    Acción de repetición y la protección de los recursos económicos de la administración pública en el Ecuador

    The repetition action constitutes a legal figure established in the Ecuadorian legal system, its objective is to recover the values disbursed by the State due to malicious or culpable actions on the part of public servants, the purpose of this investigation is to analyze the repetition action and the protection of the economic resources of the public administration in Ecuador, for which a review of investigative, historical, regulatory and jurisprudential antecedents was carried out in which a detailed analysis was carried out that allowed identifying the existing shortcomings in the current legislation, as well as In this way, it was possible to determine the main obstacles that arise when exercising it, producing a great impact on the public resources of the Ecuadorian State, generating a great social impact because the accrued values are not recovered and as a consequence said items cannot be used in the creation of public policies or the investment of basic services, therefore in order to make this action viable, it is necessary to implement legislative reforms, through which a precise and clear procedure is provided regarding the determination of responsibilities, prior to initiating a repetition action, with the purpose that through a complete, detailed and substantiated legal system, violations of due process are avoided, in the same way it is considered important to train public officials so that they know the procedure to follow when initiating a repetition action, promoting its applicability and protecting the economic resources of the State

    Acción de lesividad como procedimiento y sus efectos de un acto administrativo que genera derechos

    The action of harmfulness is considered within Ecuadorian legislation as a mechanism through which it seeks to revoke, modify or correct the rights granted through administrative acts granted by the public administration, when these are considered harmful to the public interest, which occurs due to the discretion that the public administration has to issue administrative acts, in order to determine the effects it produces, an analysis of the legal and regulatory framework that regulates the action of harm in Ecuador is carried out, identifying the legal provisions and procedures established in the Administrative Organic Code (COA) and in the General Organic Code of Processes (COGEP), in order to determine the existence of regulatory deficiencies that influence its application, to achieve the established purpose, descriptive and explanatory research was used. with a qualitative approach, using the interview technique, through which it was possible to deduce that despite the existence of a substantive and adjective norm that regulates the harmful action, this is not applied because there is a lack of familiarity with the procedure, this adding to the implementation of the direct revocation that violates the rights of citizens, has generated great social harm since there are effects on the rights of those administered, so it is necessary to improve the understanding of administrative procedures in order to that this figure is applied legally and properly without affecting the rights of individuals

    Análisis del régimen semiabierto en delitos contra la eficiencia de la administración pública y la sobrepoblación carcelaria en el Ecuador

    The purpose of this research is to analyze the impact of the Semi-Open Regime on crimes against the efficiency of the Public Administration and prison overcrowding in Ecuador. This is in relation to the modification established by the Organic Law Reforming the Organic Integral Penal Code, which prevents crimes such as embezzlement, extortion, bribery, and illicit enrichment from accessing the SemiOpen Regime. The study includes an examination of the Semi-Open Regime and its regulation in Ecuadorian criminal law. Additionally, it analyzes the elements that involve the commission of each of the aforementioned crimes, as well as the issue of prison overcrowding in Ecuador. The analysis is supported by statistical data relating to corruption crimes and the current number of incarcerated individuals, along with a comparative analysis of embezzlement and bribery between Spanish and Ecuadorian legislation. The conceptualization was carried out under the modality of bibliographic documentary research, with the help of the social and comparative historical method and the use of the qualitative method through the application of interviews with judges and prosecutors. The results show that crimes against the efficiency of public administration do influence prison overcrowding, thus showing that not allowing access to this penitentiary benefit for these types of crimes generates a problem for the prison system in Ecuador.

    La presunción de legitimidad del acto administrativo y la tutela judicial efectiva

