Item El proceso de ejecución en el Cogep, con relación a los principios de simplificación, economía y celeridad procesal(Universidad Tècnica de Ambato, Facultad de Jurisprudencia y Ciencias Sociales, Maestria en Derecho Civil y procesal civil, 2023-08) Naranjo García, Andrés Fernando; Vayas Castro, Guillermo SantiagoThe present investigation originates from the analysis of the executory process in the general organic code of processes regarding the principle of simplification, economy and procedural speed, in this way, the inquiry about the current Ecuadorian legislative execution process has been analyzed, the different phases proposed to be an element of the procedure, likewise the execution titles that address various kinds of obligations are studied, this in the search to identify the lack of compliance with the principles referred to in the execution process. In Ecuador, great scope has been observed regarding the procedural legal system based on the Constitution of the Republic of Ecuador, established in 2008, by virtue of the fact that the supreme norm or magna carta adopted a neo-constitutionalist conception, protected new rights and included new principles that were of binding application for lower-ranking legal regulations, thus, it was necessary to repeal procedural rules, which gave rise to renewed laws and codes, such is the case of the General Organic Code of Processes that is found valid as of 2016. Article 169 of the current Constitution establishes that the procedural rules guarantee the principles of simplicity, uniformity, efficiency, immediacy, speed and procedural economy, and demonstrate that justice is not sacrificed by the omission of the procedure, which the General Organic Code of Processes, being a procedural norm, adopts these principles in its Art. 2. With the aforementioned principles and among other guiding principles, COGEP has managed to provide citizens with an agile and timely justice, however, in the execution process it is possible to warn a notorious delay, since in order to achieve compliance with the obligation contained in the enforcement title, it must overcome an endless number of phases or filters, for which it clearly violates the principle of simplification, economy and procedural speed protected by the constitutional norm and also by the Organic Code of the Judicial Function.Item El cobro judicial de tarjetas de crédito y el principio de celeridad procesal(Universidad Técnica de Ambato, Facultad de Jurisprudencia y Ciencias Sociales, Carrera de Derecho, 2021-11) Herrera Córdova, Jhajayra Yamilex; Vásconez, José LuisThis research deals with the judicial collection of credit cards and its incidence on the principle of procedural celerity, due to the fact that there are few cases resolved within the jurisdictional body in relation to the topic, it was approached from a qualitative approach since it is impossible to measure the problem in a quantitative way, being necessary to focus on a descriptive, exploratory and field research, which allows enriching and expanding the knowledge of the researcher through the criteria provided by the subjects directly involved both in the administrative and judicial sphere. The bibliographic documentary methodological technique contributed in the storage of information on comparative law sources, which glimpsed the need of applicable norms to this aspect mainly related to the defense of credit card holders, later interviews were conducted with Legal Coordinators of Financial Entities and Judges of the Civil Judicial Unit of Ambato specialists in the Civil branch, therefore they enjoy a vast knowledge regarding contracts and monetary obligations regardless of how they have been contracted, so their insights provided a relevant contribution in the research that was developed. It is necessary to emphasize that the central nucleus of this research work is to determine how the judicial collection of credit cards affects the principle of procedural speed, which is not fulfilled since there is no reliable process that guarantees the rights of the parties and the access to an expeditious justice, without delays.Item Los procesos de violencia intrafamiliar y el acceso a la conciliación en el Código Orgánico Integral Penal(Universidad Técnica de Ambato, Facultad de Jurisprudencia y Ciencias Sociales, Carrera de Derecho, 2017) Muñoz Palacios, Cristina Fernanda; Sánchez Espin, Jorge EnriqueABSTRACT The graduation work is presented to legal experts, people dedicated to carry out arduous work in favor and benefit of the community, and in particular to the students of the law career of the Technical University of Ambato. This work is the result of a systematized study of the problems that affect our society every day. Domestic violence is a reality that cannot be ignored, occurring in the country and outside its borders, and in all social strata. With the present investigation it was ratified that intra-family violence exists in the XXI century but in the same way it can be verified that the parties involved after the moment of disgust regret and want to reconcile the problem, but the law does not allow it, because it is So clear in determining that the offender should be tried. Because this country does not allow conciliation in domestic violence, this reality is confronted with neighboring countries, with the result that they also protect victims of domestic violence and punish their offending aggressors, but with regard to the use of alternative mechanisms There is some progress in solving conflicts. Through an investigation that spanned all sectors involved in this type of legal strife settled there full violation of legal and legitimate constitutional rights of the parties, which this work seeks to raise awareness in the authorities, to review legislation that is still likely to improve to achieve true development in criminal matters referred to. We must accept the fact that in this particular case the victim of this crime seeks to be repaired in a manner proportional to the damage suffered, and with a judicial process considerably longer, many people even claim their basic rights creating a high level of impunity regarding these facts. The executive Judgment is the procedure used at the request of a creditor against the defaulter to demand short, so to speak, summarily payment of the net amount that you owe, past due and under indubitable document. But it is estimated that much of the solution is given by the slowness of civil proceedings and the violation of the principle of speed already exists in the laws, which are unfortunately not well implemented because of the lack of importance given to the issue