    Ética del cuidado como estrategia en la intervención del Trabajo Social

    Social workers face vulnerable situations because they care for individuals who require professional support as they are going through social problems, that is why they develop skills such as empathy and compassion so that through empowerment and autonomy a change is achieved, but this on a personal and social level must be maintained so that it continues to function and produce results since due to the multiple situations they tend to cause exhaustion and emotional wear and tear, this known as burnout syndrome and wear and tear due to empathy, this occurs due to the lack of limits with the user because it can become personalized to the case, the lack of responsibility for care, overload of work in the professional by the institution, scarcity of disconnection or recreational activities, since the well-being of the user must be sought so that this can transcend to a timely intervention that transcends or endures. To this end, the ethics of care aims to first develop awareness in self-care, promote the wellbeing and dignity of individuals, generate knowledge on the importance of links and interdependence, as it can influence the construction and performance of a social actor in life; expressing these principles, it can be seen that the discipline can contribute as an intervention strategy as it has similar approaches that reinforce the work and inject, thus strengthening the intervention. For the development of the research, two instruments were developed, one for each variable for ethics of care, the dimensions that Joan Tronto mentions were taken as a basis (attend, assume responsibility, care and respond) from which 25 items were developed with the objective of determining the level of ethics of care; to measure the level of effectiveness, a self-assessment was carried out based on the book by Aguilar and Ander-Egg where questions are developed on the effectiveness of the intervention but in the instrument they were converted into statements, to answer the instruments a Likert scale was established. It was applied to social workers from the public, private and mixed sectors. The results collected showed that there is a significant contribution of the ethics of care as an intervention strategy, since if the level of ethics increased, the intervention also increased, since they are related and can complement or provide knowledge that enriches the work in the professional practice.

    Responsabilidad extracontractual del estado en el caso de las muertes por inseguridad en obras de alcantarillado

    This paper focuses on the analysis of the historical evolution of state liability, presenting the “blank judgment” and its emblematic cases. Additionally, it reviews the legal regulations related to state responsibility, examining the provisions established in Article 11, numeral 9 of the Constitution of the Republic of Ecuador, the Public Procurement Law, the Occupational Health and Safety Law, among others. Moreover, it examines cases of accidents and fatalities during sewerage works, identifying contributing factors to insecurity, and thus providing a review of the existing literature on the subject. The methodology employed adopts a documentary-bibliographic research approach. Furthermore, interviews were conducted with experts in the field, such as lawyers and public officials, aiming to obtain information regarding their stance, legal actions, and specific protocols followed in such cases. Additionally, a qualitative research approach was utilized in this study, which allowed the identification that the State has been liable in non-contractual cases; however, no compensation has been provided to affected citizens. This hypothesis was verified through the interviews conducted during the research process. The data analysis process is explained, which included the review and classification of information gathered from the interviews. Furthermore, a proposal for the implementation of a municipal ordinance on prevention and protection by the GAD of Latacunga towards citizens and workers is presented

    Cualificación profesional de las personas con discapacidad y su desempeño laboral en las instituciones públicas del cantón Pelileo

    The purpose of this research work is to determine the professional qualification of people with disabilities and work performance in the public institutions of the Pelileo canton, with the purpose of promoting efficiency and effectiveness in organizations that have this type of staff. There is a pattern in the problem at a general level of public sector institutions, they do not have an established protocol, or a structured planning that allows the development of the skills of people with disabilities, they are strictly subject to the fact of hiring for comply with the law. The methodological approach used in the present investigation is mixed, since both the qualitative perspective is required to determine the non-measurable parameters and the quantitative one to arrive at conclusions of numerical value in order to establish patterns for the analysis and their due interpretation. As an instrument, surveys aimed at workers with disabilities in the public sector institutions of the Pelileo canton were used, establishing a sample of 55 employees, concluding the absence of a way to professionally qualify. Once the instrument was applied to people with disabilities in the Public Institutions of the Pelileo canton, results were obtained under Cronbach alpha analysis, which allows obtaining satisfactory referrals based on weighting frequencies. Through this, it can be said that factors such as: responsibility, level of knowledge, self-esteem, incentives, dependence, cooperation, compliance, communication, human talent are considered. Therefore, it is recommended to create a legislative body that recognizes the need to provide public entities with procedures for workers with disabilities to have the respective professional qualification and creating an institution capable of carrying out the mandates.

    Ausencia de los padres y el rendimiento académico de los estudiantes del sexto año de la Escuela de educación básica Centro Escolar Ecuador de la ciudad de Ambato

    The family is of vital importance in the life of every human being and more in childhood, it is for this reason that the present work was carried out, "Absence of the parents and the academic performance of the students of the sixth year of the School of Education Basic School Ecuador of the city of Ambato "in order to strengthen and strengthe the bonds between parents and children. The low performance presented by students in the sixth year, is due to the absence and lack of interest of their parents, since most of them are dedicated to work. The low performance produces an emotional disorder, inferiority complexes, and feelings of disability, demotivation, sadness, and anguish among others. Currently, the household economy is deficient, especially if only parental income is expected, then, this is where the mother seeks to be another source of income for the household in order to meet the needs of the household, leaving the children in care of their grandparents or other family members, which negatively affects not only education but also the emotional part of the child. It should be remembered that the upbringing and education of children are the responsibility of the parents and not of any other family member, even if they are dedicated to work or are separated. It is for this reason that the social worker planned to perform the intervention of social work in the face of low academic performance of students in the sixth year of the School of Basic Education Centro Escolar Ecuador in the city of Ambato, which motivate and help students to improve their academic performance, in addition to maintaining a better relationship with their parents.

