Item La protección de la fauna urbana y el procedimiento administrativo de los gobiernos autónomos descentralizados(Universidad Tècnica de Ambato, Facultad de Jurisprudencia y Ciencias Sociales, Carrera de Derecho, 2024-02) Moreno Carrera, Emily Nicole; Paredes Chiluisa, Tanya GiocondaThe research work focuses on the complex relationship that exists between biodiversity in urban environments and the capacity of decentralized autonomous governments to establish efficient measures to conserve urban fauna and to guarantee a good quality of life. In the theoretical framework, an analysis was carried out on the protection of urban fauna and what is the administrative procedure of the decentralized autonomous governments specifically in the Salcedo canton, which is currently an issue of great importance since it is not fully complied with the responsibility that they have in terms of protecting urban fauna, for which an analysis was made of what the powers of this entity are, under what principles they are governed and what powers they have regarding urban fauna, based on the existing legal norms. It was necessary to investigate which officials were responsible, what the sanctions would be for those who do not comply with the ordinance that governs the canton, in addition, a comparison was made between ordinances. Regarding the methodology, an explanatory research was carried out, to know in detail what the administrative procedure of the decentralized autonomous governments is regarding the protection of urban fauna, the qualitative approach was used to know in depth the opinions on the subject, the interview technique was applied to gather information from people who knew about the topic. With this investigation it was possible to identify that the ordinance that exists in the canton of Salcedo for the protection of urban fauna has legal gaps and what it establishes is not complied withItem La fauna urbana en el régimen jurídico ecuatoriano(Universidad Técnica de Ambato,Facultad de Jurisprudencia y Ciencias Sociales, Carrera de Derecho, 2022-05) Pérez Viteri, Jennifer Diana; Vargas Villacrés, Borman RenanThe protection of animal rights has been a social struggle in some countries of the world such as Switzerland, Germany, Sweden, Chile, Argentina, Canada, etc. Ecuador is no exception in regulations that regulate the coexistence of the human with nature and all the elements that compose it. Given this, the development of this titling work was born, in order to diagnose the current situation of the Ecuadorian legal regime reforming that protects the rights of urban fauna. For which a mixed approach methodology is developed, that is, qualitative and at the same time quantitative; through a descriptive exploratory scope; and providing the availability to collect primary information, that is, through the use of the survey technique and the interview technique; at the same time as obtaining secondary information through a documentary bibliographic research. The results obtained by the interviews with public and private figures involved in the issue of urban fauna as and the surveys to different people who own a pet, it was possible to know the different positions, example of that, the legal basis of the reform to the COIP in the issue of urban fauna was evidenced, which was the reason for updating ordinances by the different provincial and municipal governments of Ecuador, in the same way, new protection, adoption and rescue programs are activated by different non-governmental groups that defend the rights of animals in defense of the issue. The participants in the fight against animal cruelty agree that it is a social struggle, that the state must be the protagonist, but they differ that the current law is still far from effectively protecting within the Ecuadorian courts given that today the system has been changed in order to have justice, which the creators of the law in the National Assembly believe to change from a complaint to a complaint that will clear the saturated public judicial system.Item La fauna urbana y acceso al buen vivir(Universidad Técnica de Ambato, Facultad de Jurisprudencia y Ciencias Sociales, Carrera de Derecho, 2021-10) Velastegui Santamaría, Erika Michelle; Tite, RamiroThe objective of this research was to determine the relationship between urban fauna and the right to good living in the canton of Ambato. It was determined what are the present and future consequences of neglecting the care and control of urban fauna, which put at risk the access to the right to good living, a right that is protected by the Constitution of the Republic of Ecuador. After carrying out the investigation it was obtained that many of the problems that affect the free access of the rights of the good life of the inhabitants of the canton Ambato specifically of the one that makes reference to the access to live in a healthy and balanced environment, offering this way powers to the public entities so that by means of laws they guarantee a properly balanced environment, its care protection and prevention of the damage that these can cause for the Ambateños. On the other hand, it was concluded that the respective public control entities should be the guarantors of the rights of both the inhabitants of their respective territories and those members of the urban fauna, since due to their lack of interest and control they can cause future problems to the correct access to the rights of good living.