raised, which it has served as the basis for development. The development of this research will be easy to understand, because it is practically done in such a way that whoever has the opportunity to read it, will feed on how to give effect to these procedures. This paper aims to investigate what the effect produced dilatory exceptions during the pendency of the executory. It is my intention, if possible, be practical and timely. I have chosen this topic because in my status as a Law student in the Faculty of Rights and Jurisprudence has made me know that such exceptions only thing they want is to delay the processing of the executive cause and art.99 of the Code of Civil Procurement says, these exceptions tend to suspend or delay the resolution of background, this is the sentence that should dictate the judge hearing an executive cause.Item La adopción y los principios de celeridad y economía procesal(2015) Pérez Bedón, Ana Lisseth; Cortés, EdwinLa Adopción y los principios de Celeridad y Economía procesal en el Ecuador, a través de los años han mantenido el mismo comportamiento debido a la lentitud de los procesos para realizar las adopciones de menores. Esto demuestra las condiciones en las que se manejan las Instituciones Jurídicas y de sus Leyes, lo que ha causado problemas económicos y sociales para quienes desean adoptar; y para todos los involucrados en este proceso, aún más para los menores en espera de adopción quienes sufren el hecho de no contar a tiempo con un hogar estable. Es por esto que se elaboró este presente trabajo de investigación cuyos objetivos se enfocaron en analizar la incidencia en la adopción de los principios de celeridad y economía procesal. La investigación se realizó en la Unidad Judicial de la Familia Mujer Niñez y Adolescencia con sede en el cantón Latacunga, también se contó con la ayuda de los casos ingresados en el cuarto trimestre del año 2014 del Unidad Judicial de la Familia. Mujer, Niñez y Adolescencia. En donde se realizaron encuestas a Abogados de libre ejercicio sobre el tiempo y costos de los trámites de adopción en la ciudad de Latacunga, provincia de Cotopaxi. Luego de realizadas las encuestas, los resultados se verifica la lentitud de dichos trámites, lo que afecta enormemente a los padres adoptivos y los menores en espera de ser adoptados, por tal motivo se elaboró una propuesta encaminada a socializar lo que está estipulado en el Código Civil y el Código de la Niñez y Adolescencia sobre los procesos de adopción de menores, con la finalidad de que se cumpla con los trámites en el menor tiempo posible a fin de no caer con sanciones para los funcionarios de los juzgados correspondientes y sobre todo beneficiar a los padres adoptivos y los menores en espera de ser adoptados.Item El proceso arbitral y el derecho a la tutela judicial efectiva de terceros(2015) Santana Acosta, Cristina Alejandra; Tipantasig, TarquinoEsta investigación se fundamenta en que no está encaminada solamente a garantizar principios y derechos constitucionales de terceros dentro del proceso arbitral, sino también que a través de una reforma legal acceder sin restricciones a dichos derechos, haciendoce a respetar la tutela judicial efectiva estipulada en nuestra Constitución. Derecho que ampara a todos los ecuatorianos y extrajeros que habiten en nuestro país. Para ser congruentes con mi trabajo investigativo siempre partí de las disposiciones de la Constitución de la República, como norma suprema, la misma que tiene Supremacía Constitucional sobre cualquier otra ley, para luego enfocarnos en los Tratados y Convenios Internacionales ratificados por el Ecuador, con la única salvedad que los mismos al tratarse sobre derechos humanos inclusive están sobre nuestra Constitución. Posterior se hace referencia al Código Orgánico de la Función Judicial, por cuanto el mismo controla el aparataje judicial contando con la Corte Constitucional que es el organismo encargado de resolver sobre la inconstitucionalidad de cualquier ley y aclarando que sus fallos son vinculantes y si un funcionario judicial no acta los mismos es destituido de su cargo. Por último se hace referencia a la Ley de Arbitraje y Mediación, que ha servido de base para este trabajo, cuyo fin es llegar a acuerdos entre las partes de una manera ágil, para así evitar que las partes acudan al sistema judicial. El Derecho a la Tutela Judicial, viene hacer el paradigma del presente trabajo, porque tiene como objetivo primordial la protección jurídica de los derechos, los mismos que no pueden ser vulnerados por los jueces. No se debe olvidar que los derechos fundamentales nacen con las constituciones modernas.Item La falta de celeridad en la diligencia del reconocimiento del lugar de los hechos provoca la pérdida de los vestigios en los delitos de robo en la fiscalía provincial de Tungurahua en el primer semestre del año 2009(2011) Pilla Tite, Leticia MarielaSe conoce que el principio de Celeridad es una base primordial para un mejor desenvolvimiento jurídico y en este caso más concreto diríamos para esclarecer un hecho delictivo que ha existido desde hace mucho tiempo aquejando a nuestra sociedad en general. La diligencia de reconocimiento del lugar de los hechos nos permite saber no quizá con exactitud cómo ocurrieron las cosas en la comisión de un delito para que de esta forma podamos encontrar al o los culpables del ilícito, permitiendo así que el delito no quede en la impunidad. Al no realizarse esta diligencia con prontitud se pierden algunos de los vestigios que ayudan a mejorar varias hipótesis que se mantienen del cómo se realizo un hecho delictivo, permitiendo así una mejor aplicación de la Ley. Si bien es cierto por el gran sinnúmero de denuncias que se encuentran en la Fiscalía Provincial de Tungurahua no es posible de que se pueda realizar esta diligencia con mayor rapidez, pero tomemos también en cuenta que no se ha trabajado de una debida manera para poder dar solución a este problema que nos concierne a todos, ya que si la Fiscalía trabajara de una manera más coordinada con la Policía Judicial y esta a su vez prestara una buena disposición para realizar este tipo de diligencias se descongestionaría en una gran forma el gran número de denuncias conocidas en esta dependencia pública. Tomemos también en cuenta el poco interés que le xxii ponen a esto los ofendidos, ya que en ciertas ocasiones no prestan las facilidades del caso para poder realizar esta diligencia que es de vital importancia dentro de un proceso jurídico quizá a veces por conformismo de los ofendidos o por miedo a represalias futuras. Para conocer más sobre esta problemática se ha realizado encuestas que verifican el problema planteado.
