Item Régimen de rehabilitación semiabierto en el delito de obstrucción a la justicia y la tutela judicial efectiva(Universidad Tècnica de Ambato, Facultad de Jurisprudencia y Ciencias Sociales, Carrera de Derecho, 2023-09) Manobanda Mazabanda, Elida Gabriela; Acosta Morales, María GabrielaThe prison system in Ecuador has evolved throughout history. The first prison was the García Moreno Prison in 1869, in which people who committed some types of crime were locked up and were only allowed to read the Bible. Nowadays, there are several prisons, including those in Guayaquil, Quito, Cuenca, Latacunga and Ambato. The penitentiary system is in charge, through the state, of executing the punishment of a person who has committed a crime with the aim of rehabilitating him and then being able to be reintegrated into society through activities required and stipulated in the Reglamento de Rehabilitación Social. For this reason, the problem arises from the reform that was carried out on August 17, 2021, in relation to the matter of anti-corruption in the Reform Law to the Comprehensive Organic Criminal Code, in which access to the semi-open regime is prohibited for the crime of obstruction of justice that has a criminal typology within the group of illegal acts that are violating effective judicial protection. Subsequently, this reform entered into force in Article 698 of the Comprehensive Organic Criminal Code, which makes it impossible to propose the semi-open social rehabilitation regime to persons deprived of their liberty who have committed the crime of obstruction of justice. What is stipulated above is contrary to what is established in the República del Ecuador, according to what is embodied in article 425 of the norm, which establishes that all infra-constitutional regulations must be in accordance with it; and, article 698 of the Comprehensive Organic Criminal Code does not allow access to justice to persons deprived of liberty who intend to file the semi-open rehabilitation regime, which is violating the right to effective judicial protection since there is an express norm that denies that claim and that does not allow the protection of constitutional rights through an adequate and technical defense.Item El abuso de las boletas de auxilio y la normativa penal(Universidad Técnica de Ambato, Facultad de Jurisprudencia y Ciencias Sociales , Carrera de Derecho, 2016-11) Andrade Ortiz, Miguel Ángel; Tite, Segundo RamiroThis work titration called "ABUSE OF BALLOTS RELIEF AND REGULATIONS CRIMINAL" proposes that a rigorous when casting a ballot for help, using guesswork fledged scrutiny applies, to avoid damage to the litigants, considering that in our own legislation, there are efficient mechanisms for conflict resolution. Being Judicial proceedings in different units, it is not to pursue the cause, contrary to prevent harm, not only the victim but also to the accused, that constitutional guarantees are respected, in addition to the International.Item La reparación integral de las víctimas y las disposiciones del Código Orgánico Integral Penal(Universidad Técnica de Ambato, Facultad de Jurisprudencia y Ciencias Sociales , Carrera de Derecho, 2016-10) González Mejía, Adriana Cristina; Guevara Fuentes, José RubénThe research work titled: “THE INTEGRAL REPARATION OF THE VICTIMS AND THE PROVISIONS IN THE CÓDIGO ORGÁNICO INTEGRAL PENAL”, performs a thorough analysis of the few provisions contained in the Code Organic Integral Criminal Código Orgánico Integral Penal with respect to integral reparation of victims of criminal offences that consist in three articles that address the rights of victims, the comprehensive reparation of damage and the mechanisms to apply, as well as the principles, rights and guarantees referred to in the Constitution of Ecuador, 2008, and other legal sources, national and international. After a thorough theoretical investigation and field came to determine that the provisions referred to in the Código Orgánico Integral Penal are not sufficient to ensure comprehensive reparation to the victims, but on the contrary many of the times tend to be the cause of that criminal justice bodies incur in serious violations of the protection rights enshrined in the constitution since it is currently what is causing dissatisfaction with these processes is the discretion of the acting operators of justice validating other principles of criminal law that the right of protection and integral reparation to the victims. In this sense, the article 78 of the current Constitution establishes that “The victims of criminal offenses shall benefit from special protection...”, “shall be mechanisms for a repair...” in accordance with the particulars set out in the provisions of the COIP and other international instruments. The integral reparation of the victims of criminal offences is a topic which is taking a great momentum because of the alarming figures of deprotection of the victims at the local, national and international, and is the reason that motivated the conduct of this research, which seeks to offer an alternative solution to the problem, through the establishment of a protocol to inter-agency for the protection, attention and integral reparation to victims of criminal offences.Item La justicia indígena y los tratos crueles e inhumanos en el cantón Ambato(2015) Barrionuevo Silva, Lilian Jazmina; Espín Meléndez, María CristinaActualmente al revisar la normativa jurídica de nuestro país podemos evidenciar que en la Constitución de la República del Ecuador no se especifica el alcance que tiene la Jurisdicción Indígena, y al ser independiente la administración de justicia otorgada por nuestra Constitución a estos grupos comunitarios hemos notado que los castigos infringidos por los líderes de las comunidades indígenas violentan los Derechos Humanos de los procesados dando paso a la tergiversación de las sanciones establecidas por los miembros de las comunidades lo que es tema a tratar dentro de esta tesis, y se llega a evidenciar la no aplicación de los derechos y principios constitucionales, razón por la cual la investigación evidencia la afectación de los Derechos Humanos. Al momento de visualizar dicho problema, es necesario investigarlo para poder cumplir con el principal objetivo de la Constitución, el cual es el respeto a los Derechos Humanos, además de precautelar los principios constitucionales que son inviolables pero que por diferentes circunstancias estos se han visto perjudicados en nuestro cantón, y que gracias a la creación de las Fiscalías de asuntos indígenas se ha tratado de evitar la violaciones de tales Derechos y la afectación del sistema de justicia. La presente investigación está enfocada al planteamiento de una propuesta que se ve encaminado en la creación de un Acuerdo de Compromiso en la Comunidad de Illagua Chico Parroquia de Quisapincha el Cantón Ambato en lo referente al procedimiento de aplicación de Justicia Indígena, puesto que dentro nuestra normativa no se ha especificado lo que se debe hacer o de qué manera se va a sancionar al miembro que cometa una infracción dentro y fuera de la Comunidad, por lo que dentro de la aplicación de Justicia Indígena en dicha comunidad ha vulnerado los Derechos Humanos consagrados en la Constitución de la República del Ecuador, y con esta Acta de Compromiso se pretende regular la aplicación de Justicia Indígena dentro de esta comunidad.