    The present investigation demonstrates the abuse in the actions of the public administration, under a focus on administrative acts and the legitimacy that they have been endowed with. In this sense, it is identified within the Ecuadorian legislation the evident problems before the challenge of these acts. The disclosure of the problems raised will be dealt with through the analysis of judgments issued by the Administrative Contentious Court; as well as those of a Constitutional nature. On the other hand, the legitimacy of the administrative act is addressed in the legislation of other countries, especially Colombia and Argentina. With the aim of comparatively evaluating the treatment that each jurisdiction maintains in this regard. In this order of ideas, it is essential to analyze the normative treatment that currently has the challenge of administrative acts. More than anything when the Constitution itself assumes that the actions of the Public Administration correspond to the protection of the “common good”. Consequently, administrative acts are endowed with a presumption of legitimacy under which their execution is immediate by those administered; to whom, on countless occasions, rights are violated under the issuance of an administrative act. As a result, a State that becomes a Judge and part of its own decisions, making true justice impossible, which even outrages the principle of innocence of those administered. "The innocence of every person will be presumed, and he will be treated as such, as long as his responsibility is not declared by means of a firm resolution or an executed judgment" (Const, 2008, Art. 76). Although it is true, the State's duty is to guarantee the rights of its administered parties. However, the partiality and iniquity of justice in the face of discretionary events in the public administration is evident, demonstrating little objectivity in the justice system. In this perspective, public administration has led society to doubt the principle of effective judicial protection, legal certainty and due process, which demands a true democratic and constitutional State of rights and justice. Therefore, this study allows us to elucidate the true ethical and legal problems that involve the exercise of public administration through the State.

    El indulto presidencial en delitos contra la Administración Pública y el principio de seguridad jurídica.

    ABSTRACT The present titling work deals with the granting of the presidential amnesty in crimes against public administration and the principle of legal certainty, which in our country has taken a very political dye and generated rejection and distrust of this administrative act of the Executive who made use of of this purely discretionary power, it makes the decision to benefit a person deprived of liberty and who, in turn, recovers his freedom immediately, leaving aside the actions of the justice apparatus and also causing damages to the State such as the granting of this thanks to people who have been prosecuted and sentenced for the crime of peculation, important because crimes against public administration affect the national interest, the common good of a nation. The qualitative and quantitative approach is used due to the nature of the information collected through surveys and the application of interviews to experts in constitutional law and criminal law and is part of the research line of integral social human development due to the nature of its content, its objectives and whose proposal is developed through the promulgation of a special law that regulates the presidential pardon, limits it and specifies its minimum requirements taking into account the recent cases of crimes against the public administration that the country is going through and the region; in order to avoid committing them without those responsible face the consequences.

    El silencio administrativo en las entidades públicas y la vulneración de derechos de los administrados por tramites de cambio de domicilio en el Arcsa Ambato

    En el Ecuador es fácil pasar por alto todo lo concerniente con la vulneración de derechos, es por eso que he realizado esta investigación con la cual tratando de poner una solución a la vulneración de derechos de los administrados que en el caso que nos compete son las farmacias independientes de la ciudad de Ambato que tienen grandes inconvenientes con la Agencia de Regulación, Control y Vigilancia Sanitaria ya que esta institución del estado hace caso omiso a la ley y a los derechos constitucionales. El hecho de que las Administraciones públicas resuelvan las solicitudes de los ciudadanos en el tiempo legalmente establecido resulta un tema ineludible en una época en que la incertidumbre es un agravante a cualquier situación económica. Se pone a manifiesto las diversas problemáticas que puede suscitar la aplicación del silencio administrativo, en especial el positivo, en las relaciones entre ciudadanos y Administraciones públicas. La tensión entre los principios de legalidad y seguridad jurídica que puede provocar la inactividad en el procedimiento muestra, con toda su crudeza, la necesidad de establecer mecanismos que permitan una relación entre ciudadanos y Administraciones basada en la confianza legítima y, al mismo tiempo, en la adecuada preservación de los intereses generales. Asimismo, la posible producción de daños provocados por la inactividad de la Administración plantea la necesidad de un estudio desde la perspectiva de la responsabilidad extracontractual de las Administraciones públicas. En este aspecto, se pone de relieve el análisis sistemático de los criterios jurisprudenciales sobre los efectos de la inactividad procedimental. Su repercusión, tanto en los estándares de actuación administrativa como en las consecuencias que han podido venir soportando indebidamente los ciudadanos justifica la conveniencia de este trabajo para abogados, empleados o servidores públicos. Para poder encontrar con argumentos sólidos y útiles que, además de examinar críticamente las posiciones tradicionales, contribuyan a repensar los modelos actuales, insistiendo en la conveniencia de revalorizar la obligación de resolver el procedimiento, las garantías que éste comporta y la exigencia de una respuesta debida por parte de las Administraciones públicas.