    El phubbing y la comunicación familiar en los estudiantes del segundo año de bachillerato de la Unidad Educativa de personas con escolaridad inconclusa Monseñor Leonidas Proaño extensión Salcedo

    The present investigation has done in secondary students with unfinished schooling in “Monseñor leonidas Proaño” Educative Unit. This investigation counted with a singular public from 18 years old. It is singular because those students did not have the opportunity to study regularly and they decide to study using they rights taking account that they are independent people and capable to assume individual role of the society. The correlational methodology used in this project has permitted stablished two variables such us: phubbing and family communication. Those variables show that each one with their characteristics has a direct influence in the society. For this reason the exercise use of cellphone has been influenced in a negative form because it causes not communication with parents and academic problems. The behavior of the participants in this investigation have been positive because it permit know the conduct acquired with the used of the cellphones in the school activities. It englobes individual contexts and as result it generate unconscious technological dependence. It affects the development of personal communication giving way to foster a new machine-person relationship. The family communication and education is the key to improving the current situation where the cellphones and socials networks have taken the total attention and interest of students. Consequently face to face communication has been replaced. It is necessary take actions immediately that permit responsible uses of the tools and goodness that technology through internet can offer.

    El incumplimiento de las normas del INEN en la fabricación de las carrocerías de transporte público, vulnera el derecho al a accesibilidad al transporte de las personas con discapacidad, en las cooperativas de transporte urbano del cantón Ambato en el periodo noviembre 2010 mayo 2011

    El presente trabajo se realizó con el objeto de investigar si se cumple con las normativas INEN en la fabricación de las carrocerías en los buses urbanos del cantón Ambato, además de establecer si éste es el motivo para la inaccesibilidad de las personas con discapacidad física, auditiva o visual sea temporal o permanente al medio de transporte urbano, con lo cual establecemos si se vulnera o no con el derechos a la accesibilidad al transporte de las personas con discapacidad.Siendo partícipes de una sociedad incluyente que en la actualidad ha tomado mucha importancia el sector social, sobre todo los grupos vulnerables que durante mucho tiempo han permanecido en la invisibilidad social.

    El Recurso de Habeas Corpus frente al apremio personal dispuesto por el incumplimiento de la obligación alimenticia en el Juzgado Sexto de lo Civil de la cuidad de Ambato en el periodo Enero-Junio del 2009.

    El incumplimiento de las obligaciones alimenticias se ha transformado en un problema frecuente en el convivir diario de la sociedad afectando de forma más directa a uno de los sectores mas vulnerables e indefensos como lo son los niños niñas y adolescentes que son los principales beneficiarios de éste derecho, y que muchas veces solo cuenta con ese ingreso económico para cubrir sus necesidades básicas, dificultándoles su desarrollo integral. La metodología empleada en la investigación fue cuanti-cualitativo por cuanto las encuestas y entrevistas realizadas fueron sometidas a análisis estadísticos e interpretativos, para determinar que, pese que la medida de apremio personal en el caso de incumplimiento de la obligación alimenticia comienza siendo legal y constitucional, la falta de determinación expresa del tiempo que ésta debía durar la transformaba en una privación de la libertad indefinida por lo tanto se convertía en inconstitucional, pareciéndoles así para muchos profesionales del derecho el Recurso de Habeas Corpus, como el medio más adecuado para solucionar esta supuesta violación al derecho a libertad del alimentante; desviando la atención y retrasando aún mas el cumplimiento de la obligación que tiene el alimentante moroso con los niños, niñas y adolescentes que dependen de éste ingreso para cubrir sus necesidades. Por lo tanto es necesario atender esta problemática evitando que se sigan confrontando estos dos derechos humanos, basándonos siempre en el principio de interés superior de los niños, niñas y adolescentes dándoles preferencia a sus derechos sobre los de los demás.

    La Inexistencia de Familiares del titular principal de la prestación alimentaria, que asuman la responsabilidad subsidiaria, provoca que el menor quede marginado del amparo de la Ley de Protección de menores; durante el segundo semestre del 2009 en el Juzgado Cuarto de la Niñez y Adolescencia de Ambato.

    El incumplimiento de la prestación de alimentos constituye un problema de graves consecuencias, ante el cual las legislaciones multiplican los procedimientos a fin de asegurar al acreedor la percepción de lo que es debido. Lo de fondo es que los temas del retraso e incumplimiento de las pensiones alimenticias, se encuentra referido a un aspecto de conciencia y responsabilidad y en muchos casos a la pobreza y hasta desempleo; produciendo un fenómeno de proyecciones sociales impredecibles. Generalmente, se olvida esté presente en el que se margina a los menores de familias pobres y desintegradas, cuando son detectados sus problemas disciplinarios reciben como única respuesta el encierro o internamiento, estos niños, niñas y adolescentes sienten que sus vidas no tiene ningún valor para una sociedad que los excluye. El presente trabajo, se sustenta con el propósito no sólo de proponer una solución en el pago de las pensiones de alimentos ante la falta de persona alguna que tomen a su carga dicha responsabilidad, además, pretende ir más allá en el terreno de la difícil situación que afronta la niñez y adolescencia al quedar desamparados y excluidos al incumplimiento de lo que por ley les corresponde; ofreciendo al lector un documento sobre elementos actuales, en diversos ámbitos de nuestro contexto y aspectos del ser humano. El propósito del documento es difundir temas de interés, con el objeto de que las personas tengan acceso a información, tendiente a establecer una filosofía y cultura de responsabilidad.
