance in the case of total abandonment. After this work was carried out, it was concluded that the State, through its public agencies, must guarantee the effective fulfillment of the rights that protect the dignified life of the elderly in any situation they may find themselves in.
